{"id":579,"date":"2006-09-14T06:23:00","date_gmt":"2006-09-14T12:23:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2006\/09\/politics-of-auditor-snafu-create-a-dangerous-new-precedent-and-will-discourage-some-voters\/"},"modified":"2006-09-14T06:23:00","modified_gmt":"2006-09-14T12:23:00","slug":"politics-of-auditor-snafu-create-a-dangerous-new-precedent-and-will-discourage-some-voters","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2006\/09\/politics-of-auditor-snafu-create-a-dangerous-new-precedent-and-will-discourage-some-voters\/","title":{"rendered":"Politics of auditor snafu create a dangerous new precedent and will discourage some voters"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Armijo%2C%20Jeff.12.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Armijo%2C%20Jeff.12.jpg\" alt=\"\" border=\"0\" \/><\/a>It appears politics beat the law in the battle over whether Jeff Armijo would be the Democrats\u2019 candidate for state auditor.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I\u2019m not saying <st1:place st=\"on\">Armijo<\/st1:place> would have won. But we\u2019ll never know, and the action taken by the secretary of state to remove <st1:place st=\"on\">Armijo<\/st1:place> from the ballot sets a new precedent that remains unchallenged.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">It\u2019s a dangerous precedent, and one that discourages Democrats and Republicans from being independent of their party\u2019s platform and marching orders.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armi<\/st1:place><st1:place st=\"on\">jo<\/st1:place> is under investigation for allegations that he made unwanted sexual advances toward a campaign volunteer. Though Armijo at first called them \u201crumors,\u201d they are not: Prosecutors in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> are reviewing the case to determine whether criminal charges are warranted.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Public disclosure of the allegations in late August by the <a href=\"http:\/\/www.abqtrib.com\/\" target=\"_blank\">Albuquerque Tribune<\/a> prompted Gov. Bill Richardson to announce he would meet with <st1:place st=\"on\">Armijo<\/st1:place> to discuss whether he should withdraw from the race. <st1:place st=\"on\">Armijo<\/st1:place> responded by saying he was guilty of no wrongdoing, would not agree to such a meeting and was not resigning.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But <st1:city st=\"on\">Richardson<\/st1:city> strong-armed <st1:place st=\"on\">Armijo<\/st1:place> into meeting on Aug. 29 and announcing afterward that he would drop out of the auditor\u2019s race. The party began the process of replacing <st1:place st=\"on\">Armijo<\/st1:place> on the ballot.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the meantime, <st1:place st=\"on\">Armijo<\/st1:place> had second thoughts. After all, he never wanted to step aside. He held a news conference last week, minutes before the deadline to withdraw from the race, to announce he would not do that.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIf that makes a select few politicians nervous, so be it,\u201d <st1:place st=\"on\">Armijo<\/st1:place> said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But the secretary of state took his name off the ballot based on the argument of <st1:city st=\"on\">Richardson<\/st1:city>\u2019s lawyers and the Democratic Party that <st1:place st=\"on\">Armijo<\/st1:place>\u2019s previous actions \u2013 primarily a news release announcing he would step down \u2013 constituted a formal withdrawal. Previously, a withdrawal required a signed, notarized letter.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place> and the party sued each other to attempt to resolve the dispute. The governor\u2019s office announced he would stay out of the situation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Then came Wednesday\u2019s surprise announcement, made by Armijo, Democratic Party Chair John Wertheim and Speaker of the House Ben Lujan, that <st1:place st=\"on\">Armijo<\/st1:place> would step down for the good of the party.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">As part of the deal, <st1:place st=\"on\">Armijo<\/st1:place> was allowed to make the following statement:<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cOut of my profound respect for Speaker Lujan I have concluded that, in the interest of many wonderful New Mexicans, that I will not seek the office of state auditor,\u201d he said. \u201cI was elected fair and square by 62 percent of the Democratic Primary voters, and my fight to protect ordinary New Mexicans will never end. Although I still feel that I am the candidate for state auditor, my meager resources cannot match the mighty powers and resources of big government and powerful politicians.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That\u2019s what I\u2019m talking about: The powers-that-be won not because they were right, but because they are more powerful.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That should leave a bad taste in the mouths of all Democrats, regardless of whether they believe the allegations against <st1:place st=\"on\">Armijo<\/st1:place> are true.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Any assertion by <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s office that he stayed out of the final deal-making is laughable. He forced <st1:place st=\"on\">Armijo<\/st1:place> to originally say he would drop out. Who really believes he backed off after that? Who knows what sort of conversations <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> had with Lujan. Did they make a deal?<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I realize the Democratic Party and those who were involved believe they were doing the right thing in forcing <st1:place st=\"on\">Armijo<\/st1:place> off the ballot. They believe they are the good guys and the Republicans aren\u2019t, and <st1:place st=\"on\">Armijo<\/st1:place>\u2019s name on the ballot might hurt other Democrats in November.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But this shouldn\u2019t have been their decision to make. <st1:place st=\"on\">Armijo<\/st1:place> was picked to represent the party by 62 percent of voters in the Democratic primary. The decision to stay in the race or quit should have been his, and his alone.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place>\u2019s inability to fight this to the end lets the party and Richardson get away with the same tactics the governor\u2019s campaign called unethical when the person being accused was John Dendahl. It leaves the legal question unanswered and sets a new precedent: All candidates have to do to withdraw from races is say out loud that they are withdrawing. What\u2019s next? Can the party decide it doesn\u2019t want someone on the ballot and claim its members were told by the candidate he would withdraw?<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">We\u2019re on a slippery slope that is certain to discourage independence and encourage more partisan politics.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Don\u2019t think the public doesn\u2019t see it, either. This will be seen by many as another black eye for the Democratic Party.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Garcia%2C%20Lorenzo.2.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Garcia%2C%20Lorenzo.2.jpg\" alt=\"\" border=\"0\" \/><\/a>Even the <a href=\"http:\/\/www.freenewmexican.com\/news\/48937.html\" target=\"_blank\">Santa Fe New Mexican<\/a>, which many would argue is the most liberal daily newspaper in the state, called Saturday for the Democrats to concede the auditor\u2019s race to Republican Lorenzo Garcia, who the newspaper\u2019s editorial described as an \u201cexcellent candidate.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWhen the dust settles from the Democratic intramural dirt-throwing and wrangling for position, it will be clear that <st1:place st=\"on\"><st1:state st=\"on\">New Mexico<\/st1:state><\/st1:place> needs Garcia to restore credibility to the state auditor\u2019s office; the Democrats, for all their registration advantage over the Republicans, for now have lost the confidence of their fellow citizens when it comes to this position.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Balderas%2C%20Hector.2.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Balderas%2C%20Hector.2.jpg\" alt=\"\" border=\"0\" \/><\/a>It will take a lot for Hector Balderas, <st1:place st=\"on\">Armijo<\/st1:place>\u2019s replacement on the ballot, to regain that confidence. That\u2019s no shot against him. I\u2019m intrigued by the idea of having an attorney run the auditor\u2019s office, and he might make a good auditor.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But outgoing Auditor Domingo Martinez, a Democrat, was a rare example of a member of that party who had the courage to consistently stand up to cronyism in state government, regardless of who was involved. The Democratic Party has shown that, as long as <st1:city st=\"on\">Richardson<\/st1:city> rules with an iron fist, we must have one as independent as <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> in the auditor\u2019s office.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Now that Republicans who are mired in scandal control the federal government, Democrats like to talk about the importance of balance and the need for people willing to stand up for what\u2019s right. The balance of power is equally out of whack in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>, with the scales tipping to the Democrats.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Few doubt that Garcia will remain independent and an important check on state government.
