{"id":4454,"date":"2009-04-09T20:22:00","date_gmt":"2009-04-10T02:22:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/04\/guv-signs-land-office-competitive-bidding-bill\/"},"modified":"2009-04-09T20:22:00","modified_gmt":"2009-04-10T02:22:00","slug":"guv-signs-land-office-competitive-bidding-bill","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/04\/guv-signs-land-office-competitive-bidding-bill\/","title":{"rendered":"Guv signs land office competitive bidding bill"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/Sd6tskbQ7KI\/AAAAAAAALXY\/6lG0Aw7cr_8\/s1600-h\/Richardson,+Bill.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/Sd6tskbQ7KI\/AAAAAAAALXY\/6lG0Aw7cr_8\/s200\/Richardson,+Bill.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5322882790802386082\" border=\"0\" \/><\/a><\/p>\n<p class=\"MsoNormal\">Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> has signed legislation that will require competitive bidding on all <a href=\"http:\/\/nmstatelands.org\/\" target=\"_blank\">State Land Office<\/a> development leases.<\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=S&amp;LegType=B&amp;LegNo=540&amp;year=09\" target=\"_blank\">Senate Bill 540<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SFISC\" target=\"_blank\">Steve Fischmann<\/a>, D-Las Cruces, came in response to a development controversy in Las Cruces, and was the only bill in a package proposed by three Las Cruces lawmakers that was endorsed by Land Commissioner <a href=\"http:\/\/www.nmstatelands.org\/default.aspx?PageID=2\" target=\"_blank\">Pat Lyons<\/a> &#8212; and the only one that passed the Legislature this year.<\/p>\n<p class=\"MsoNormal\">The proposals followed Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King\u2019s<\/a> finding fault last year with Lyons\u2019 leasing of land on Las Cruces\u2019 East Mesa to Philip Philippou so it could be developed. The AG\u2019s <a href=\"http:\/\/www.haussamen.com\/AGOpinionOnSoloLandDeal.pdf\" target=\"_blank\">formal opinion<\/a> on The Vistas at Presidio land deal states that the <a href=\"http:\/\/www.haussamen.com\/LandOfficeAgreement.pdf\" target=\"_blank\">lease agreement\u2019s<\/a> method of compensating Philippou\u2019s company for developing the land is \u201cnot comprehended by and in conflict with\u201d a statute that allows developers who improve land for the state to be compensated only for the appraised value of the improvements.<\/p>\n<p class=\"MsoNormal\">In the lease, the land office also agreed to compensate Philippou for other project costs and 40 percent of the change in value of the land as a result of the improvements.<\/p>\n<p class=\"MsoNormal\">The competitive bidding bill was also significant because, in the Las Cruces situation, Lyons bypassed his own bidding process &#8212; which he\u2019s not currently required by law to use &#8212; and leased the thousands of acres of land in question to Philippou in December 2006. Months earlier, while the Republican Lyons was running for re-election, Philippou gave $20,500 to a political action committee run by lobbyists he employs. The PAC gave most of it to Lyons\u2019 campaign, and the lobbyists gave another $3,600. After Lyons leased the land to Philippou, the developer gave another $6,000 to Lyons.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gov.
