{"id":7628,"date":"2009-10-09T10:39:51","date_gmt":"2009-10-09T16:39:51","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=7628"},"modified":"2009-10-09T10:41:04","modified_gmt":"2009-10-09T16:41:04","slug":"eeoc-sues-gop-lieutenant-governor-candidate%e2%80%99s-business","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/10\/eeoc-sues-gop-lieutenant-governor-candidate%e2%80%99s-business\/","title":{"rendered":"EEOC sues GOP lieutenant guv candidate\u2019s business"},"content":{"rendered":"<div id=\"attachment_6463\"  class=\"wp-caption module image alignright\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-6463\" title=\"Moore, Brian\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2009\/09\/Moore-Brian1.jpg\" alt=\"Brian Moore\" width=\"120\" height=\"160\" \/><p class=\"wp-caption-text\">Brian Moore<\/p><\/div>\n<p>A business owned by Republican lieutenant governor candidate <a href=\"http:\/\/www.brianmoorenm.com\/\">Brian Moore<\/a> is being sued for allegedly not hiring a job applicant because he had a learning disability.<\/p>\n<p>The U.S. Equal Employment Opportunity Commission is bringing the lawsuit against Clayton Ranch Market, a grocery store owned by Moore and his wife Linda, according to the <a href=\"http:\/\/www.qcsunonline.com\/news\/clayton-7659-market-lawsuit.html\">Quay County Sun<\/a>.<\/p>\n<p>The lawsuit, according to the newspaper, claims the store didn\u2019t hire Robert Harris in April 2008 to be a stocker and bagger because of a learning disability, in violation of the Americans With Disabilities Act.<\/p>\n<p>\u201cThe EEOC\u2019s investigation revealed that Clayton Ranch Market hired people with the same or similar qualifications as Mr. Harris, yet Mr. Harris, who sought employment with the store, was neither hired or contacted about a job,\u201d the EEOC\u2019s Rayford Ivrin said in a press release, according to the newspaper. \u201cEmployers cannot deny employment to qualified applicants because of disability.\u201d<\/p>\n<p>Moore told the newspaper he could not comment on details, but added, \u201cWe categorically deny any wrongdoing and look forward to defending our reputation in court.\u201d<\/p>\n<p>The lawsuit seeks back wages, compensatory and punitive damages and the institution and carrying out of a company policy prohibiting discrimination against those with disabilities.<\/p>\n<p>Moore, who was a state representative from Clayton for eight years, entered the race for lieutenant governor <a href=\"..\/2009\/09\/former-rep-moore-running-for-lieutenant-governor\/\">five weeks ago<\/a>. The only other announced Republican candidate for lieutenant governor is <a href=\"http:\/\/standforprogress.com\/learnaboutjrdamron.html\">J.R.
