Under the administration\u2019s \u201czero tolerance\u201d policy, when parents cross the border illegally, their children are taken from them because they cannot be sent to jails.<\/p>\n<aside class=\"module align-left half type-aside\">\n<h3>About this article<\/h3>\n<p>This article originally appeared in\u00a0<a href=\"https:\/\/www.texastribune.org\/2018\/06\/20\/trump-order-immigrant-families-together-separated\/\" target=\"_blank\" rel=\"noopener\">The Texas Tribune<\/a>,\u00a0a nonpartisan, nonprofit media organization that informs Texans and engages with them about public policy, politics, government and statewide issues.<\/p>\n<h3>Read the order<\/h3>\n<p>Read the executive order Trump signed <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/affording-congress-opportunity-address-family-seperation\/\" target=\"_blank\" rel=\"noopener\">by clicking here<\/a>.<\/p>\n<\/aside>\n<p dir=\"ltr\">The order directs that, \u201cto the extent permitted by law,\u201d immigrant families should be held together in immigration detention facilities run by the Department of Homeland Security. Trump said the order will end the family separations while prosecutions continue. The decision to keep children \u2014 some reportedly as young as 8 months old \u2014 away from their parents and under the care of strangers has drawn strong rebukes from lawmakers, religious leaders and immigration advocates across the country.<\/p>\n<p dir=\"ltr\">\u201cWe\u2019re going to have strong, very strong borders, but we\u2019re going to keep the families together,\u201d Trump said.<\/p>\n<p dir=\"ltr\">Meanwhile, Senate Republicans \u2014 including both U.S. senators from Texas \u2014 introduced the Keep Families Together and Enforce the Law Act, which would hold families together in detention centers run by the Department of Homeland Security as they await a court hearing. That would effectively give the administration the best of both worlds: a strict immigration process without the family separations that have earned near-universal backlash.<\/p>\n<p dir=\"ltr\">\u201cA zero tolerance policy is exactly correct; I think a family reunification policy is exactly correct,\u201d U.S. Sen. <a href=\"https:\/\/www.texastribune.org\/directory\/john-cornyn\/\" target=\"_blank\" rel=\"noopener\">John Cornyn<\/a> told reporters Wednesday.<\/p>\n<p dir=\"ltr\">The executive and legislative measures are geared toward the same goal. But, Cornyn said, congressional action is necessary because \u201cthere probably will be legal challenges to the president\u2019s executive order.\u201d<\/p>\n<p dir=\"ltr\">\u201cIt\u2019s important to have the backstop of congressional action to be able to preserve this family unity goal,\u201d said Cornyn, who is among the most powerful Republicans in Congress.<\/p>\n<p dir=\"ltr\">The executive order seems to put Trump squarely at odds with a 1997 legal constraint, known as the Flores settlement, which says children may not be detained for more than 20 days, even if they are with their parents. That had kept President Barack Obama from keeping families together in detention centers during a similar immigration surge.<!--more--><\/p>\n<p dir=\"ltr\">In the order, Trump directs Attorney General Jeff Sessions to work to \u201cmodify\u201d that settlement agreement to permit the government \u201cto detain alien families together throughout the pendency of criminal proceedings for improper entry or any removal or other immigration proceedings.\u201d<\/p>\n<p dir=\"ltr\">The executive order also represents a sharp departure from the administration\u2019s previous position, a reversal that seems to have been prompted by a flood of public outcry.<\/p>\n<p dir=\"ltr\">Facing widespread, harsh criticism from both sides of the aisle and all corners of the country, Trump at first defended the policy by saying he was simply following the law and insisted, incorrectly, that only Congress could stop the separations.<\/p>\n<p dir=\"ltr\">Under past administrations, most first-time border crossers had not been criminally prosecuted for illegally entering the country.<\/p>\n<p dir=\"ltr\">Even in Texas, where prominent Republicans tend to hew to the Trump line, many statewide Republican leaders, including Gov. <a href=\"https:\/\/www.texastribune.org\/directory\/greg-abbott\/\" target=\"_blank\" rel=\"noopener\">Greg Abbott<\/a> and both of the state&#8217;s U.S. senators, had been calling for ending the separations. Members of the Texas congressional delegation on both sides of the aisle praised Trump\u2019s order, voicing relief that the humanitarian and public relations disaster would now come to an end.<\/p>\n<p dir=\"ltr\">\u201cHe did the right thing. I\u2019m glad he did it,\u201d said U.S. Rep. <a href=\"https:\/\/www.texastribune.org\/directory\/ted-poe\/\" target=\"_blank\" rel=\"noopener\">Ted Poe<\/a>, R-Houston.<\/p>\n<p dir=\"ltr\">As he walked into a vote Wednesday afternoon, U.S. Rep. <a href=\"https:\/\/www.texastribune.org\/directory\/henry-cuellar\/\" target=\"_blank\" rel=\"noopener\">Henry Cuellar<\/a>, D-Laredo, shouted over his shoulder, \u201cIt\u2019s about time.\u201d<\/p>\n<p dir=\"ltr\">Democrats were reluctant, though, to give credit to Trump for ending a problem he started in the first place.<\/p>\n<p dir=\"ltr\">\u201cThis was a problem that he alone created,\u201d said U.S. Rep. <a href=\"https:\/\/www.texastribune.org\/directory\/joaquin-castro\/\" target=\"_blank\" rel=\"noopener\">Joaquin Castro<\/a>, D-San Antonio.<\/p>\n<p dir=\"ltr\">And representatives were divided over whether Congress needs to codify measures to keep immigrant families together.<\/p>\n<p dir=\"ltr\">\u201cIt\u2019d be nice to codify his actions, but it\u2019s not absolutely essential,\u201d said U.S. Rep. Lamar Smith, R-San Antonio. \u201cThis probably solves the problem.\u201d<\/p>\n<p dir=\"ltr\">Cuellar agreed. But a number of Texas lawmakers emphasized the unpredictable nature of executive orders \u2014 and argued that Congress must pass legislation to ensure families are not subject to the whim of a president\u2019s pen.<\/p>\n<p dir=\"ltr\">\u201cIt\u2019s an executive order, and we all know executive orders can be changed by whoever comes around, comes to office later,\u201d Poe said. \u201cBut this is Congress\u2019 responsibility, and Congress must weigh in on this issue, as well as border security and immigration.\u201d<\/p>\n<p dir=\"ltr\"><em>Abby Livingston contributed reporting from Washington.
