{"id":4714,"date":"2009-07-08T00:06:00","date_gmt":"2009-07-08T06:06:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/07\/city-sues-philippou-over-lingering-infrastructure-issues\/"},"modified":"2009-07-08T00:06:00","modified_gmt":"2009-07-08T06:06:00","slug":"city-sues-philippou-over-lingering-infrastructure-issues","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/07\/city-sues-philippou-over-lingering-infrastructure-issues\/","title":{"rendered":"City sues Philippou over lingering infrastructure issues"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SlQ4Ys9lHrI\/AAAAAAAAL4k\/OuXS9A6vums\/s1600-h\/Philippou,+Philip.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SlQ4Ys9lHrI\/AAAAAAAAL4k\/OuXS9A6vums\/s200\/Philippou,+Philip.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5355967853887823538\" border=\"0\" \/><\/a><\/p>\n<p class=\"MsoNormal\">Almost two years ago, a spokesman for Las Cruces developer Philip Philippou said he expected that drainage improvements in the Dos Sue\u00f1os subdivision would be completed in 4-6 weeks.<\/p>\n<p class=\"MsoNormal\">The drainage issue was one of many problems with the controversial developer\u2019s subdivision that journalist Vicki Nisbett revealed in <a href=\"http:\/\/haussamen.blogspot.com\/2007\/10\/new-growth-rules-dont-help-dos-sueos.html\">an article published on this site<\/a> in October 2007. And, despite the statement made at the time to Nisbett by Kirk Clifton, development administrator for Philippou\u2019s company, the drainage improvements have still not been completed.<\/p>\n<p class=\"MsoNormal\">Apparently, the City of Las Cruces has had enough. The <a href=\"http:\/\/www.lcsun-news.com\/las_cruces-news\/ci_12764235\" target=\"_blank\">Las Cruces Sun-News<\/a> is reporting that the city has filed a lawsuit alleging that Philippou has failed to comply with building requirements in several of his subdivisions and is asking a district court judge to force Philippou to complete the work he started.<\/p>\n<p class=\"MsoNormal\">The city states in its <a href=\"http:\/\/www.haussamen.com\/LCPhilippouLawsuit.pdf\" target=\"_blank\">15-page complaint <\/a>that Philippou has \u201cfailed to construct drainage infrastructure improvements\u201d in the Dos Sue\u00f1os subdivision and that the city, its citizens and others \u201cwill suffer irreparable injury unless injunctions are granted due to the fact that persons purchasing lots in this subdivision will be unprotected from the non-performance of Defendants and will be forced to live in lots lacking basic infrastructure or services.\u201d<\/p>\n<p class=\"MsoNormal\">The complaint also seeks to force Philippou to comply with infrastructure requirements he agreed to but has not met in several other Las Cruces subdivisions. In addition to drainage improvements, the issues identified include roadway and utility work and rock wall improvements.<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">What happened to finishing the work in 2007?<\/span><\/p>\n<p class=\"MsoNormal\">In 2007, Nisbett quoted Clifton as saying most of the outstanding work in Dos Sue\u00f1os, which is located north of U.S. Highway 70 on both sides of <a href=\"http:\/\/maps.google.com\/maps?f=q&amp;source=s_q&amp;hl=en&amp;geocode=&amp;q=n+Jornada+Rd,+Las+Cruces,+Dona+Ana,+New+Mexico+88011&amp;sll=32.375861,-106.729781&amp;sspn=0.012178,0.014913&amp;ie=UTF8&amp;z=13&amp;iwloc=A\" target=\"_blank\">Jornada Road<\/a>, should be completed in four to six weeks. That included construction of a 20- to 40-foot-wide concrete drainage ditch the city required on the north side of the subdivision.<\/p>\n<p class=\"MsoNormal\">\u201cThere\u2019s been continuous work out there, although it might be slow,\u201d Clifton said. \u201cWe just want to get done and out of there as quickly as everyone wants us to.\u201d<\/p>\n<p class=\"MsoNormal\">Kyle Moberly, a Las Cruces attorney who represents Philippou, had something much different to say to the Sun-News on Monday when asked about the lawsuit.<\/p>\n<p class=\"MsoNormal\">\u201cApparently, the city wants to publicly embarrass Mr. Philippou, who in his ongoing efforts to resolve these matters in this difficult economic climate, earlier this morning (Monday) submitted proposals to the city for resolving these matters,\u201d the newspaper quoted Moberly as saying. \u201cSince we only received a copy of this complaint late this morning, we have not had a chance to thoroughly review it and, therefore, are not in a position to properly respond. However, our cursory review reveals the complaint appears to be overly broad and inconsistent with previous communications we received from the city.\u201d<\/p>\n<p class=\"MsoNormal\">Mayor <a href=\"http:\/\/las-cruces.org\/council\/mayor.shtm\" target=\"_blank\">Ken Miyagishima<\/a> had this to say to the newspaper:<\/p>\n<p class=\"MsoNormal\">\u201cThis lawsuit is really about the public trust. The city has the best interest of the public to consider,\u201d he said. \u201cWe have a responsibility to ensure that residents get what they\u2019re promised when they move into a city-approved subdivision.\u201d<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">A history of controversy<\/span><\/p>\n<p class=\"MsoNormal\">The lawsuit is the latest trouble for Philippou, a man who is arguably one of the most controversial developers in the state. Here are some of the other headline-grabbing situations in which he\u2019s been involved in recent years:<\/p>\n<p class=\"MsoNormal\">\u2022 Last month, he paid the city <a href=\"http:\/\/www.mercurynews.com\/ci_12518506?IADID=Search-www.mercurynews.com-www.mercurynews.com&amp;nclick_check=1\" target=\"_blank\">more than $200,000<\/a> for an outstanding water bill only after the city placed liens on his properties.<\/p>\n<p class=\"MsoNormal\">\u2022 In 2007, it was revealed that then-District 1 City Councilor Jos\u00e9 Frietze had <a href=\"http:\/\/haussamen.blogspot.com\/2007\/10\/conflict-of-interest-controversy-erupts.html\">failed to disclose land donations<\/a> Philippou made to a non-profit Frietze runs.<\/p>\n<p class=\"MsoNormal\">\u2022 Philippou\u2019s most visible controversy relates to his dealings with the State Land Office. <a href=\"http:\/\/www.nmstatelands.org\/default.aspx?PageID=2\" target=\"_blank\">Pat Lyons<\/a>, the state land commissioner, bypassed his own bidding process and agreed to lease thousands of acres of public land in Las Cruces to Philippou in 2006. Around the same time, Lyons received approximately $30,000 in campaign contributions from Philippou and a political committee and lobbyists tied to the developer.<\/p>\n<p class=\"MsoNormal\">It\u2019s a land deal Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King<\/a> has said is flawed. The AG\u2019s <a href=\"http:\/\/www.haussamen.com\/AGOpinionOnSoloLandDeal.pdf\" target=\"_blank\">formal opinion<\/a> states that the <a href=\"http:\/\/www.haussamen.com\/LandOfficeAgreement.pdf\" target=\"_blank\">lease agreement\u2019s<\/a> method of compensating Philippou\u2019s company for developing the land is \u201cnot comprehended by and in conflict with\u201d a statute that allows developers who improve land for the state to be compensated only for the appraised value of the improvements.<\/p>\n<p class=\"MsoNormal\">The controversies surrounding the land office and Frietze helped fuel public outcry over the city\u2019s growth policies and helped lead to the <a href=\"http:\/\/haussamen.blogspot.com\/2008\/01\/new-city-leaders-must-bring-change-they.html\">overthrowing of the city council<\/a> in two elections held in late 2007 and early 2008.<\/p>\n<p class=\"MsoNormal\"><span style=\"font-style: italic;\">A prior version of this posting incorrectly attributed a quote to Clifton that should have been attributed to Moberly.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Almost two years ago, a spokesman for Las Cruces developer Philip Philippou said he expected that drainage improvements in the Dos Sue\u00f1os subdivision would be completed in 4-6 weeks.
