(Read Armijo\u2019s lawsuit by clicking <a href=\"http:\/\/www.haussamen.com\/ArmijoComplaint2.pdf\" target=\"_blank\">here<\/a> and the Democratic Party\u2019s by clicking <a href=\"http:\/\/www.haussamen.com\/ArmijoComplaint.pdf\" target=\"_blank\">here<\/a>.)<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">At a hearing held at 9 a.m. in <st1:city st=\"on\">Albuquerque<\/st1:city>, District Judge Ted Baca ordered the secretary of state\u2019s office to delay printing ballots until the matter is resolved, said <st1:place st=\"on\">Armijo<\/st1:place>\u2019s attorney, Paul M. Kienzle.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIt\u2019s put on hold for now,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Then, at a hearing at 3 p.m. in <st1:place st=\"on\"><st1:city st=\"on\">Santa Fe<\/st1:city><\/st1:place>, District Judge Tim Garcia decided that he, not Baca, will be the judge to hear the matter from now on because the Democratic Party\u2019s lawsuit in his court was filed first. Matt Farrauto, executive director of the party, said that was appropriate because the Democrats, <st1:place st=\"on\">Armijo<\/st1:place> and the secretary of state\u2019s office are all included as parties in that lawsuit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Armijo\u2019s lawsuit in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> did not include the Democrats.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Garcia has set a hearing for 10 a.m. Wednesday, and will likely hear testimony. Farrauto said there was discussion that the hearing might last more than a day, but Kienzle said the parties will likely aim to complete the hearing Wednesday to allow for a quick appeal to the Supreme Court by either side.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place> announced that he would drop out of the race in late August because of allegations that he made unwanted sexual advances toward a campaign volunteer. Though he claims the allegations are false, Gov. Bill Richardson pressured him to drop out.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place> changed his mind before last week\u2019s deadline to officially withdraw and announced he would not file the signed, notarized withdrawal letter that had typically been required by the secretary of state\u2019s office. The governor\u2019s office and Democratic Party argued that <st1:place st=\"on\">Armijo<\/st1:place>\u2019s prior public statements and actions constituted a withdrawal, and the secretary of state took his name off the ballot, leading to the lawsuits. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>A hearing has been set for Wednesday morning on the matter of whether Jeff Armijo will remain the Democrat\u2019s candidate for state auditor on the General Election ballot.
