The uncertainty about how IPRA applies when private companies are doing public work with your money sometimes reduces that tool to a tiny chisel.<\/p>\n<p>The Legislature needs to update state law to give you back your sledgehammer.<\/p>\n<p>Here\u2019s the problem: It took a lawsuit to get a prison health company to <a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/corizon-ordered-to-pay-attorneys-fees\/article_3dbbb8e5-8376-5a82-9e8d-d55de3524e57.html\" target=\"_blank\" rel=\"noopener noreferrer\">release settlement agreements<\/a> with state inmates who sued the company. It also took a lawsuit to force the town of Truth or Consequences to <a href=\"http:\/\/www.nmpress.org\/stories\/Open-government-advocates-welcome-court-ruling,227?content_source=&amp;category_id=4&amp;search_filter=&amp;event_mode=&amp;event_ts_from=&amp;list_type=most_commented&amp;order_by=&amp;order_sort=&amp;content_class=&amp;sub_type=stories&amp;town_id=\" target=\"_blank\" rel=\"noopener noreferrer\">release video recordings of public meetings<\/a> made by a government contractor.<\/p>\n<p>Lawsuits consume time and money. Many people don\u2019t have the means to sue. And IPRA\u2019s intent is that you shouldn\u2019t have to sue to learn about how your money is being spent.<\/p>\n<p>Legal settlements and video recordings undoubtedly fall under IPRA\u2019s definition of public records: \u201c\u2026all documents, papers, letters, books, maps, tapes, photographs, recordings and other materials, regardless of physical form or characteristics, that are used, created, received, maintained or held by<strong> or on behalf of any public body<\/strong> (emphasis added) and relate to public business.\u201d<\/p>\n<p>From the 2012 T or C case, the N.M. Court of Appeals created a 12-point test to be used in court to determine whether records held by government contractors are subject to public disclosure.<\/p>\n<p>It was with that test in mind that NMPolitics.net sued the City of Las Cruces <a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/nmpolitics-net-sues-for-release-of-city-manager-applications\/\" target=\"_blank\" rel=\"noopener noreferrer\">in 2016<\/a>, seeking dozens of city manager job applications that were submitted to the company conducting the search and being kept secret. The Court of Appeals has previously ruled that the public should get to see such job applications. We argued that the city shouldn\u2019t be allowed to hide them from you by outsourcing its search.<!--more--><\/p>\n<p>But the Court\u2019s test is subjective. Judges are to consider the totality of circumstances \u2013 each of the 12 points and context \u2013 and then make a ruling. In September, the judge in our case ruled in favor of the city and <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2017\/10\/CV.2016.1220.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">dismissed our lawsuit<\/a>.<\/p>\n<p>I thought about appealing. However, while I wanted to win release of the city manager applications, my real goal was to establish that government can\u2019t bypass the public\u2019s right to know by outsourcing its work.<\/p>\n<p>Given that the 12-point test is complex and subjective, I ultimately decided an appeal, even if we won, wouldn\u2019t accomplish that goal. Each case is unique. We\u2019d have to fight this battle again. And again. And again.<\/p>\n<p>Instead of appealing, I\u2019m calling on the Legislature to update state law. Make clear that records that would be public if held by a government agency are still public when held by a contractor doing government work.<\/p>\n<p>To be clear, I don\u2019t want a private company\u2019s payroll records or utility bills to be out in the public. I\u2019m not seeking trade secrets. I own a business and am sensitive to the desire to keep such information private.<\/p>\n<p>But documents a contractor creates or collects as part of its work for the government should be public.
