The details of those allegations aren\u2019t known because that file has been sealed.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The commission filed a new petition Wednesday asking the court to strip the pay from Garza\u2019s suspension, order him to submit to a drug test, and demand that he explain why he has refused a drug test. The commission does have powers related to obtaining judges\u2019 medical records, but whether they apply to forcing drug tests may be an untested area of law.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Reached by telephone, Garza said he had not heard about the new petition and denied using drugs.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThat\u2019s not true,\u201d Garza said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The filing states that Garza failed to meet a captain from the New Mexico State Police for a drug test on Friday. It also contains an affidavit from an employee of Magistrate Court who says that she and another court employee one on occasion saw Garza at work with \u201cwhite powder\u201d on his nostrils\u201d and acting \u201cextremely hyperactive.\u201d She says that, in recent months, Garza\u2019s behavior has become \u201cerratic,\u201d that he is \u201cparanoid all the time,\u201d and that he has a reputation as a \u201cparty animal\u201d and \u201cassociates with known drug users.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The massive filing with the court contains other affidavits.
