{"id":497845,"date":"2018-01-06T20:45:47","date_gmt":"2018-01-07T03:45:47","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=497845"},"modified":"2018-01-06T20:45:47","modified_gmt":"2018-01-07T03:45:47","slug":"woman-who-alleged-informant-exploited-romantic-relationship-receives-reduced-sentence","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2018\/01\/woman-who-alleged-informant-exploited-romantic-relationship-receives-reduced-sentence\/","title":{"rendered":"Woman who alleged informant exploited romantic relationship receives reduced sentence"},"content":{"rendered":"<p>Jennifer Padilla likely won\u2019t spend a single day locked up in federal prison.<\/p>\n<div id=\"attachment_413228\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-413228\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2017\/08\/1-Padilla-Profile-FB-336x364-336x364.jpg\" alt=\"Jennifer Padilla\" width=\"336\" height=\"364\" \/><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Jennifer Padilla, shown in spring 2016.<\/p><\/div>\n<p>Under an agreement accepted Wednesday by U.S. District Judge William P. \u201cChip\u201d Johnson, the 39-year-old mother of five received 24 months behind bars instead of the 10 to 13 years prosecutors originally wanted.<\/p>\n<p>Arrested in August 2016 on methamphetamine trafficking and conspiracy charges, Padilla is one of scores of people who were dubbed among Albuquerque\u2019s \u201cworst of the worst\u201d after their arrests in a controversial 2016 undercover sting by the federal bureau of Alcohol Tobacco Firearms and Explosives (ATF).<\/p>\n<p>Padilla\u2019s reduced sentence followed allegations she made in court motions that an ATF informant exploited their romantic relationship to lure her into a crime she would not otherwise have committed.<\/p>\n<p>NMID independently verified many of Padilla\u2019s claims and laid them out in<a href=\"http:\/\/nmindepth.com\/2017\/08\/23\/boyfriends-betrayal-abq-woman-jailed-after-atf-informant-lured-her-into-drug-deals\/\" target=\"_blank\" rel=\"noopener\">\u00a0a story co-published with the Santa Fe Reporter on Aug. 23<\/a>.<\/p>\n<p>Since her arrest on Aug. 10, 2016, Padilla has been incarcerated at the Santa Fe County Adult Detention Center \u2013 17 months Johnson credited as time served, leaving only seven months on her sentence. Rather than assign her to a prison or jail cell, Johnson said from the bench during a sentencing hearing on Wednesday that he would \u201cstrongly recommend\u201d the U.S. Bureau of Prisons release Padilla to a halfway house.<\/p>\n<p>If Padilla were sent to a halfway house, it would represent a return to a familiar setting.<\/p>\n<p>It was while Padilla was living in a state-funded, Albuquerque halfway house in 2016 that she met the ATF informant. He also re-introduced her to drugs, slipping her an Ecstasy pill one night at the halfway house, ending more than a year of sobriety.<\/p>\n<p>In late July 2016, the informant told her that he had been robbed and his Florida-based drug dealing partners would hurt him if she didn\u2019t arrange a couple of drug deals to help him earn some quick cash, Padilla says.<\/p>\n<p>Padilla grudgingly agreed and called two old acquaintances who allegedly sold meth to ATF agents with the informant acting as a middle-man.<\/p>\n<p>Padilla was not present for either transaction and did not negotiate prices or the amounts of meth \u2014 facts Johnson noted in court Wednesday as part of his reasoning for accepting the plea deal, which was hammered out late last year by Padilla\u2019s lawyer, L. Val Whitley, and the U.S. Attorney\u2019s Office.<\/p>\n<p>Johnson acknowledged Wednesday that Padilla\u2019s allegations about the ATF informant\u2019s actions could have led to an acquittal if her case had gone to trial. But, he added, she might also have been convicted and sentenced to a decade or more in prison if a jury didn\u2019t trust her version of events.<!--more--><\/p>\n<p>\u201cThis was truly a compromise plea,\u201d Whitley, her attorney, said in court. \u201cShe made some bad decisions, but she was in a compromised position when this happened. She was very vulnerable.\u201d<\/p>\n<p>Wearing a blue jail jumpsuit and recently styled hair, Padilla told Johnson: \u201cI\u2019ve had a rough past few years.\u201d<\/p>\n<p>\u201cI was really trying to get my life back together when this happened,\u201d she continued. \u201cI\u2019ve lost another year and a half \u2026 It\u2019s just sad and upsetting. I had no intention to do this.\u201d<\/p>\n<p>Padilla\u2019s mother and 15-year-old daughter watched from the gallery. Her mother, Denise \u201cScooter\u201d Sullivan, wiped away tears.<\/p>\n<p>After the hearing, U.S. Marshals allowed Padilla, who was shackled, and her daughter to sit across the courtroom railing from one another and chat.
