It\u2019s a probe that apparently has expanded to include a request for a host of documents from the auditor\u2019s office, including all tips sent to the fraud hotline, personnel files and \u201ccopies of all electronic communications\u201d including e-mails, text messages, faxes, attachments and embedded files, the Journal article quotes the subpoena as stating.<\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SdB0zMD56iI\/AAAAAAAALS4\/uWAZ9rHBDgQ\/s1600-h\/King,+Gary.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SdB0zMD56iI\/AAAAAAAALS4\/uWAZ9rHBDgQ\/s200\/King,+Gary.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5318879582684310050\" border=\"0\" \/><\/a>The subpoena was released by the auditor\u2019s office in response to a public records request, along with the auditor\u2019s response to it.<\/p>\n<p class=\"MsoNormal\">Balderas was quoted by the Journal as saying it was he who turned complaints made to the fraud hotline against him over to the AG in order to avoid a conflict of interest. The AG then made the broad request in the subpoena, to which the auditor\u2019s office responded that it \u201cis not prepared to allow the (attorney general) to rummage through its files.\u201d<\/p>\n<p class=\"MsoNormal\">\u201cSetting aside the legal objections to the subpoena, it is particularly disconcerting that the subpoena reflects a hostile attitude on the part of the Attorney General\u2019s Office that has derailed the efforts at mutual cooperation,\u201d the Journal quoted the letter as stating.<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">The political context<\/span><\/p>\n<p class=\"MsoNormal\">The political context is this: Though neither may actually run, the chatter is widespread that Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King<\/a> might challenge Lt. Gov. <a href=\"http:\/\/www.ltgovernor.state.nm.us\/\" target=\"_blank\">Diane Denish<\/a> for the Democratic nomination for governor in 2010, and that Balderas might run alongside Denish for lieutenant governor.<\/p>\n<p class=\"MsoNormal\">For the record, Balderas has told me <a href=\"http:\/\/haussamen.blogspot.com\/2008\/11\/rising-rapidly.html\">he is interested<\/a> in becoming lieutenant governor, while King last told me in 2007 that he was <a href=\"http:\/\/haussamen.blogspot.com\/2007\/02\/ag-king-discusses-wide-range-of-hot.html\">likely to run for re-election<\/a> in 2010 instead of seeking the state\u2019s highest office.<\/p>\n<p class=\"MsoNormal\">But there\u2019s another potential political angle to this story. Balderas has been a much more aggressive state auditor than any other in recent memory. He has worked to increase the influence of his office by using its previously little-utilized subpoena power in special audits, hiring criminal investigators and developing the fraud hotline.<\/p>\n<p class=\"MsoNormal\">Such investigatory power has most often been left to the AG, but Balderas has been involved in high-profile probes of the <a href=\"http:\/\/haussamen.blogspot.com\/2009\/01\/housing-authorities-were-colossal.html\">housing authority scandal<\/a> and <a href=\"http:\/\/haussamen.blogspot.com\/2009\/03\/balderas-expands-audit-of-state-land.html\">the dealings of the land office<\/a> &#8212; situations also being investigated by the AG.<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Another state official under investigation<\/span><\/p>\n<p class=\"MsoNormal\">At any rate, what\u2019s going on here is a legal standoff: The AG wants a bunch of information and has issued a subpoena for it. The auditor says the AG can\u2019t have some of the information he seeks. As is customary, the AG\u2019s office didn\u2019t comment, beyond saying that the AG \u201chas the authority to investigate other agencies,\u201d the Journal article states.<\/p>\n<p class=\"MsoNormal\">The bottom line: Add Balderas to the list of state officials under investigation, even if the allegations against him appear to be less serious than those leveled against some others, including the governor.
