For additional articles and more information, visit the home page for this special report by clicking <\/span><a style=\"font-style: italic;\" href=\"http:\/\/haussamen6.blogspot.com\/\">here<\/a><span style=\"font-style: italic;\">.<\/span>  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Two attorneys and a judge criticized the judicial discipline process and suggested changes to improve the system during a candid legislative committee hearing Thursday in <st1:place st=\"on\"><st1:city st=\"on\">Las   Cruces<\/st1:city><\/st1:place>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Several members of the <a href=\"http:\/\/legis.state.nm.us\/lcs\/committeedetail.asp?CommCode=COJ\" target=\"_blank\">Courts, Corrections and Justice Committee<\/a> expressed concern about aspects of the process for disciplining misbehaving judges, and said the discussion was productive and would help improve the system.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The discussion included more than two hours of blunt and, at times, tense debate about the current system and the <a href=\"http:\/\/www.supremecourtlawlibrary.org\/JSC\/Main.htm\" target=\"_blank\">Judicial Standards Commission<\/a>, the state body charged with holding judges accountable to the <a href=\"http:\/\/www.conwaygreene.com\/nmsu\/lpext.dll\/Infobase5\/225e9\/29ccb?f=templates&#038;fn=document-frame.htm&amp;2.0\" target=\"_blank\">Code of Judicial Conduct<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Bosson%2C%20Richard.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Bosson%2C%20Richard.jpg\" alt=\"\" border=\"0\" \/><\/a>State <a href=\"http:\/\/www.supremecourt.nm.org\/\" target=\"_blank\">Supreme Court<\/a> Chief Justice Richard Bosson opened the hearing by sharing some history of the 38-year-old commission and addressing the recent increase in its activity, which was sought by the high court in response to several high-profile incidents of judicial misconduct in 2004.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cTheir work is more intense and they work at a more frenetic pace and they accomplish more,\u201d Bosson said. \u201cWe appreciate that. \u2026 I really think they\u2019ve done a fine job and they play a very, very important role.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">At the same time, Bosson acknowledged, there has been scrutiny of several aspects of the commission\u2019s work, including its confidentiality.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI know that\u2019s been the subject of discussion, and it should be,\u201d he said, adding that the commission is not \u201cperfect.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Commission Chair David Smoak said the system works well.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe are not broken, if that\u2019s the concern,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/White%2C%20Lawrence.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/White%2C%20Lawrence.jpg\" alt=\"\" border=\"0\" \/><\/a>Two <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city> attorneys who have defended judges in their dealings with the commission disagreed. Attorney Lawrence White, who represented former Do\u00f1a Ana County Magistrate Judge <a href=\"http:\/\/haussamen6.blogspot.com\/2006\/08\/magistrate-judge-susana-chaparro.html\" target=\"_blank\">Susana Chaparro<\/a>, said the problem isn\u2019t with commission\u2019s members or staff, but rather with the process.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThey have to work with what they have, but what they have is broken, ladies and gentlemen,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Youngers%2C%20Joleen.0.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Youngers%2C%20Joleen.0.jpg\" alt=\"\" border=\"0\" \/><\/a>Attorney Joleen Youngers, who represented former District Judge <a href=\"http:\/\/haussamen6.blogspot.com\/2006\/08\/district-judge-larry-ramirez-resigned.html\" target=\"_blank\">Larry Ramirez<\/a>, agreed. She said she has spoken to many judges and attorneys who have dealt with the commission and believe it \u201cis intruding and second-guessing,\u201d has involved itself in \u201cadministrative matters\u201d more properly dealt with by the Administrative Office of the Courts, and \u201chas unduly expanded its view of what should merit its attention.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">White said he believes the system is set up so that accused judges are \u201cguilty until proven innocent.\u201d He said a commission hearing is a \u201cquasi criminal proceeding,\u201d and said it takes the votes six of 11 commission members \u201cto find the judge at guilt.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThe commission charges and the commission convicts,\u201d White said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Noel%2C%20Jim.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Noel%2C%20Jim.jpg\" alt=\"\" border=\"0\" \/><\/a>Commission Director Jim Noel pointed out that the commission does not have the authority to discipline judges and its findings aren\u2019t rulings of guilt. Its staff attorneys conduct investigations and the commission decides, following hearings, whether to ask the high court to discipline judges.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The high court, not the commission, is the judge of guilt, several at the hearing said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Concern about treatment of local judges<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">White and Youngers expressed concern over the filing by the commission of public requests that the high court temporarily suspend judges while it investigates allegations against them. Such a filing in the current case of suspended Do\u00f1a Ana County Magistrate Judge <a href=\"http:\/\/haussamen6.blogspot.com\/2006\/08\/magistrate-judge-carlos-garza.html\" target=\"_blank\">Carlos Garza<\/a> included affidavits detailing alleged drug use and other charges. Youngers said because of that \u201cit\u2019s hard to image that, regardless of the outcome, he will ever enjoy good reputation or success as a judge ever again.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">State Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=186&#038;Submit=Search\" target=\"_blank\">Joseph Cervantes<\/a>, D-Las Cruces, agreed.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThat, to me, is the end of a judge\u2019s career,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">A week after those allegations became public, the high court sealed Garza\u2019s file. Bosson told the legislative committee that, since then, the court has issued a ruling requiring that all requests for temporary suspension remain under seal. That will mean no allegations become public unless the commission, after it completes its investigation, initiates formal proceedings against a judge.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Youngers and White also expressed concern about the cost of defense against an ethical complaint, which Youngers said can cost $50,000 or more.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cEven if unjustly accused, even if none of the violations stand, they have to foot that bill,\u201d she said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Such was the case with Las Cruces Municipal Judges <a href=\"http:\/\/haussamen6.blogspot.com\/2006\/08\/municipal-judge-melissa-miller-byrnes.html\" target=\"_blank\">Melissa Miller-Byrnes<\/a> and <a href=\"http:\/\/haussamen6.blogspot.com\/2006\/08\/municipal-judge-james-t-locatelli.html\" target=\"_blank\">James T. Locatelli<\/a>, who spent more than $100,000 defending themselves against an ethical complaint. All but one of the charges against Miller-Byrnes were later dismissed by the high court, and all of the charges against Locatelli were dismissed.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Locatelli%2C%20Jim.4.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Locatelli%2C%20Jim.4.jpg\" alt=\"\" border=\"0\" \/><\/a>Locatelli was in attendance at Thursday\u2019s hearing and addressed the committee.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI now have a legal debt of over $60,000. My reputation has suffered. My family has suffered. I have suffered,\u201d he said. \u201cIn short, justice was not done.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Unlike White, Locatelli said the commission and Noel are to blame.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThe commission abuses its own processes,\u201d he said. \u201cSomething is wrong with the system. Something needs to be done.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He said there was \u201ca naked attempt by Mr. Noel to muscle us\u201d into admitting to misconduct, and that Noel only offered a deal that would resolve the complaint after the judges learned that he and one of the men who filed the complaint against them went to law school together and are both active in the Democratic Party.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The implication was clear. Noel did not address Locatelli\u2019s comments during the hearing, but responded afterward.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThat\u2019s the most ridiculous, ludicrous, absurd thing I\u2019ve ever heard,\u201d he said, adding that a provision in the <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> <a href=\"http:\/\/www.fscll.org\/JSC\/const.htm\" target=\"_blank\">Constitution<\/a> prohibits him from discussing the specifics of any deals discussed with Locatelli and Miller-Byrnes.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIt\u2019s very easy to fabricate things because I can\u2019t answer with all of the facts,\u201d Noel said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Youngers said she believes the recent actions of the commission have resulted in the judiciary losing \u201ctalented judges\u201d and discouraged good attorneys from seeking judgeships.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI fear that we\u2019re also tainting the reputation of the judiciary,\u201d she said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">State Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=215&#038;Submit=Search\" target=\"_blank\">Al Park<\/a>, D-Albuquerque, said he didn\u2019t agree that good applicants are discouraged by the commission\u2019s actions. He pointed out that there have been a number of applicants for recent judicial vacancies.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI\u2019m not buying your argument,\u201d he said. \u201cIf the vacancies were going unfilled, I\u2019d probably be more receptive to that.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Youngers countered by pointing out that Locatelli ran unopposed in the last election. Park said that might be because Locatelli is a good judge, but Cervantes said Youngers is right.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI\u2019m concerned about the chilling effect,\u201d Cervantes said. \u201cI\u2019ll be honest with you. I disagree with those who say there has not been a chilling effect.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Suggestions for change<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">White suggested that the commission needs \u201cindependent advice,\u201d and said it\u2019s unfair that the attorneys who argue cases before the commission also provide it with legal advice.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Under the current system, one or two of the commission\u2019s three attorneys will argue a case before the commission, and another attorney not involved in the case will serve as an adviser to the commission on that case; however, the next case could be argued by the attorney who advised the commission on that one. All three staff attorneys fill both roles at different times.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">White and Youngers suggested the creation of a panel separate from the commission that would review incoming complaints.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Noel said some state\u2019s commissions have a two-tier process: A smaller panel evaluates allegations and decides which cases should be sent to a larger commission, and that body decides whether to seek discipline. Such a system can work, Noel said, but he also believes the current system works.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI don\u2019t think it\u2019s broken. I know that there is concern that the process does not provide adequate due process,\u201d Noel said, adding that the process is not criminal or civil and those standards of due process do not apply. \u201cJudges are entitled to the amount of process that is due in an administrative hearing.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">White and Youngers suggested that there should be some mechanism for reimbursing the legal costs incurred by judges who are later cleared of charges. Bosson said he believes \u201cthere is some fairness to that\u201d but added that the state would have to pay for such an expense.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There was also debate about whether judges are actually resigning because of the cost of defense. Ramirez claimed that is why he quit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Noel said it\u2019s hard to know what is actually in a judge\u2019s mind when he or she resigns. He acknowledged that some have said they were resigning because they could not afford the cost of defending themselves, but also said, \u201con the other hand, maybe that\u2019s an excuse. Maybe they know their conduct was so egregious that they\u2019re going to lose.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Smoak said that has been the case with some judges.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe\u2019ve seen them resign to avoid any of (the allegations) becoming public,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Noel said the only way for the public to know for certain that judges aren\u2019t resigning solely because of the cost of legal defense would be to \u201copen up the process\u201d and get rid of the constitutional duty of the commission to keep most of its work secret.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There is no timetable for legislative or other action to change the commission\u2019s procedures or structure.
