{"id":7212,"date":"2009-10-02T12:03:16","date_gmt":"2009-10-02T18:03:16","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=7212"},"modified":"2009-10-02T12:03:16","modified_gmt":"2009-10-02T18:03:16","slug":"ag-hands-off-case-involving-his-cousin-business-partner","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/10\/ag-hands-off-case-involving-his-cousin-business-partner\/","title":{"rendered":"AG hands off case involving his cousin, business partner"},"content":{"rendered":"<div id=\"attachment_7213\"  class=\"wp-caption module image alignright\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-7213\" title=\"King, Gary\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2009\/10\/King-Gary1.jpg\" alt=\"Gary King\" width=\"120\" height=\"160\" \/><p class=\"wp-caption-text\">Gary King<\/p><\/div>\n<p>Attorney General <a href=\"http:\/\/nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\">Gary King<\/a> has referred a case involving his cousin to the 1st Judicial District Attorney\u2019s Office in Santa Fe \u201cto avoid any potential conflicts,\u201d the <a href=\"http:\/\/www.abqjournal.com\/news\/state\/022322570963newsstate10-02-09.htm\">Albuquerque Journal<\/a> is reporting.<\/p>\n<p>The case involves a request from the <a href=\"http:\/\/www.nmprc.state.nm.us\/\">Public Regulation Commission\u2019s<\/a> top attorney to determine whether the sale of water by a company owned in part by Commissioner <a href=\"http:\/\/www.nmprc.state.nm.us\/commissioner2.htm\">David King<\/a> to two water utilities governed by the PRC violates state law. David and Gary King are first cousins and partners in two businesses, Pine Canyon Ranch Inc. and King Land and Cattle Co.<\/p>\n<p>From the Journal:<\/p>\n<blockquote><p>\u201cDavid King is part-owner of Estancia Basin Water Supply, which for years has sold water to two utilities, New Mexico American Water Co. and Thunder Mountain Water Co., which serve customers in the Edgewood area.\u201d<\/p><\/blockquote>\n<p>Gary King is not involved in Estancia Basin Water Supply.<\/p>\n<p>An AG spokesman was quoted by the Journal as saying that the decision to refer the case to the DA was made by the chief deputy attorney general, and that Gary King wasn\u2019t involved.<\/p>\n<p>This isn\u2019t the only case in which Gary King is facing conflict-of-interest allegations. His office is prosecuting the case against the former secretary of state and others even though one of the defendants, Elizabeth Kupfer, <a href=\"..\/2009\/08\/defendant-once-carried-out-firing-of-ag-prosecutor\/\">used to work for King<\/a>. In addition, when Kupfer worked for the previous AG, she once <a href=\"..\/2009\/08\/defendant-once-carried-out-firing-of-ag-prosecutor\/\">carried out the firing<\/a> of one of the two prosecutors now working on the case against her.<\/p>\n<p>Defense attorneys plan to use the situation to argue that Gary King\u2019s office has no business prosecuting the case.
