Half of that amount, or thirty percent of his total funds, comes from companies that have\u00a0<a href=\"http:\/\/dataaccess.nmstatelands.org\/DataAccess\/lease_information.aspx\" target=\"_blank\" rel=\"noopener\">active leases<\/a>\u00a0with the State Land Office. Those lessees are largely oil and gas companies, ranchers or dairy producers.<\/p>\n<p>Garcia Richard has raised $220,000 from 1,036 donors, 72 percent of which are $200 or less. Her big donors are primarily labor unions and tribes. Only 49 of her donors live outside New Mexico. Seven of her donors are ranchers, contributing a total of $3,875.<\/p>\n<p>The money advantage going into the general election season greatly favors Lyons. He reported $183,568 on hand in early September, compared to Garcia Richard\u2019s $32,816. Garcia Richard says if that\u2019s his argument, then, \u201cI\u2019m going to come back with, he\u2019s been our only land commissioner that\u2019s had one of his very poor land decisions have to be overturned by our New Mexico State Supreme Court.\u201d<\/p>\n<p>Back in 2010, the state supreme court overruled a\u00a0<a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/n-m-supreme-court-halts-white-peak-land-swap\/article_f5e21295-c508-55c1-9163-d51125409905.html\" target=\"_blank\" rel=\"noopener\">land swap<\/a>\u00a0Lyons had coordinated in White Peak for failing to follow public auction requirements. That exchange, Lyons contends, would have created contiguous lands open to hunters in an area where it\u2019s tough to see the line between state trust and private land.<\/p>\n<p>\u201cI was just trying to keep someone from getting shot,\u201d he says.<\/p>\n<p>In an audit released at the end of Lyons\u2019 second term, Attorney General Hector Balderas found inadequate documentation and arbitrary appraisals, the results of which he estimated cost New Mexicans millions of dollars. Lyons insists his deals were above-board and that boxes stacked in the corner of his office are full of documents to prove it.<\/p>\n<p>\u201cNobody did any late-night deals,\u201d he adds. \u201cI left that office with 78,000 more acres. \u2026 There wasn\u2019t a deal we lost money on.\u201d<\/p>\n<p>Former land commissioner Ray Powell says the office has struggled with openness. When he first took over at the state land office in 1993 his stationary arrived without any contact information printed on it.<\/p>\n<p>\u201cI said, \u2018What\u2019s the deal here?\u2019\u201d he recalls. \u201cAnd they really scratched their heads and looked at the floor, and said, \u2018We were told not to put it on.\u2019 And I said \u2018Why?\u2019 And they said, \u2018Because if we do, they\u2019ll call us.\u2019<!--more--><\/p>\n<p>\u201cIt was a closed shop and flew under the radar, and that\u2019s how you got away with so much.\u201d<\/p>\n<p>One way Garcia Richard says she\u2019s tried to steer clear of those historic troubles and put herself in position to better advocate for New Mexicans when it comes to getting their fair share from oil and gas starts before she\u2019s even in office. The royalty rate is set by state statute, and she argues it\u2019s too low.<\/p>\n<p>\u201cThat\u2019s benefitting the individual and not the state, and if you want to look at campaign finance reports, you might be able to find out why,\u201d she says. \u201cSo this is why I get accused of demonizing the industry, and I feel like, it\u2019s not appropriate for me \u2014 when I\u2019m going to be sitting across the table negotiating with someone, it\u2019s not appropriate for them to fund my campaign.\u201d<\/p>\n<p>It\u2019s a principle current commissioner Aubrey Dunn has also shown some traces of. In 2017, he announced he was\u00a0<a href=\"http:\/\/www.artesianews.com\/1513305\/land-commissioner-returns-campaign-contributions-from-owner-of-company-filing-suit.html\" target=\"_blank\" rel=\"noopener\">returning $4,500 in campaign contributions<\/a>\u00a0from a company and its principal officer after they sued him over his policies crafted to protect the Ogallala Aquifer.<\/p>\n<p>Lyons took issue both with the idea that Garcia Richard wasn\u2019t taking money from those with a special interest in the state land office, arguing that her campaign finance reports show donations from ranchers.<\/p>\n<p>\u201cContributions don\u2019t influence what I do. They never have for 26 years.
