First, she was separated from her 15-year-old son under the U.S. government\u2019s short-lived <a href=\"https:\/\/www.texastribune.org\/2018\/04\/06\/feds-order-border-prosecutors-adopt-zero-tolerance-policy-immigration\/\" target=\"_blank\" rel=\"noopener\">\u201czero-tolerance\u201d<\/a> policy after fleeing what she described as 17 years of physical and emotional abuse \u2014 including death threats \u2014 from her husband and illegally crossing the Rio Grande on May 16.<\/p>\n<p dir=\"ltr\">They were quickly apprehended by Border Patrol agents near McAllen and requested asylum; Luz was sent to the Port Isabel Detention Center while her son was shipped to a San Antonio migrant youth shelter. Luz said she left her six other children in the care of her mother and other relatives in Honduras; her lawyer said she hoped to gain asylum and bring them to the United States to join her.<\/p>\n<aside class=\"module align-left half type-aside\">\n<h3>About this article<\/h3>\n<p>This article originally appeared in\u00a0<a href=\"https:\/\/www.texastribune.org\/2018\/10\/26\/migrant-mother-denied-surgery-scar-ice-detention\/\" target=\"_blank\" rel=\"noopener\">The Texas Tribune<\/a>,\u00a0a nonpartisan, nonprofit media organization that informs Texans and engages with them about public policy, politics, government and statewide issues.<\/p>\n<\/aside>\n<p dir=\"ltr\">Then, within a week of arriving at Port Isabel, Luz said her umbilical hernia and Cesarean section scar \u2014 the aftermath of delivering her seventh child in March 2017 \u2014 ripped open.<\/p>\n<p dir=\"ltr\">So began a four-month medical nightmare.<\/p>\n<p dir=\"ltr\">After being assigned a top bunk in her Port Isabel room, Luz said she told ICE agents about her surgeries and her concern that repeated climbing onto the bed could irritate the scars.<\/p>\n<p dir=\"ltr\">\u201cWell it was a long time ago, you\u2019ll be fine,\u201d Luz said an agent told her.<\/p>\n<p dir=\"ltr\">Within a week, Luz said her abdomen started leaking.<\/p>\n<p dir=\"ltr\">\u201cI could feel my shirt get wet,\u201d she said. \u201cAnd I told my roommates to check what was happening to me, and they told me, \u2018Oh God Luz, your C-section opened up.\u2019\u201d<\/p>\n<p dir=\"ltr\">Luz said she could fit her pinky finger into the scar\u2019s hole and she was in a lot of pain. She said a doctor in the detention center prescribed antibiotics and gave her ibuprofen for the pain, and she was under a nurse\u2019s care at the facility for eight days.<\/p>\n<p dir=\"ltr\">According to an obstetrics and gynecology faculty doctor at the Texas Tech University Health Sciences Center in Odessa, Luz\u2019s seven pregnancies likely left her stomach muscles weakened, resulting in an umbilical hernia. While such hernias are not uncommon or typically painful, the doctor said heavy lifting and straining can lead to additional problems and increased pain in any incision area, which could explain how Luz\u2019s C-section scar reopened.<\/p>\n<p dir=\"ltr\">In an emailed statement to the Tribune, ICE spokesperson Adelina Pruneda said the agency could not comment on Luz\u2019s case, but the agency \u201ctakes very seriously the health, safety and welfare of those in our care &#8230; comprehensive medical care is provided to all individuals in ICE custody.\u201d<\/p>\n<p dir=\"ltr\">Pruneda said detention centers provide 24-hour emergency care and are staffed with doctors, nurses, licensed mental health providers, physician assistants and nurse practitioners. But it\u2019s increasingly difficult for an applicant to qualify for asylum on the grounds of domestic or gang violence alone after U.S. Attorney General Jeff Sessions&#8217; <a href=\"https:\/\/www.texastribune.org\/2018\/06\/11\/jeff-sessions-victims-domestic-or-gang-violence-asylum\/\" target=\"_blank\" rel=\"noopener\">announcement in June<\/a> that essentially eliminated domestic abuse and gang threats as qualifying factors.<\/p>\n<p dir=\"ltr\">After denying her credible fear claim, Luz said the officer told her she could either be deported with her son or deported alone.<\/p>\n<p dir=\"ltr\">\u201cIt was either you\u2019re both going to go back home, or he can stay and you go back home,\u201d Luz\u2019s attorney, Ruby Powers, explained. \u201cShe chose to give him a better life if that meant she had to waive her rights to reunification.\u201d<!--more--><\/p>\n<p dir=\"ltr\">\u201cNobody was helping her,\u201d Powers added. \u201cShe didn\u2019t know any better and she was distraught because of the separation and because of the pain.\u201d<\/p>\n<p dir=\"ltr\">After nearly a month in Port Isabel, Luz was transferred to the South Texas Detention Center in Pearsall, where she said doctors gave her more ibuprofen and wrapped her scar. She said doctors told her that because she had a deportation order, they wouldn\u2019t be able to do anything more than manage the pain through ibuprofen.<\/p>\n<p dir=\"ltr\">\u201cIt closed on its own, but only from the outside,\u201d Luz said. \u201cThe doctor told me from the inside it was still open.\u201d<\/p>\n<p dir=\"ltr\">Luz said she couldn\u2019t do anything but lie in bed due to the intense pain.<\/p>\n<h3 dir=\"ltr\">&#8216;The moment that saved her&#8217;<\/h3>\n<p dir=\"ltr\">Powers, a Houston-based attorney who has worked on other \u201czero-tolerance\u201d family separation cases, learned about Luz\u2019s case in early September, just before The American Civil Liberties Union and President Trump <a href=\"https:\/\/www.aclu.org\/news\/aclu-comment-asylum-agreement-family-separation-challenge\" target=\"_blank\" rel=\"noopener\">reached an agreement<\/a> that would allow families \u2014 many who said they had signed away their reunification rights under distress \u2014 <a href=\"https:\/\/www.aclu.org\/news\/aclu-comment-asylum-agreement-family-separation-challenge\" target=\"_blank\" rel=\"noopener\">another credible fear interview<\/a>.<\/p>\n<p dir=\"ltr\">\u201cThat was the moment that saved her,\u201d Powers said.<\/p>\n<p dir=\"ltr\">Asylum officers reviewed her case following the ACLU announcement, and her negative review was <a href=\"https:\/\/www.texastribune.org\/2018\/09\/25\/jeff-sessions-donald-trump-asylum-migrant-parents\/\" target=\"_blank\" rel=\"noopener\">changed to positive<\/a>, making her eligible for bond. Luz\u2019s son was released from the shelter to family in New York three weeks ago, and Luz said doctors at Pearsall re-examined her wound.<\/p>\n<p dir=\"ltr\">\u201cNow all of a sudden she had a surgery date,\u201d Powers said. \u201cIt is apparent that not until she had legal representation were her medical concerns taken seriously.\u201d<\/p>\n<p dir=\"ltr\">ICE arranged for Luz to have surgery on Sept. 24 in a San Antonio hospital. When she woke up from the procedure, Luz said an ICE agent shackled her hands and feet. After a day in the hospital, she was released back to the detention center.<\/p>\n<p dir=\"ltr\">She walked out of Pearsall with Powers on Tuesday night after the immigration nonprofit organization RAICES posted her $9,000 bond.<\/p>\n<p dir=\"ltr\">After five months of separation, Luz was scheduled to fly to New York on Thursday to see her son.<\/p>\n<p dir=\"ltr\"><em>Elsa Cavazos contributed to this report.<\/em><\/p>\n<p dir=\"ltr\"><i>Disclosure: Texas Tech University has been a financial supporter of The Texas Tribune, a nonprofit, nonpartisan news organization that is funded in part by donations from members, foundations and corporate sponsors.
