{"id":4416,"date":"2009-03-30T12:16:00","date_gmt":"2009-03-30T18:16:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/03\/can-we-have-an-ethics-commission-now\/"},"modified":"2009-03-30T12:16:00","modified_gmt":"2009-03-30T18:16:00","slug":"can-we-have-an-ethics-commission-now","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/03\/can-we-have-an-ethics-commission-now\/","title":{"rendered":"Can we have an ethics commission now?"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SdENnB3OAbI\/AAAAAAAALTI\/rQAEPhUinMw\/s1600-h\/Lujan,+Ben.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SdENnB3OAbI\/AAAAAAAALTI\/rQAEPhUinMw\/s200\/Lujan,+Ben.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5319047599067365810\" border=\"0\" \/><\/a><\/p>\n<p style=\"font-style: italic;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Lujan\u2019s billboard snafu is the latest situation to prove the need for creation of an independent ethics commission<\/span><\/p>\n<p class=\"MsoNormal\">Here\u2019s the latest example of a smelly situation involving public officials that probably won\u2019t get the proper investigation it deserves because New Mexico doesn\u2019t have an independent state ethics commission:<\/p>\n<p class=\"MsoNormal\">Did House Speaker <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HLUJA\" target=\"_blank\">Ben Lujan<\/a> get special treatment when top officials with the state <a href=\"http:\/\/www.nmshtd.state.nm.us\/\" target=\"_blank\">Department of Transportation<\/a> searched for ways to let him keep an illegal billboard up or at least retroactively legalize it so he could be compensated for its removal?<\/p>\n<p class=\"MsoNormal\">We don\u2019t know. And there\u2019s a good chance we won\u2019t know. <\/p>\n<p class=\"MsoNormal\">That\u2019s because there\u2019s not really an agency in place to investigate such fishy situations, except the attorney general, whose focus is on criminal activity. While lots of unethical behavior is criminal, plenty is not.<\/p>\n<p class=\"MsoNormal\">And while the Legislature does have an <a href=\"http:\/\/www.nmlegis.gov\/lcs\/committeedetail.aspx?CommitteeCode=ES\" target=\"_blank\">ethics committee<\/a> and procedures in place for dealing with ethical complaints against members, the committee doesn\u2019t do a thing. Not a thing.<\/p>\n<p class=\"MsoNormal\">Lujan, as <a href=\"http:\/\/haussamen.blogspot.com\/2009\/03\/dot-lujans-illegal-billboard-must-come.html\">The Santa Fe New Mexican<\/a> first reported earlier this month, has been maintaining an illegal billboard along U.S. 84\/285 near Pojoaque for years and was ordered by DOT to take it down in advance of an upcoming highway project.<\/p>\n<p class=\"MsoNormal\">Here\u2019s what Lujan told the New Mexican:<\/p>\n<p class=\"MsoNormal\" style=\"\">\u201cNobody had ever notified me that there\u2019s even a permit required in all these years that it\u2019s been there,\u201d he said, adding that he will talk to his lawyer and respond to the department\u2019s letter.<\/p>\n<p class=\"MsoNormal\" style=\"font-weight: bold;\"><span style=\"font-size:130%;\">Something fishy<\/span><\/p>\n<p class=\"MsoNormal\" style=\"\">There is a lot more to this story, and it was a weekend <a href=\"http:\/\/www.abqjournal.com\/news\/state\/291105state03-29-09.htm\" target=\"_blank\">Albuquerque Journal<\/a> article that revealed that DOT officials looked for ways to ensure Lujan could keep up the billboard or be compensated for its removal. Considering he\u2019s the speaker of the House, that\u2019s clue No. 1 that something could be fishy. Think anyone else got such treatment?<\/p>\n<p class=\"MsoNormal\" style=\"\">The Journal learned about the attempts to help Lujan from internal DOT documents it obtained from unnamed sources &#8212; records that were left out when the DOT provided a bunch of documents in response to a Journal public records request. Why did DOT omit them? <a href=\"http:\/\/en.wikipedia.org\/wiki\/Executive_privilege\" target=\"_blank\">\u201cExecutive privilege,\u201d<\/a> of course.<\/p>\n<p class=\"MsoNormal\" style=\"\">Right\u2026 That\u2019s clue No. 2 that there\u2019s a stench in the air.<\/p>\n<p class=\"MsoNormal\" style=\"\">Lujan refused to comment to the Journal. Clue No. 3.<\/p>\n<p class=\"MsoNormal\" style=\"\">Clue No. 4: Lujan makes thousands of dollars every year from selling advertising on the billboard. And, according to the Journal, he \u201c<span class=\"popup\">introduced legislation this year that would have made the DOT\u2019s six district engineers political appointees of the governor,\u201d which is something many power-hungry executives would want. The bill died.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span class=\"popup\">Given our state\u2019s pay-to-play culture and Lujan\u2019s <a href=\"http:\/\/haussamen.blogspot.com\/2009\/03\/open-conference-committees-are-good.html\">ethically challenged past<\/a>, this really stinks. Maybe there was nothing improper. Maybe there was.
