{"id":4519,"date":"2009-05-01T01:00:00","date_gmt":"2009-05-01T07:00:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/05\/aldus-founder-faces-criminal-charges-in-new-york\/"},"modified":"2009-05-01T01:00:00","modified_gmt":"2009-05-01T07:00:00","slug":"aldus-founder-faces-criminal-charges-in-new-york","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/05\/aldus-founder-faces-criminal-charges-in-new-york\/","title":{"rendered":"Aldus founder faces criminal charges in New York"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/SfqRt1Kn92I\/AAAAAAAALiM\/cbIup6nAr5c\/s1600-h\/Cuomo,+Andrew.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/SfqRt1Kn92I\/AAAAAAAALiM\/cbIup6nAr5c\/s200\/Cuomo,+Andrew.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5330733325498185570\" border=\"0\" \/><\/a><\/p>\n<p style=\"font-style: italic;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">NY Attorney General Andrew Cuomo alleges that illegal dealings related to investment funds extended all the way to New Mexico<\/span><\/p>\n<p class=\"MsoNormal\">A founder of <a href=\"http:\/\/www.aldusequity.com\/\" target=\"_blank\">Aldus Equity<\/a> who was charged with a felony in New York on Thursday faces allegations that, in exchange for increased business in that state, he helped the son of the New York state comptroller win a lucrative contract in New Mexico for a firm he was representing.<\/p>\n<p class=\"MsoNormal\">The new allegation further ties New Mexico to the massive scandal that is rocking New York and spreading across the nation, and comes on the heels of Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> ordering the <a href=\"http:\/\/haussamen.blogspot.com\/2009\/04\/richardson-orders-termination-of-aldus_30.html\">State Investment Council<\/a> (SIC) and <a href=\"http:\/\/haussamen.blogspot.com\/2009\/04\/educational-retirement-board-will-also.html\">Educational Retirement Board<\/a> (ERB) to fire Aldus.<\/p>\n<p class=\"MsoNormal\">In filing a fraud-related felony charge against Aldus founder Saul Meyer on Thursday, <a href=\"http:\/\/en.wikipedia.org\/wiki\/Andrew_Cuomo\" target=\"_blank\">Andrew M. Cuomo<\/a>, New York\u2019s attorney general, said on a conference call with reporters that he is \u201cdisclosing a national network of actors who often acted in concert and did this all across the country,\u201d The <a href=\"http:\/\/www.nytimes.com\/2009\/05\/01\/nyregion\/01pension.html?_r=1&amp;hp\" target=\"_blank\">New York Times<\/a> is reporting.<\/p>\n<p class=\"MsoNormal\">\u201cThis is sort of like when you pull a thread on the sweater and that one thread starts to unravel the entire fabric,\u201d the Times quoted him as saying. \u201cWe\u2019re pulling threads and it turns out the other end of the thread is in New Mexico or Connecticut or Illinois or in California.\u201d<\/p>\n<p class=\"MsoNormal\">According to <a href=\"http:\/\/www.oag.state.ny.us\/media_center\/2009\/apr\/pdfs\/Meyer%20Complaint%20-%20FINAL.pdf\" target=\"_blank\">the criminal complaint<\/a> Cuomo\u2019s office filed against Meyer, in 2006 Meyer sought and received control over an additional $200 million from a New York pension fund from then-N.Y. Comptroller <span style=\"\"> <\/span><a href=\"http:\/\/en.wikipedia.org\/wiki\/Alan_Hevesi\" target=\"_blank\">Alan G. Hevesi<\/a>.<\/p>\n<p class=\"MsoNormal\">At the time, Aldus was already doing business with the SIC in New Mexico, and, a week after Aldus won control over the additional $200 million in New York, the company recommended that the SIC invest as much as $30 million with a fund called Catterton VI. The SIC later invested $25 million with the fund.<\/p>\n<p class=\"MsoNormal\">The third-party marketer who helped Catterton win the New Mexico contract was Daniel Hevesi, son of the New York comptroller. He was paid $250,000 for his work on the deal.<\/p>\n<p class=\"MsoNormal\">The criminal complaint, quoting records obtained by the New York AG, states that, in May 2006, Daniel Hevesi thanked Meyer \u201cfor NM.\u201d<\/p>\n<p class=\"MsoNormal\">Meyer, who also faces charges of violating securities law, has pleaded not guilty.<\/p>\n<p class=\"MsoNormal\">No government officials in New Mexico are implicated in any wrongdoing in the criminal complaint, which simply indicates that New Mexico served as the staging area for half of the alleged criminal deal for which Meyer is charged.<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Investigations \u2018lead back to one another\u2019<\/span><\/p>\n<p class=\"MsoNormal\">In New Mexico, officials with the SIC and ERB have been <a href=\"http:\/\/haussamen.blogspot.com\/2009\/04\/fbi-questions-officials-about-embattled.html\">questioned by the FBI<\/a> about Aldus. Both agencies suspended contracts with Aldus earlier this month and began internal probes. Then on Wednesday, Richardson ordered the SIC to terminate its deal with Aldus, and on Thursday, he instructed the ERB to do the same.<\/p>\n<p class=\"MsoNormal\">The Times article points out that the action by Richardson came \u201cin the wake\u201d of the charges in New York as \u201cmany Aldus clients were scrambling to sever their ties with the firm.\u201d According to the Times, Cuomo believes he has \u201cuncovered what amounts to a conspiracy involving politicians, professional investors and consultants to defraud public pension funds in New York and other states by paying millions of dollars in kickbacks in exchange for access to the funds.\u201d<\/p>\n<p class=\"MsoNormal\">There are several other connections between the scandal in New York, the New Mexico investment agencies and Richardson that I\u2019ve previously written about.
