Duran, who is trying to avoid prison time,\u00a0has the option to <a href=\"https:\/\/twitter.com\/steveterrell\/status\/657587705937829889\" target=\"_blank\">withdraw her guilty plea<\/a> at a sentencing hearing in December if the judge attempts to incarcerate her.<\/p>\n<p>The AG&#8217;s Office didn&#8217;t seek to take Duran&#8217;s pension, saying\u00a0<a href=\"http:\/\/law.justia.com\/codes\/new-mexico\/2013\/chapter-31\/article-18\/section-31-18-15.4\" target=\"_blank\">the law<\/a> doesn&#8217;t allow for her to be fined in an amount up to the value of her pension\u00a0in this case.<\/p>\n<p>Duran &#8220;indeed tendered her resignation late last night,&#8221; her\u00a0attorney, Erlinda Ocampo Johnson of Albuquerque, wrote in an email to\u00a0NMPolitics.net early this morning.<\/p>\n<p>Soon thereafter, Duran agreed in court to plead guilty to six of 65 charges she faced, including <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/DuranPleaAgreement.pdf\" target=\"_blank\">embezzlement and money laundering<\/a>. Two of the charges to which Duran admitted are felonies. Glenn Ellington scheduled Duran&#8217;s sentencing <a href=\"https:\/\/twitter.com\/DanBoydNM\/status\/657588922160017409\" target=\"_blank\">for Dec. 14<\/a>. He didn&#8217;t rule out sentencing Duran to prison, even though the Attorney General&#8217;s Office agreed to seek only probation. Ellington said Duran <a href=\"https:\/\/twitter.com\/steveterrell\/status\/657587705937829889\" target=\"_blank\">could withdraw her guilty plea<\/a> at the December hearing if he decides to sentence her to prison time.<\/p>\n<p>Duran was facing\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/08\/nm-secretary-of-state-charged-with-fraud-embezzlement-money-laundering\/\" target=\"_blank\">fraud, embezzlement, money laundering<\/a>\u00a0and dozens of other charges related to abusing the campaign finance reporting system. She initially\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/duran-appears-in-court-pleads-not-guilty\/\" target=\"_blank\">pleaded not guilty<\/a>.<\/p>\n<p>Duran&#8217;s resignation became\u00a0known publicly just after midnight because of the leak of\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/FrequezEmailOnDuran.jpg\" target=\"_blank\">an email<\/a> in which\u00a0Kari Fresquez, interim state elections director, announced the cancellation of several rulemaking hearings scheduled to be held today.<\/p>\n<p>&#8220;In light of Secretary Duran&#8217;s resignation on Thursday evening, the Office of the Secretary of State has cancelled the rulemaking hearings,&#8221; states the 11:18 p.m. Thursday message\u00a0to unknown recipients. It was obtained and <a href=\"http:\/\/www.dpnm.net\/2015\/10\/23\/breaking-dpnm-chairwoman-on-secretary-of-state-durans-resignation\/\" target=\"_blank\">released<\/a> by the Democratic Party of New Mexico.<!--more--><\/p>\n<p>Shortly thereafter, a source with knowledge of the situation confirmed to NMPolitics.net that Duran had indeed resigned. NMPolitics.net isn&#8217;t identifying that source.<\/p>\n<p>Duran submitted <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/DuranResignationLetter.pdf\" target=\"_blank\">her resignation letter<\/a> to Gov. Susana Martinez shortly before midnight Thursday.<\/p>\n<p>&#8220;Although I may be leaving office, I shall always reflect upon the last 36 years of service, honored to work with you and others, serving the citizens of the State of New Mexico,&#8221; Duran wrote in that\u00a0letter.<\/p>\n<p>Martinez, a Republican, is now tasked with appointing a replacement\u00a0to\u00a0lead the Secretary of State&#8217;s Office through the 2016 election.\u00a0Whoever\u00a0Martinez appoints will also have to decide whether to run for re-election almost immediately.\u00a0Voters will select a new secretary of state next year.<\/p>\n<p>Until Martinez makes an appointment, Deputy Secretary of State Mary Quintana is in charge of the office. Martinez spokesman Chris Sanchez said the governor &#8220;hopes to make an appointment in the coming weeks.&#8221;<\/p>\n<p>&#8220;In the interim, our office will <a href=\"http:\/\/www.governor.state.nm.us\/Submit_Your_Resume.aspx\" target=\"_blank\">accept r\u00e9sum\u00e9s<\/a> and recommendations from the public, lawmakers, and other elected officials,&#8221; Sanchez said. &#8220;In wake of Ms. Duran\u2019s resignation, the governor hopes we can come together and move forward as a state.\u201d<\/p>\n<p>Viki Harrison, executive director of Common Cause New Mexico, called Duran&#8217;s resignation &#8220;the first critical step in rebuilding the public&#8217;s trust in our political system.&#8221;<\/p>\n<p>And Lonna Atkeson, a political science professor at the University of New Mexico, characterized Duran&#8217;s resignation as &#8220;clearing the cloud over her administration as plans begin for the 2016 election.&#8221;<\/p>\n<p>&#8220;It&#8217;s important for the integrity of our election system that this happened,&#8221; Atkeson wrote <a href=\"https:\/\/www.facebook.com\/lonna.atkeson\/posts\/910508235651278\" target=\"_blank\">on Facebook<\/a>. &#8220;I hope Governor Martinez quickly appoints a qualified successor who can raise the stature of the office.&#8221;<\/p>\n<p>Duran&#8217;s resignation and plea agreement come almost\u00a0two months after Attorney General Hector Balderas filed <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/08\/nm-secretary-of-state-charged-with-fraud-embezzlement-money-laundering\/\" target=\"_blank\">a criminal complaint<\/a> accusing her\u00a0of\u00a0using campaign funds to keep her personal bank account in the black while gambling at several casinos in New Mexico.<\/p>\n<p>Duran\u00a0allegedly deposited some\u00a0checks intended to be campaign contributions into her personal bank account and never disclosed them as political donations. In other instances the AG&#8217;s office says Duran\u00a0took\u00a0money out of\u00a0her campaign account and deposited\u00a0it into her\u00a0personal account.<\/p>\n<p>In all, Duran is\u00a0accused of misusing\u00a0about\u00a0$10,000 in campaign funds.<\/p>\n<p>Duran\u00a0also faced a charge of <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/duran-faces-new-felony-charge-of-identity-theft\/\" target=\"_blank\">identify theft<\/a> for\u00a0listing a former state senator as her campaign treasurer, allegedly without his knowledge.<\/p>\n<h3>The road to resignation<\/h3>\n<p>As secretary of state, Duran was responsible\u00a0for overseeing the state&#8217;s <a href=\"https:\/\/www.cfis.state.nm.us\/media\/\" target=\"_blank\">campaign finance reporting system<\/a>. So her alleged abuse of\u00a0that very system\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/flawed-nm-campaign-reporting-system-needs-reform-many-say\/\" target=\"_blank\">cast doubt on its integrity<\/a>.<\/p>\n<p>It also\u00a0led to examination of <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/amount-rep-maestas-says-he-failed-to-report-climbs-to-more-than-11k\/\" target=\"_blank\">other candidates&#8217;<\/a>\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/another-officials-campaign-finance-reports-are-under-scrutiny\/\" target=\"_blank\">finance reports<\/a>\u00a0and\u00a0sparked a new conversation <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/reforming-nms-campaign-finance-reporting-system-is-a-must\/\" target=\"_blank\">about reforming the system<\/a>.<\/p>\n<p>But Duran herself was a barrier to such conversations. She insisted on\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/secretary-of-state-duran-was-at-work-last-week-today\/\" target=\"_blank\">showing up to work<\/a> in recent weeks instead of resigning.\u00a0Many balked at the idea of her overseeing the 2016 presidential election.<\/p>\n<p>It got worse when Duran\u00a0went ahead with plans to <a href=\"http:\/\/www.lcsun-news.com\/story\/news\/local\/new-mexico\/2015\/10\/19\/duran-proposes-new-campaign-finance-rules\/74225188\/\" target=\"_blank\">implement\u00a0new rules<\/a> intended to make elections more transparent and accountable. Those were among the rules scheduled for a hearing today.<\/p>\n<p>&#8220;What does embattled Secretary of State Dianna Duran not understand about the problem with putting her name and the word &#8216;reform&#8217; in the same sentence?&#8221; asked the\u00a0Albuquerque Journal editorial board in a piece that ran <a href=\"http:\/\/www.abqjournal.com\/662941\/opinion\/duran-the-last-choice-to-oversee-campaign-reform.html\" target=\"_blank\">earlier this week<\/a>.<\/p>\n<p>The calls for Duran&#8217;s resignation had grown louder in recent weeks.\u00a0<a href=\"http:\/\/www.daily-times.com\/story\/opinion\/editorials\/2015\/09\/11\/editorial-secretary-state-should-resign-now\/72191512\/\" target=\"_blank\">Many<\/a> <a href=\"http:\/\/archive.lcsun-news.com\/las_cruces-opinion\/ci_28811889\/editorial-duran-should-step-down-top-election-official\" target=\"_blank\">of the<\/a> <a href=\"http:\/\/cnjonline.com\/2015\/09\/05\/duran-should-resign-before-impeachment\/\" target=\"_blank\">state\u2019s<\/a>\u00a0<a href=\"http:\/\/www.santafenewmexican.com\/opinion\/editorials\/our-view-dianna-duran-should-resign\/article_aceee791-3d84-5d2c-b631-3f0b98999d77.html\" target=\"_blank\">newspapers<\/a>, <a href=\"http:\/\/www.kob.com\/article\/stories\/s3900786.shtml#.VhqaXbRViko\" target=\"_blank\">politicians<\/a> and even\u00a0<a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/former-duran-aide-adair-calls-for-her-resignation\/article_556e7661-c6eb-5e8d-827f-69ccd9b75dba.html\" target=\"_blank\">former staffers<\/a>\u00a0in the Secretary of State&#8217;s Office\u00a0said she needed to go. So did <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/duran-needs-to-resign-many-nmpolitics-net-readers-say\/\" target=\"_blank\">NMPolitics.net&#8217;s readers<\/a>.<\/p>\n<p>\u201cThere is a confidence problem and, may I add, it is severe,\u201d Cindy Madrid\u00a0of Socorro wrote during a discussion NMPolitics.net facilitated <a href=\"https:\/\/www.facebook.com\/haussamen\/posts\/10100922201108871?comment_id=10100922214422191&amp;offset=0&amp;total_comments=19&amp;comment_tracking=%7B%22tn%22%3A%22R9%22%7D\" target=\"_blank\">on Facebook<\/a>. \u201cThis is why she should not continue in the job. She is compromised even if she is proven to be innocent.\u201d<\/p>\n<p>House Speaker Don Tripp had already initiated the process of <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/speaker-appoints-lawmakers-to-investigate-charges-against-duran\/\" target=\"_blank\">considering impeachment<\/a>, but Duran&#8217;s resignation\u00a0halts the special legislative committee&#8217;s work. Tripp, in a statement, called Duran&#8217;s resignation &#8220;the right thing to do for New Mexico.&#8221;<\/p>\n<p>It also\u00a0puts an end to\u00a0a long political career. Duran\u00a0served two terms as Otero County clerk.\u00a0She\u00a0was a state senator for <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislator_details_archive.aspx?SponsorCode=SDURA\" target=\"_blank\">17 years<\/a>. And,\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/11\/duran-defeats-herrera-in-secretary-of-state-race\/\" target=\"_blank\">in 2010<\/a>,\u00a0Duran became\u00a0the first Republican to be elected secretary of state <a href=\"https:\/\/en.wikipedia.org\/wiki\/Secretary_of_State_of_New_Mexico\" target=\"_blank\">since 1928<\/a>. Voters narrowly re-elected her\u00a0<a href=\"http:\/\/krqe.com\/2014\/11\/05\/duran-to-keep-job-as-secretary-of-state\/\" target=\"_blank\">last year<\/a>.<\/p>\n<h3>On to 2016<\/h3>\n<p>Following Duran&#8217;s resignation, Democrats wasted no time focusing on what&#8217;s next. Deb Haaland, who chairs the state Democratic Party, said she&#8217;s hopeful New Mexico can &#8220;move forward with a fair election in 2016, and that trust can be restored in the Secretary of State\u2019s office.&#8221;<\/p>\n<p>&#8220;We will have a strong Democratic candidate that will take a hard look at the drop in voter participation in New Mexico as well as the other various issues facing the Secretary of State\u2019s office,&#8221; Haaland <a href=\"http:\/\/www.dpnm.net\/2015\/10\/23\/breaking-dpnm-chairwoman-on-secretary-of-state-durans-resignation\/\" target=\"_blank\">said<\/a>.<\/p>\n<p>Meanwhile, state GOP Chairwoman Debbie Maestas said the party respects &#8220;Dianna Duran\u2019s decision to step down amid these recent accusations and help restore credibility to the Secretary of State\u2019s Office.&#8221;<\/p>\n<p>&#8220;Voters rightfully demand that our elected officials be accountable to the law, and our party will continue to advocate for accountability in government,&#8221; Maestas said.<\/p>\n<p><em>This was a breaking news article and was updated repeatedly as the news of Duran&#8217;s resignation and plea agreement unfolded.
