Kienzle of <st1:city st=\"on\">Albuquerque<\/st1:city>, filed his complaint Friday in the Second Judicial District Court in <st1:place st=\"on\"><st1:city st=\"on\">Albuquerque<\/st1:city><\/st1:place>. You can read the complaint by clicking <a href=\"http:\/\/www.haussamen.com\/ArmijoComplaint2.pdf\" target=\"_blank\">here<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The dispute won\u2019t stop the Democratic Party from meeting Saturday to pick a candidate to replace <st1:place st=\"on\">Armijo<\/st1:place> on the ballot. Kienzle also filed a request for an injunction stopping Secretary of State Rebecca Vigil-Giron from removing Armijo\u2019s name from the ballot, and District Judge Geraldine Rivera in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> has set a hearing for Tuesday at 4 p.m. \u2013 an hour before the deadline to put candidates\u2019 names on the ballot.<\/p>\n<p class=\"MsoNormal\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"color:black;\">I couldn\u2019t reach officials with the Democratic Party to find out if a judge in <st1:place st=\"on\"><st1:city st=\"on\">Santa Fe<\/st1:city><\/st1:place> has set a hearing.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place> announced on Aug. 29 that he was dropping out of the race. That followed a meeting with Gov. Bill Richardson, who pressured him to get out.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Armijo had been plagued by allegations of making unwanted sexual advances toward a campaign volunteer \u2013 allegations that are under review by prosecutors in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\">Armijo<\/st1:place> never filed the paperwork normally required to withdraw. On Tuesday, the last day to withdraw, <st1:place st=\"on\">Armijo<\/st1:place> announced he was staying in the race. The Democratic Party and governor\u2019s office argued that it was too late and said his prior news release constituted a formal withdrawal. The attorney general\u2019s office agreed, and the secretary of state announced she had taken <st1:place st=\"on\">Armijo<\/st1:place>\u2019s name off the ballot, leading to today\u2019s court filings.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><span style=\"font-weight: bold; font-style: italic;\">Update, 6:10 p.m.:<\/span> Democratic Party Chair John Wertheim said a hearing has not been set in <st1:city st=\"on\"><st1:place st=\"on\">Santa Fe<\/st1:place><\/st1:city> on his party\u2019s request. He said he\u2019s glad his party also filed a lawsuit, because Armijo\u2019s complaint names the secretary of state as a defendant but not the Democratic Party, which he said indicates that <st1:place st=\"on\">Armijo<\/st1:place> wanted to take away the party\u2019s ability to argue in the case.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He said there are other reasons his party filed the lawsuit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe wanted to have an affirmative statement of confidence in our legal position,\u201d Wertheim said. \u201cOur party is very deeply affected by this issue.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I\u2019ve been unable to reach Kienzle for comment.<\/p>\n<p class=\"MsoNormal\">\n","protected":false},"excerpt":{"rendered":"<p>The Democratic Party of New Mexico and Jeff Armijo have both filed lawsuits asking district judges to back their positions in the dispute over whether Armijo should be the party\u2019s candidate for state auditor.
