(Photo by Heath Haussamen)<\/p><\/div>\n<p>Attorney General <a href=\"http:\/\/nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\">Gary King<\/a> says his office will appeal a federal judge\u2019s ruling earlier this month that slapped down an attempt to force two nonprofits to register as political action committees.<\/p>\n<p>\u201cWe feel the U.S. Supreme Court has raised some important concepts that have a bearing upon states\u2019 rights to require organizations to disclose who is paying for political ads that are put forth by these same organizations,\u201d King said in a news release. \u201cThis case has never been about the First Amendment, despite misinformation to the contrary. We are not trying to control the content of political ads.\u201d<\/p>\n<p>\u201cWe believe, however, that the case has everything to do with voters having the right to know who is paying for political advertising,\u201d he said.<\/p>\n<p>You can hear Albuquerque radio reporter Peter St. Cyr\u2019s exclusive interview with King about the coming appeal by clicking <a href=\"http:\/\/wordcab.blogspot.com\/2009\/08\/attorney-general-will-appeal-nonprofits.html\">here<\/a>. The most interesting point: King says his office might have to take the case all the way to the U.S. Supreme Court, and acknowledged that the nation\u2019s high court is currently considering <a href=\"http:\/\/www.scotuswiki.com\/index.php?title=Citizens_United_v._Federal_Election_Commission\">a similar issue<\/a>.<\/p>\n<p>But King told St. Cyr that he expects this month\u2019s district court ruling to be the \u201claw of the land\u201d for the 2010 election in New Mexico because appeals take time.<\/p>\n<p>In early August, U.S. District Judge Judith C. Herrera issued a <a href=\"http:\/\/www.haussamen.com\/NMYO_SWOP_Decision.pdf\" target=\"_blank\">30-page decision<\/a> stating that mailers <a href=\"http:\/\/www.haussamen.com\/M1RobinsonFF.pdf\" target=\"_blank\">like this one<\/a> sent out by New Mexico Youth Organized (NMYO) &#8212; which is a project of the <a href=\"http:\/\/www.civicpolicy.com\/\" target=\"_blank\">Center for Civic Policy<\/a> (CCP) &#8212; and <a href=\"http:\/\/www.swopblogger.org\/\" target=\"_blank\">SouthWest Organizing Project<\/a> (SWOP) two to three months before last year\u2019s June primary don\u2019t meet the narrow definition in federal law of political activity and thus can\u2019t be regulated as such.<\/p>\n<p>King has said the mailers cross the line between issue advocacy and political campaigning as defined by the state\u2019s <a href=\"http:\/\/www.sos.state.nm.us\/pdf\/campaign.pdf\" target=\"_blank\">Campaign Reporting Act<\/a>, alleging that they were designed to help progressive legislative candidates win elections. In addition to contending that the mailers were about an upcoming special session of the Legislature, not an election, the nonprofits have said all along that federal law trumps state law.<\/p>\n<p>In her decision, the judge agreed with both points made by the nonprofits.<\/p>\n<p><em>By way of disclosure, I also write for the <\/em><a href=\"http:\/\/www.newmexicoindependent.com\/\" target=\"_blank\"><em>New Mexico Independent<\/em><\/a><em>, which is owned by the <\/em><a href=\"http:\/\/www.newjournalist.org\/\" target=\"_blank\"><em>Center for Independent Media<\/em><\/a><em> in Washington. When the group was starting up its New Mexico news site last year, CCP helped it locate funding sources. In addition, one of my colleagues at NMI, Marjorie Childress, works for SWOP.
