He and the other plaintiff, Martin Boyd, filed an appeal Thursday with the 10th Circuit in <st1:city st=\"on\"><st1:place st=\"on\">Denver<\/st1:place><\/st1:city>, according to the <a href=\"http:\/\/www.lcsun-news.com\/news\/ci_4800874\" target=\"_blank\">Las Cruces Sun-News<\/a>. They argue that the city\u2019s logo, which includes three crosses, is unconstitutional.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Now the same judge, U.S. District Court Judge Robert Brack, has tossed out Weinbaum\u2019s similar lawsuit against the school district, the Sun-News is reporting <a href=\"http:\/\/www.lcsun-news.com\/news\/ci_4804928\" target=\"_blank\">in a separate article<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The cases have earned <st1:city st=\"on\"><st1:place st=\"on\">Las   Cruces<\/st1:place><\/st1:city> national media attention. Weinbaum argues that the crosses in government logos essentially force Christianity upon him and, in the case of the school district, his child using taxpayer money. The governments argue that the crosses have historical significance.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">After all, the city\u2019s name is <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city>.
