{"id":79630,"date":"2015-08-30T13:25:22","date_gmt":"2015-08-30T19:25:22","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=79630"},"modified":"2015-08-31T21:27:00","modified_gmt":"2015-09-01T03:27:00","slug":"charges-against-duran-followed-by-shock-caution-quiet","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/08\/charges-against-duran-followed-by-shock-caution-quiet\/","title":{"rendered":"Charges against Duran followed by shock, caution, quiet"},"content":{"rendered":"<p>Democrats and Republicans locked in highly charged battles\u00a0over problems at\u00a0the <a href=\"http:\/\/nmpoliticalreport.com\/11547\/suit-gov-ped-secretary-influenced-aps-deputy-superintendent-hire\/\" target=\"_blank\">Albuquerque Public Schools<\/a>\u00a0and <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/07\/cabinet-secretary-denies-wrongdoing-in-tax-case\/\" target=\"_blank\">the work of the state auditor<\/a>, among other issues, put their guns down over the weekend, at least temporarily, after Secretary of State Dianna Duran was charged with\u00a0abusing the New Mexico&#8217;s\u00a0campaign finance system.<\/p>\n<div id=\"attachment_55834\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-55834\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg\" alt=\"Dianna Duran\" width=\"336\" height=\"232\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna.jpg 518w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><\/a><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Dianna Duran<\/p><\/div>\n<p>The allegations come from the office of Attorney General Hector Balderas, a Democrat who accuses Duran, a Republican, of\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/08\/nm-secretary-of-state-charged-with-fraud-embezzlement-money-laundering\/\" target=\"_blank\">fraud, embezzlement, money laundering<\/a>\u00a0and other charges. Duran allegedly used\u00a0funds intended for\u00a0her campaign instead for personal use &#8212; apparently\u00a0including gambling.<\/p>\n<p>Instead of responding to the charges by accusing Balderas of partisan motives, the state&#8217;s top Republicans\u00a0issued statements that some\u00a0interpreted\u00a0as\u00a0placing distance between themselves and\u00a0Duran &#8212; or at least not wanting to be viewed as defending her.<\/p>\n<p>&#8220;We respect Dianna Duran and her legal team&#8217;s rights to present the facts and defend these allegations,&#8221; said Deborah Maestas, who chairs\u00a0the Republican Party of New Mexico. &#8220;However if allegations are true, she needs to be fully accountable under the law. The attorney general must hold elected officials of both parties to the same legal and ethical standards without partisan bias.&#8221;<\/p>\n<p>Gov. Susana Martinez, a Republican, issued a similar statement\u00a0after meeting with Balderas.<\/p>\n<p>\u201cThese allegations are deeply troubling and concerning, and all relevant state agencies have and will continue to assist the attorney general throughout the process,\u201d Martinez said. \u201cIt\u2019s important that New Mexicans understand that no one is above the law and that every New Mexican is treated equally under our system.\u201d<!--more--><\/p>\n<p>Democrats weren&#8217;t saying much at all, though Do\u00f1a Ana County Clerk Lynn Ellins posted a comment on NMPolitics.net&#8217;s Facebook page in response to those who were criticizing Republicans.<\/p>\n<p>&#8220;In all fairness, do not blame the Republican Party for this,&#8221; <a href=\"https:\/\/www.facebook.com\/haussamen\/posts\/10100889675814821?comment_id=10100889884900811&amp;offset=0&amp;total_comments=27&amp;comment_tracking=%7B%22tn%22%3A%22R8%22%7D\" target=\"_blank\">Ellins, a Democrat, wrote<\/a>. &#8220;Whodda known?&#8221;<\/p>\n<p>Duran isn&#8217;t accused of stealing public money. She&#8217;s accused of taking advantage of the campaign finance system to illegally use money donated to her campaign. Investigators allege several\u00a0instances in which checks intended to be campaign donations were deposited into Duran&#8217;s personal bank account. And according to <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/diannaduran_redacted.pdf\" target=\"_blank\">the criminal complaint<\/a>, about $430,000 was\u00a0electronically debited from accounts controlled by Duran at several New Mexico casinos in 2013 and 2014.<\/p>\n<p>Duran&#8217;s office is responsible for\u00a0policing ethics and campaign finance reporting in New Mexico, which makes the allegations against her even more stunning to many.<\/p>\n<p>Some politicians and officials were wondering what&#8217;s next: Would Duran resign? If not, would\u00a0the N.M. House of Representatives, which is controlled by Republicans, initiate impeachment proceedings?<\/p>\n<p>Some were also noting that, in a statement given to NMPolitics.net Friday, Duran&#8217;s attorney didn&#8217;t deny the allegations. Erlinda Ocampo Johnson instead alleged &#8220;potential violations of the law&#8221; in the way Balderas&#8217; office investigated. Johnson said she would be filing a motion to dismiss the complaint.<\/p>\n<h3>Common Cause &#8216;shocked&#8217;<\/h3>\n<p>Viki Harrison, executive director of Common Cause New Mexico, said the organization was &#8220;shocked&#8221; by the allegations against the state official in charge of &#8220;the implementation of campaign finance laws, ethics enforcement for candidates and lobbyists, and the operation of elections across the state.&#8221;<\/p>\n<p>&#8220;These are critical functions in our state government, and we were very encouraged to read Gov.\u00a0Martinez\u2019s statement ensuring that \u2018all relevant state agencies have and will continue to assist the attorney general throughout the process,'&#8221; Harrison said.<\/p>\n<p>&#8220;These charges are serious, and we are hopeful for a quick and fair outcome in court so this important office can get back to business and the state is not dragged through a long process that further deteriorates public trust in our elected officials,&#8221; she said.<\/p>\n<h3>&#8216;Wow. Just wow.&#8217;<\/h3>\n<p>Meanwhile, during NMPolitics.net&#8217;s Facebook discussions, some New Mexicans commented about yet another politician being charged with serious crimes. Duran joins a long list of New Mexico elected officials from the past decade or so to face criminal allegations.<\/p>\n<p>&#8220;Wow. Just wow. The NM political scene is like a corrupt onion,&#8221; wrote\u00a0<a href=\"https:\/\/www.facebook.com\/haussamen\/posts\/10100889675814821?comment_id=10100890430382661&amp;offset=0&amp;total_comments=27&amp;comment_tracking=%7B%22tn%22%3A%22R5%22%7D\" target=\"_blank\">Allison Smith<\/a> of Carlsbad. &#8220;I hope more and more layers keep getting peeled away.&#8221;<\/p>\n<p>In recent years most politicians facing criminal charges have been Democrats.
