{"id":69983,"date":"2015-07-29T23:54:09","date_gmt":"2015-07-30T05:54:09","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=69983"},"modified":"2015-07-30T20:51:26","modified_gmt":"2015-07-31T02:51:26","slug":"cabinet-secretary-denies-wrongdoing-in-tax-case","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/07\/cabinet-secretary-denies-wrongdoing-in-tax-case\/","title":{"rendered":"Cabinet secretary denies wrongdoing in tax case"},"content":{"rendered":"<p>The head\u00a0of the state&#8217;s Taxation and Revenue Department did not pressure\u00a0employees to give special treatment to a taxpayer she used to work for, a spokesman says.<\/p>\n<div id=\"attachment_70003\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-70003\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Padilla-Demesia-336x223.jpg\" alt=\"Demesia Padilla\" width=\"336\" height=\"223\" \/><\/a><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Demesia Padilla<\/p><\/div>\n<p>Secretary Demesia Padilla &#8220;did nothing wrong and flatly denies the allegations that she acted improperly,&#8221; said Ben Cloutier,\u00a0the department&#8217;s communications director.<\/p>\n<p>An audit of the taxpayer was apparently an issue the department&#8217;s staff handled delicately.\u00a0Cloutier provided NMPolitics.net with a copy of <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/TRDEmail.jpg\" target=\"_blank\">an Oct. 15, 2014 email<\/a>\u00a0that appears to reference the taxpayer, who\u00a0<a href=\"http:\/\/www.santafenewmexican.com\/news\/blogs\/politics\/who-is-the-mystery-client-in-the-tax-rev-investigation\/article_2353b444-271e-11e5-835c-2f87e87fd1a6.html\" target=\"_blank\">hasn&#8217;t been named\u00a0publicly<\/a>. Kevin Sourisseau, the department&#8217;s Audit &amp; Compliance Division deputy director, wrote in the email that an audit of the taxpayer &#8220;has not received any special consideration from the audit staff.&#8221;<\/p>\n<p>&#8220;Thank you for your support with this difficult and uncomfortable issue,&#8221; he wrote to\u00a0Lizzy Vedamanikam, director of the department&#8217;s Administrative Services Division.<\/p>\n<p>The email\u00a0refers to a discussion about\u00a0the audit with Padilla the day before\u00a0and states that &#8220;No changes have been made to the audit.&#8221;<\/p>\n<p>Cloutier didn&#8217;t immediately respond to questions about the email.<\/p>\n<h3>AG is investigating<\/h3>\n<p>State Auditor Tim Keller has asked the attorney general to investigate accusations that Padilla <a href=\"http:\/\/www.abqjournal.com\/610748\/news\/tax-and-rev-secretary-identified-as-subject-of-complaint.html\" target=\"_blank\">pressured state employees<\/a> to give special treatment to the taxpayer, who\u00a0she worked for as a certified public accountant before joining\u00a0the administration\u00a0of Gov. Susana Martinez. Keller has\u00a0alleged &#8220;<a href=\"http:\/\/www.abqjournal.com\/618665\/news\/state-auditor-keller-accused-in-california-case.html\" target=\"_blank\">abuse of power<\/a>.&#8221;<!--more--><\/p>\n<p>The investigation started with\u00a0an anonymous tip to\u00a0the auditor&#8217;s fraud hotline, states\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Gov-Letter-RE-TRD.pdf\" target=\"_blank\">a letter<\/a>\u00a0from the auditor to Gov. Susana Martinez, Padilla&#8217;s boss.<\/p>\n<p>An independent firm\u00a0Keller hired\u00a0found justification to launch an\u00a0investigation into whether Padilla &#8220;inappropriately&#8221; influenced employees to benefit the taxpayer, according to\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/AG-Letter-RE-TRD.pdf\" target=\"_blank\">a letter<\/a> from the auditor to Attorney General Hector Balderas. The firm\u00a0also found reason to investigate whether Padilla retaliated against employees who refused to help her, and whether other senior-level employees in the department assisted Padilla.<\/p>\n<p>In a statement to NMPolitics.net, Padilla said she&#8217;s focused on doing her job.<\/p>\n<p>\u201cWe have a very political state auditor who is willing to play fast and loose with the facts to get some media attention,&#8221; Padilla said. &#8220;His allegations are based on unsubstantiated claims by two former disgruntled employees who have an ax to grind.&#8221;<\/p>\n<p>In an earlier statement,\u00a0Cloutier said those former employees &#8220;either work for the state auditor or were fired for sexual harassment.&#8221; He didn&#8217;t name them.<\/p>\n<p>Keller has accused the Tax and Revenue Department of <a href=\"http:\/\/nmpoliticalreport.com\/7521\/state-auditor-trd-tried-to-obstruct-investigation\/\" target=\"_blank\">trying to obstruct<\/a> his office&#8217;s probe.<\/p>\n<h3>War of words<\/h3>\n<p>Democrats and Republicans have engaged in a war of words since Keller, a Democrat, announced that he was turning the allegations against Padilla, a Republican, over to Balderas, a Democrat, earlier this month. Cloutier\u00a0called Keller &#8220;the most political state auditor in New Mexico history&#8221; and\u00a0said the auditor\u00a0was\u00a0was pushing &#8220;false claims for the sake of grabbing a headline.\u201d<\/p>\n<p>The state&#8217;s Democratic Party has\u00a0called for Padilla&#8217;s resignation. The state GOP called Keller\u00a0\u201ca politician willing to smear anyone to generate a headline.\u201d<\/p>\n<p>Meanwhile, Martinez&#8217;s spokesman has said the Republican governor is is looking into the matter but also\u00a0said Keller is &#8220;highly partisan&#8221; and &#8220;has a history of playing fast and loose with the facts in order to see his name in the paper.&#8221;<\/p>\n<p>&#8220;It\u2019s important that we first get all the facts \u2014 something that the state auditor has failed to provide,\u201d Martinez spokesman\u00a0Chris Sanchez was quoted by <a href=\"http:\/\/www.abqjournal.com\/610748\/news\/tax-and-rev-secretary-identified-as-subject-of-complaint.html\" target=\"_blank\">the Albuquerque\u00a0Journal<\/a> as saying.<\/p>\n<p>Keller has not publicly released\u00a0evidence to demonstrate\u00a0wrongdoing.
