{"id":899,"date":"2006-11-20T12:14:00","date_gmt":"2006-11-20T18:14:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2006\/11\/eeoc-says-school-district-violated-ogas-rights\/"},"modified":"2006-11-20T12:14:00","modified_gmt":"2006-11-20T18:14:00","slug":"eeoc-says-school-district-violated-ogas-rights","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2006\/11\/eeoc-says-school-district-violated-ogas-rights\/","title":{"rendered":"EEOC says school district violated Ogas&#8217; rights"},"content":{"rendered":"<p class=\"MsoNormal\">The U.S. Equal Employment Opportunity Commission has ruled that former Las Cruces Public Schools Superintendent Louis Martinez violated the rights of former Mayfield High School Principal Robert Ogas by chasing him out in 2005.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In a ruling issued Wednesday, the commission found that <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> and the school district discriminated against Ogas based on his age \u2013 he was 64 at the time of his departure \u2013 and his ethnicity.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The controversy over Ogas\u2019 departure led to deep divisions in the school district that have resurfaced in the present controversy over current Superintendent Sonia Diaz. The protests that resulted from Ogas\u2019 departure led to a successful, public push for the school board to oust <st1:place st=\"on\"><st1:city st=\"on\">Martinez<\/st1:city><\/st1:place>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Ogas was a longtime principal at Mayfield and a legend in that community, but there was division within the community and school board over his tenure. Some saw him as a man who ran the best high school in the district, while others saw him as a barrier to better educating underperforming students.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">From the start of his tenure, <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> was at odds with Ogas. The former superintendent placed Ogas on leave in April 2005, leading to the protests that were attended by hundreds of people. <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> later decided to reinstate Ogas through June 2005 \u2013 the end of his contract \u2013 but made no statement about whether the contract would be renewed. Ogas resigned at the beginning of June 2005, but said he was forced to do so.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The EEOC ruled that <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> made the decision to not renew Ogas\u2019 contract before he placed him on leave in April.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Though the EEOC said discrimination did occur, it also found that there was not evidence to support Ogas\u2019 claim that harassment occurred.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">The ruling that there was discrimination, according to the EEOC determination, was made because Ogas was performing his job satisfactorily but was replaced with a younger, non-Hispanic principal. The ruling was also made, it states, because the school district \u201chas not shown that its actions were based on reasons other than discrimination.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The situation now goes to mediation and a potential settlement.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI think it\u2019s important for the public to know that Bob Ogas has gone through an awful lot, that it\u2019s a good thing that he has been vindicated for the treatment he has received by the district, and we\u2019re hopeful for a resolution, so he can get on with his life,\u201d said Ogas\u2019 attorney, Lawrence Pickett.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I was unable to reach officials with the school district for comment. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Equal Employment Opportunity Commission has ruled that former Las Cruces Public Schools Superintendent Louis Martinez violated the rights of former Mayfield High School Principal Robert Ogas by chasing him out in 2005.
