Under Flores, children must be placed in state-licensed shelters that require certain standards such as specific staff-to-child ratios and reporting suspected child abuse.<\/p>\n<p>In another significant change, the new Trump regulations would allow children who arrived with parents to be detained in unlicensed family detention centers. The Department of Homeland Security would hire an auditor to \u201censure compliance with the family residential standards established by ICE (U.S. Immigration and Customs Enforcement),\u201d<a href=\"https:\/\/www.federalregister.gov\/documents\/2018\/09\/07\/2018-19052\/apprehension-processing-care-and-custody-of-alien-minors-and-unaccompanied-alien-children\" target=\"_blank\" rel=\"noopener\"> the rules<\/a> read.<\/p>\n<p>Put another way, the government would be licensing itself.<\/p>\n<p>\u201cIt\u2019s absurd,\u201d said Neha Desai, immigration director for the National Center for Youth Law and one of the lawyers in the Flores case.<\/p>\n<p>\u201cIf these regulations were to go into effect in this country, it would be a dramatic step backward in providing the most fundamental of rights and protections for some of the most vulnerable children in this country,\u201d Desai said.<\/p>\n<p>The new regulations would affect the <a href=\"https:\/\/www.nytimes.com\/2018\/09\/12\/us\/migrant-children-detention.html\" target=\"_blank\" rel=\"noopener\">nearly 13,000<\/a> children currently in the care of the Office of Refugee Resettlement, which operates more than 100 shelters in 17 states.<\/p>\n<p>\u201cWhat they\u2019re trying to do with the rules is expand their power to detain families and children for longer in worse conditions,\u201d said Ai-jen Poo, one of the leaders of the Families Belong Together coalition.<!--more--><\/p>\n<p>The Flores standards, she added, put \u201ca check on the administration.\u201d<\/p>\n<p>The Flores agreement forced the government to comply with a set of national standards on the detention, care and release of immigrant children. The settlement was a result of a class-action lawsuit filed in 1985 by immigrant advocacy groups over the treatment of unaccompanied minors.<\/p>\n<p>In September, the Departments of Homeland Security and Health and Human Services<a href=\"https:\/\/www.revealnews.org\/blog\/government-seeks-to-end-court-oversight-of-how-it-treats-immigrant-children\/\" target=\"_blank\" rel=\"noopener\"> moved to replace<\/a> the agreement with the new regulations. Lawyers representing the children<a href=\"https:\/\/www.documentcloud.org\/documents\/5030474-Flores-Injunction.html\" target=\"_blank\" rel=\"noopener\"> filed an injunction<\/a> Nov. 2, arguing that the new rules violate the terms of the Flores agreement.<\/p>\n<p>The Department of Health and Human Services declined to comment because the case is pending. In <a href=\"https:\/\/www.documentcloud.org\/documents\/5096626-Government-Response-to-Motion-to-Enforce.html\" target=\"_blank\" rel=\"noopener\">a response<\/a> filed last week, government lawyers argue that the injunction is \u201cpremature\u201d because the regulations aren\u2019t finalized. Officials still have to review more than 95,000 comments submitted by the public since the rules were posted in the Federal Register on Sept. 7.<\/p>\n<p>The new rules also would strip children of the right to see an immigration judge if they\u2019re considered a flight risk or a danger to themselves or others. Instead, a minor could request a hearing before an official from the Department of Health and Human Services, \u201chardly a neutral and detached decisionmaker,\u201d lawyers say in court filings.<\/p>\n<p>That arrangement may mean more children end up in psychiatric facilities or jails such as the Yolo County Juvenile Detention Facility in California, where minors have reported being<a href=\"https:\/\/www.mercurynews.com\/2018\/06\/26\/yolo-county-retains-youth-immigrant-contract-amid-controversy\/\" target=\"_blank\" rel=\"noopener\"> pepper-sprayed<\/a> by guards.<\/p>\n<p>\u201cI cannot shower because the water is so hot that it is making my hair fall out,\u201d a 17-year-old held at Yolo told lawyers, according to the <a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.cacd.45170\/gov.uscourts.cacd.45170.501.1.pdf\" target=\"_blank\" rel=\"noopener\">court filings<\/a>. \u201cThe food here tastes bad, the only thing that I eat is fruit because the rest does not have any flavor. I have lost weight since being in Yolo because I can\u2019t eat the food.\u201d<\/p>\n<p>Leah Chavla, policy adviser at the Women\u2019s Refugee Commission, said the proposed regulations are concerning because the government has violated the Flores agreement before. Over the summer, for instance, Shiloh Treatment Center near Houston came under scrutiny for<a href=\"https:\/\/www.revealnews.org\/blog\/immigrant-children-forcibly-injected-with-drugs-lawsuit-claims\/\" target=\"_blank\" rel=\"noopener\"> injecting immigrant children in its care<\/a> with powerful psychiatric drugs without proper consent. A federal judge <a href=\"https:\/\/www.revealnews.org\/blog\/judge-orders-government-to-release-immigrant-kids-from-troubled-shelter\/\" target=\"_blank\" rel=\"noopener\"> ordered<\/a> the government in July to stop the practice, though attorneys allege it\u2019s<a href=\"https:\/\/www.revealnews.org\/blog\/immigrant-children-still-being-drugged-at-shelter-despite-judges-order-lawyers-say\/\" target=\"_blank\" rel=\"noopener\"> still continuing<\/a>.<\/p>\n<p>\u201cThey\u2019re saying, \u2018Trust me, trust us, we\u2019re going to self-regulate,\u2019 \u201d Chavla said. \u201cIt\u2019s just expecting everybody to place blind trust on them, and I don\u2019t think that\u2019s warranted.\u201d<\/p>\n<p>A hearing on the regulations is scheduled for Nov. 30 in front of U.S. District Judge Dolly Gee in the Central District of California.<\/p>\n<p><em>Have a news tip related to immigration for Reveal?
