{"id":70018,"date":"2015-07-29T23:51:32","date_gmt":"2015-07-30T05:51:32","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=70018"},"modified":"2016-04-14T10:05:11","modified_gmt":"2016-04-14T16:05:11","slug":"customs-and-border-protection-should-embrace-systemic-reforms","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/07\/customs-and-border-protection-should-embrace-systemic-reforms\/","title":{"rendered":"Customs and Border Protection should embrace systemic reforms"},"content":{"rendered":"<p><strong>COMMENTARY:<\/strong> U.S. Customs and Border Protection (CBP) lacks transparency, a use-of-force policy that prioritizes human life, and adequate internal affairs staffing to prevent corruption and abuse.<\/p>\n<div id=\"attachment_70023\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-70023\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Erickson-Brian-336x211.jpg\" alt=\"Brian Erickson\" width=\"336\" height=\"211\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Erickson-Brian-336x211.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Erickson-Brian.jpg 393w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><\/a><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Brian Erickson<\/p><\/div>\n<p>These were the conclusions drawn in a Homeland Security Advisory Council report <a href=\"http:\/\/www.elpasotimes.com\/news\/ci_28470499\/government-report-states-cbp-vulnerable-to-corruption-local-unions-argue-results-are-misleading\" target=\"_blank\">highlighted July 11 by the El Paso Times<\/a>.<\/p>\n<p>The most important takeaway from this report, however, should be that every time peer law enforcement experts get an inside look at CBP, the results are alarming.<\/p>\n<p>The recommendations in this report \u2014 particularly reforms to uses of force \u2014 mirror recommendations made in February 2013 by another panel of police experts, the Police Executive Research Forum.<\/p>\n<h3>Why the resistance?<\/h3>\n<p>This begs the question: Why is our nation&#8217;s largest police force so resistant to implementing law enforcement best practices?<\/p>\n<p>For example, CBP continues to provide its officers <a href=\"https:\/\/www.aclu-nm.org\/guiltyuntilproveninnocent\/\" target=\"_blank\">gaping exceptions to racially profile<\/a>.<\/p>\n<p>Border Patrol doesn&#8217;t document or publicly report any data, aggregated by demographics, on stops and searches not resulting in arrests.\u00a0Doing so would bring CBP in line with a key recommendation from the <a href=\"http:\/\/www.cops.usdoj.gov\/policingtaskforce\" target=\"_blank\">Task Force on 21st Century Policing<\/a> and restore community trust.<!--more--><\/p>\n<p>CBP&#8217;s lack of transparency extends to complaints, investigations and data regarding use of force.<\/p>\n<div class=\"articleEmbeddedAdBox\">\n<p>Even after the agency promised greater transparency, it recently announced it would take no action against agents who used deadly force in nearly every single one of the 67 cases <a href=\"http:\/\/www.cbp.gov\/sites\/default\/files\/documents\/PERFReport.pdf\" target=\"_blank\">reviewed by PERF<\/a>, which may include cases where PERF concluded that agents fired their weapons out of &#8220;frustration.&#8221;<\/p>\n<p>CBP&#8217;s former head of internal affairs, <a href=\"http:\/\/www.washingtonpost.com\/politics\/border-agencys-former-watchdog-says-officials-impeded-his-efforts\/2014\/08\/16\/ce143288-2304-11e4-8593-da634b334390_story.html\" target=\"_blank\">James F. Tomsheck<\/a>, called one-fourth of the 28 shooting deaths he reviewed since January 2010 &#8220;highly suspect&#8221; and added that CBP distorted facts to cover up wrongdoing.<\/p>\n<p>Furthermore, data on uses of force and assaults often lack detail or definitions for meaningful analysis to check the accuracy of CBP claims.<\/p>\n<p>The Arizona Republic&#8217;s <a href=\"http:\/\/www.azcentral.com\/story\/news\/local\/arizona\/2015\/01\/02\/border-patrol-assaults-fall\/21175493\/\" target=\"_blank\">analysis of existing data<\/a> found in January 2015 that assaults against Border Patrol &#8220;fell sharply in fiscal 2014, for the sixth year in a row,&#8221; which is contrary to CBP&#8217;s claims.<\/p>\n<p>In its <a href=\"http:\/\/www.azcentral.com\/news\/politics\/articles\/20140107numbers-dont-back-need-lethal-force-border.html\" target=\"_blank\">January 2014 report<\/a>, The Republic noted that Border Patrol agents in Arizona were far less likely than local police to be assaulted at all or with dangerous weapons.<\/p>\n<p>There also can be no denying the seriousness of this advisory council&#8217;s conclusion that CBP arrests per capita for corruption exceed other federal agencies.<\/p>\n<p>A <a href=\"http:\/\/www.politico.com\/magazine\/story\/2014\/10\/border-patrol-the-green-monster-112220.html#.VafTHaRVikr\" target=\"_blank\">Politico Magazine investigation<\/a> in December 2014 found that &#8220;between 2005 and 2012, nearly one CBP officer was arrested for misconduct every single day.&#8221; By 2014, the FBI&#8217;s McAllen office saw Border Patrol agents as their number one priority for criminal investigations.<\/p>\n<h3>Implement best practices<\/h3>\n<p>To be clear, we want Border Patrol agents to go home to their families safe and uninjured after every shift.
