The bill awaiting action by the governor is <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=534&amp;year=09\" target=\"_blank\">House Bill 534<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HCHAL\" target=\"_blank\">Eleanor Chavez<\/a>, D-Albuquerque.<\/p>\n<p class=\"MsoNormal\">Chavez\u2019s bill, as approved by the Legislature, is simple. It would require that government agencies accept requests for public records via e-mail and fax.<\/p>\n<p class=\"MsoNormal\">Currently, the <a href=\"http:\/\/www.nmag.gov\/pdf\/AGO%20IPRA%20Guide.pdf\" target=\"_blank\">New Mexico Inspection of Public Records Act<\/a> requires response to \u201coral\u201d and \u201cwritten\u201d requests for public records, but there\u2019s apparently no clear definition of what constitutes writing. Denying a request because it was sent electronically, and forcing someone to instead deliver the request in person or mail it, is one method some government agencies have used to make it more difficult to access public records.<\/p>\n<p class=\"MsoNormal\">I\u2019ve faced that type of stonewalling in the past. Cervantes\u2019 bill came in response to New Mexico State University\u2019s assertion in 2007 that records requests I filed <a href=\"http:\/\/haussamen.blogspot.com\/2007\/07\/is-nmsu-violating-government.html\">weren\u2019t valid<\/a> because they were sent via e-mail. The attorney general considered NMSU\u2019s denial of my request and said that, though his office and the vast majority of state agencies treat e-mail requests as valid, state law doesn\u2019t <a href=\"http:\/\/haussamen.blogspot.com\/2007\/12\/nmsu-gets-away-for-now-with.html\">explicitly require that they be treated as valid<\/a>.<\/p>\n<p class=\"MsoNormal\">Chavez\u2019s bill was approved by the Senate on Friday on a vote of 33-0. It had previously passed the House on a vote of 64-0.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 10:45 a.m.<\/p>\n<p class=\"MsoNormal\">Cervantes\u2019 bill just passed the Senate as well, on a vote of 32-5, and now goes, along with Chavez\u2019s, to the governor. I guess the governor will get to choose which one to sign &#8212; assuming he supports the proposal.<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>This article has been updated.
