I\u2019ll have more throughout the weekend, so check back often. Keep in mind, my analysis is not an indication of who I want to win. I don\u2019t do endorsements.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Here\u2019s my analysis of the judicial races.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">District Judge, Division 5<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Schultz%2C%20Lisa.24.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Schultz%2C%20Lisa.28.jpg\" alt=\"\" border=\"0\" \/><\/a>Newly appointed District Judge Lisa Schultz, a Democrat, is challenged by Republican Janetta Hicks.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Schultz has the advantage of being the incumbent. She\u2019s only been on the bench a few weeks, but she\u2019s able to urge voters to \u201ckeep Judge Schultz\u201d in her advertising. Hicks, on the other hand, has been on leave from her job as a senior deputy district attorney and had more time to campaign while Schultz settled in to her new job.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Both have worked on campaigns in the past. Hicks has worked on more than one successful GOP campaign, so she knows what it takes for a Republican to win a county-wide race. She also has District Attorney Susana Martinez helping her, and <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> is one of the most brilliant campaigners in the area.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Hicks%2C%20Janetta.2.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Hicks%2C%20Janetta.2.jpg\" alt=\"\" border=\"0\" \/><\/a>Schultz has the advantage of being a Democrat in a Democratic county. She has more money and also has good people working on her side.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Both are running solid campaigns and have been visible in the community.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Some say Hicks\u2019 weakness is her tie to <st1:city st=\"on\">Martinez<\/st1:city>, but <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> got 58 percent of the vote in 2004 as a Republican in a Democratic county, so I don\u2019t see it as an issue.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Others say the fact that Schultz is a lesbian \u2013 she\u2019s been in a committed relationship with another woman for 31 years \u2013 might hurt her among conservative Democrats, of which there are many in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>. Is this county ready to elect an openly homosexual judge to the children\u2019s court? I\u2019ve been asked that question by several Democrats in recent weeks.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">I think voters in this county are ready for that, and I don\u2019t see it as being much of an issue in this race. Though there are a lot of conservative Democrats in the area, <st1:city st=\"on\"><st1:place st=\"on\">Las   Cruces<\/st1:place><\/st1:City> also has a very high per-capita rate of gay and lesbian residents.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Though the two candidates are very different \u2013 one is obviously liberal and the other is clearly conservative \u2013 both are excellent candidates. This should be a close race.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">District Judge, Divisio<\/span><span style=\"font-size:130%;\">n<\/span><span style=\"font-size:130%;\"> 8<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Neumann%2C%20Rita.1.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Neumann%2C%20Rita.1.jpg\" alt=\"\" border=\"0\" \/><\/a>Newly appointed District Judge Fernando Macias, a Democrat, is challenged by Republican Rita Nu\u00f1ez-Neumann.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">A strong Republican candidate could have run a tight race against Macias. Neumann was not that candidate.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Macias, a longtime politician, is vulnerable on some issues, particularly past decisions he made as a lawyer and county manager that affected people in the south county, a Democratic stronghold. Though he has reasonable explanations for the choices he has made, a strong opponent could have used those choices against him.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Macias%2C%20Fernando.10.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Macias%2C%20Fernando.9.jpg\" alt=\"\" border=\"0\" \/><\/a>Neumann has run a negative campaign against Macias, which until this election season had been almost unheard of in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>. But her attacks haven\u2019t been effective. She has portrayed Macias as a political hack, and talked about all the awards she has won, but has provided little insight into the type of judge she would be.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Macias has effectively responded by agreeing that he is a politician, and sharing why he believes that experience will help him lead a reform of the children\u2019s court.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">To top it off, Neumann doesn\u2019t have the respect of the legal community in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename>  <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>, and has been passed up by bipartisan judicial nominating commissions several times when she sought appointments to the bench. Judicial races get little attention from the public. Many Republican attorneys won\u2019t vote for Neumann and, when asked, will recommend that others don\u2019t, either.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Both candidates are controversial within their own parties. Expect there to be fewer votes by members of both parties in this race than in other races on the ballot.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Magistrate Judge, Division 2<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Newly appointed Magistrate Judge Joseph Guillory, a Democrat, is challenged by Republican Steven Foldy.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">If you want to talk about a Democratic stronghold in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename>  <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>, it\u2019s the magistrate court. It takes a rare candidate or circumstance for a Republican to win a magistrate race. Currently, all five judges on the court are Democrats.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">This race has had little visibility, making it even harder for Foldy to counter Guillory\u2019s advantage of being a member of the majority party.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Foldy planned to work a lot of overtime in his job as a corporal at the sheriff\u2019s department to help finance his campaign, but the federal Hatch Act put an end to that, and Foldy\u2019s campaign has suffered as a result.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Probate Judge<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Like the other incumbents in contested judicial races, Democrat Alice Salcido was appointed, not elected, to the position. The county commission gave her the job in early 2005, so she has a lot more experience than the other incumbents in judicial races. Salcido is challenged by Republican Patrick Curran, a former magistrate judge (one of the few Republicans to hold that position). Curran is a valid challenger, but he ran for clerk two years ago and was blown away by Democrat Rita Torres.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In addition, Salcido is running a more active campaign. In a low-visibility race \u2013 most people don\u2019t even know what the probate judge does \u2013 it\u2019s important to be actively campaigning. That\u2019s especially true when you\u2019re an Anglo, male Republican running against a Hispanic Democrat in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename>  <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">***<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">It\u2019s no coincidence that all incumbents in the contested judicial races in <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename>  <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place> were appointed. The judiciary has been rocked by repeated scandal in recent years, and three of the four vacancies these candidates filled were created as a result of scandal.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Though none of the incumbent judges in these races have been implicated in judicial scandals, this is the X Factor: Will these new judges, but incumbents nonetheless, be viewed as part of the problem and, if so, will they lose votes because of it?<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">If there is an anti-incumbent judicial wave, it\u2019s most likely to help Hicks, because that should be the closest of all these races. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>This begins my analysis of the local races in Do\u00f1a Ana County.
