She had previously resigned amid questions about possible preferential treatment of a former client.<\/p>\n<div id=\"attachment_70003\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-70003\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Padilla-Demesia.jpg\" alt=\"Demesia Padilla\" width=\"336\" height=\"223\" \/><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Demesia Padilla<\/p><\/div>\n<p>A spokesman for Attorney General Hector Balderas confirmed that special agents with the AG\u2019s office filed nine criminal charges against former Tax and Revenue Department Secretary Demesia Padilla.<\/p>\n<p>At the time of publication, the criminal complaint against Padilla was not yet available through online court records.<\/p>\n<p>James Hallinan, a spokesman for Balderas, said Padilla was charged with \u201cEngaging in an Official Act for Personal Financial Gain, Embezzlement over $20,000.00, Computer Access with Intent to Defraud or Embezzle and five counts of violating Ethical Principles of Public Service.\u201d<\/p>\n<p>Through a records request,\u00a0<i>NM Political Report<\/i>\u00a0obtained the criminal complaint which alleges Padilla embezzled more than $25,000 from a former client when she worked as a certified public accountant, before she was a cabinet secretary. Padilla is also being charged with five violations of the Governmental Conduct Act.<\/p>\n<p>The complaint also contains extensive information from interviews with Padilla\u2019s former employees, alleging the former secretary tried to give preferential treatment to a former client and tried to cover up wrongdoing.<\/p>\n<p><a href=\"http:\/\/nmpoliticalreport.com\/135343\/breaking-padilla-resigns-after-ags-search-warrant\/\" target=\"_blank\" rel=\"noopener\">Padilla resigned in December 2016<\/a>, after Balderas\u2019 office issued a search warrant for both Padilla\u2019s personal and professional records. That search warrant was one of many pieces of the\u00a0<a href=\"http:\/\/nmpoliticalreport.com\/series\/demesia-padilla-scandal\/\" target=\"_blank\" rel=\"noopener\">Padilla scandal<\/a>, which began with an audit from then-State Auditor Tim Keller. In 2015, Keller, now the mayor of Albuquerque, said an audit showed Padilla gave preferential treatment to a former client, later revealed to be Albuquerque business Harold\u2019s Trucking. Susana Martinez appointed her as Tax and Revenue Department Secretary, Padilla worked for Harold\u2019s Trucking as a certified public accountant.
