{"id":88742,"date":"2015-10-02T15:51:48","date_gmt":"2015-10-02T21:51:48","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=88742"},"modified":"2015-10-04T21:01:40","modified_gmt":"2015-10-05T03:01:40","slug":"duran-faces-new-felony-charge-of-identity-theft","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/10\/duran-faces-new-felony-charge-of-identity-theft\/","title":{"rendered":"Duran faces new felony charge of identity theft"},"content":{"rendered":"<p><em>This article has been updated.<\/em><\/p>\n<p>The Attorney General&#8217;s Office filed <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/10.2.15-New-Duran-complaint.pdf\" target=\"_blank\">a\u00a0new\u00a0felony charge<\/a> against Secretary of State Dianna Duran on Friday, accusing her of identity theft for listing a former state senator as her campaign treasurer without his knowledge.<\/p>\n<div id=\"attachment_55834\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-55834\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg\" alt=\"Dianna Duran\" width=\"336\" height=\"232\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna.jpg 518w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><\/a><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Dianna Duran<\/p><\/div>\n<p>The new\u00a0charge\u00a0comes after\u00a0The Santa Fe New Mexican\u2019s Milan Simonich <a href=\"http:\/\/www.santafenewmexican.com\/opinion\/local_columns\/ringside-seat-tables-have-turned-for-duran-once-a-harsh\/article_3aa70c75-b9f8-522b-bc27-2c30b3b243b1.html\" target=\"_blank\">wrote on Monday<\/a>\u00a0about Duran listing a Don Kidd as her campaign treasurer in 2010.<\/p>\n<p>\u201cIf she listed me, she did it on her own,\u201d Simonich quoted Kidd as saying. \u201cI didn\u2019t sign any checks or pay any bills for her, and that\u2019s what a campaign treasurer does.\u201d<\/p>\n<p>Kidd said the same thing to investigators.<\/p>\n<p>&#8220;Mr. Kidd explained that the information on the campaign reports was untrue; he was not the campaign treasurer,&#8221; states\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/10.2.15-New-Duran-complaint.pdf\" target=\"_blank\">the new criminal complaint<\/a> filed Friday. &#8220;He advised that he contributed to the campaign, but that was his only involvement.&#8221;<\/p>\n<p>Duran listed Kidd as her treasurer on <a href=\"https:\/\/www.cfis.state.nm.us\/media\/CandidateReportH.aspx?es=13&amp;ot=1&amp;o=17&amp;c=393&amp;p=0&amp;d=&amp;ct=0&amp;fn=&amp;ln=duran\" target=\"_blank\">10 reports<\/a> filed between 2010 and 2013, according to the complaint.<!--more--><\/p>\n<p>The attorney general charged Duran <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/08\/nm-secretary-of-state-charged-with-fraud-embezzlement-money-laundering\/\" target=\"_blank\">in August<\/a> with fraud, embezzlement and money laundering in a 64-count criminal complaint alleging she\u00a0abused the state&#8217;s campaign finance system for personal gain. Among the allegations\u00a0is that\u00a0Duran\u00a0deposited a $600 check into her personal account that her campaign issued to Sean Davis of Tularosa for \u201cequipment &amp; work on campaign,\u201d the attorney general claims.<\/p>\n<p>Duran allegedly forged Davis\u2019 signature. Investigators say Davis didn\u2019t work for Duran, endorse the check, or receive the money.<\/p>\n<p>So it\u2019s important to know\u00a0who, if anyone, was watching Duran\u2019s campaign finances as treasurer.<\/p>\n<p>The new criminal complaint states that investigators have compared Duran&#8217;s 2010 campaign bank account with her <a href=\"https:\/\/www.cfis.state.nm.us\/media\/CandidateReportH.aspx?es=13&amp;ot=1&amp;o=17&amp;c=393&amp;p=0&amp;d=&amp;ct=0&amp;fn=&amp;ln=duran\" target=\"_blank\">finance reports<\/a> and found more than 100 bank transactions totaling more than $10,000 that don&#8217;t show up on Duran&#8217;s finance reports.<\/p>\n<p>In <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/10\/Notice-of-intent-to-introduce-evidence-endorsed-copy.pdf\" target=\"_blank\">a separate document<\/a> filed in court Friday, the Attorney General&#8217;s Office stated that the\u00a0unreported bank spending included\u00a0&#8220;transactions at casinos, restaurants, gas stations and jewelry stores and cash withdrawals at ATM machines.&#8221;<\/p>\n<p>That document, which details some of the evidence the AG&#8217;s Office plans to introduce against Duran, also states the following:<\/p>\n<ul>\n<li>That Duran &#8220;misrepresented her finances in tax returns annually from\u00a02010 and 2013.&#8221;<\/li>\n<li>That in 2010 Duran deposited &#8220;several&#8221; checks into a personal bank account she shares with her husband that indicated they were campaign donations but\u00a0weren&#8217;t reported on campaign finance reports. Duran&#8217;s husband hasn&#8217;t been charged in the case.<\/li>\n<li>That in August 2010 Duran deposited a check from\u00a0former state Rep. and lieutenant governor candidate Brian Moore and his wife Linda into her personal account. The $500 check had &#8220;Secretary of State!&#8221; written on the memo line, the court filing states. Duran has not been charged with any crime related to the check from the Moores.<\/li>\n<\/ul>\n<p>Duran has <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/09\/duran-appears-in-court-pleads-not-guilty\/\" target=\"_blank\">pleaded not guilty<\/a> to the charges filed in August.
