{"id":4364,"date":"2009-03-17T21:35:00","date_gmt":"2009-03-18T03:35:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/03\/reform-bills-advance-but-it-may-be-too-late\/"},"modified":"2009-03-17T21:35:00","modified_gmt":"2009-03-18T03:35:00","slug":"reform-bills-advance-but-it-may-be-too-late","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/03\/reform-bills-advance-but-it-may-be-too-late\/","title":{"rendered":"Reform bills advance, but it may be too late"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/ScBsRk6ZwgI\/AAAAAAAALKY\/hjmaETSFGYY\/s1600-h\/2009Legislature.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 100px; height: 150px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/ScBsRk6ZwgI\/AAAAAAAALKY\/hjmaETSFGYY\/s200\/2009Legislature.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5314366609519395330\" border=\"0\" \/><\/a><\/p>\n<p class=\"MsoNormal\"><span style=\"font-weight: bold; font-style: italic;\">This article has been updated.<\/span><\/p>\n<p class=\"MsoNormal\">One high-profile ethics-reform proposal passed the House today, and another passed the Senate, but there\u2019s doubt that either will make it through the other chamber in time to be sent to the governor before the session ends at noon on Saturday.<\/p>\n<p class=\"MsoNormal\">The Senate approved today a committee substitute bill for <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=S&amp;LegType=B&amp;LegNo=263&amp;year=09\" target=\"_blank\">Senate Bill 263<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SBEFF\" target=\"_blank\">Sue Wilson Beffort<\/a>, R-Sandia Park, that also took elements from <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=S&amp;LegType=B&amp;LegNo=296&amp;year=09\" target=\"_blank\">Senate Bill 296<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SFELD\" target=\"_blank\">Dede Feldman<\/a>, D-Albuquerque. The bill would require that prospective and current state and local government contractors disclose their campaign contributions and that such disclosures be included in an Internet database accessible to the public.<\/p>\n<p class=\"MsoNormal\">It was approved on a vote of 26-11.<\/p>\n<p class=\"MsoNormal\">The House, meanwhile, approved on a vote of 64-0 a proposal to create an independent state ethics commission with subpoena power. The committee substitute for <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=151&amp;year=09\" target=\"_blank\">House Bill 151<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HPARK\" target=\"_blank\">Al Park<\/a>, D-Albuquerque, was also a replacement for <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?chamber=H&amp;legtype=B&amp;legno=%20614&amp;year=09\" target=\"_blank\">House Bill 614<\/a>, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HGAMH\" target=\"_blank\">Mary Helen Garcia<\/a>, D-Las Cruces.<\/p>\n<p class=\"MsoNormal\">The two bills approved today must make it through the other chamber before the session ends in order to be sent to the governor for a signature. The ethics commission proposal is the most likely to be dead. Several bills that would create a state ethics commission have been languishing in the <a href=\"http:\/\/www.nmlegis.gov\/lcs\/committeedisplay.aspx?CommitteeCode=SRC\" target=\"_blank\">Senate Rules Committee<\/a> for weeks. While the House has approved the proposal in the past, no ethics commission bill has made it to the Senate floor for debate in recent years.<\/p>\n<p class=\"MsoNormal\">The Rules Committee has become notorious for its reluctance to approve ethics-reform measures. During today\u2019s debate on SB 263, Feldman was asked why the bill didn\u2019t ban contributions from contractors, instead of requiring the disclosure of such contributions.<\/p>\n<p class=\"MsoNormal\">\u201cI\u2019ll tell you what this bill gets you that an outright ban won\u2019t get you, and that is passage through the Senate Rules Committee,\u201d Feldman said.<\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Aragon\u2019s sentencing discussed<\/span><\/p>\n<p class=\"MsoNormal\">Also noteworthy was the fact that the Senate\u2019s ethics-reform discussion came the same day that former Senate President <a href=\"http:\/\/haussamen.blogspot.com\/2009\/03\/aragon-sentenced-to-55-years-in-prison.html\">Manny Aragon was sentenced<\/a> for his role in stealing $4.2 million in taxpayer money by inflating and falsifying invoices during construction of the Bernalillo County Metropolitan Courthouse.<\/p>\n<p class=\"MsoNormal\">\u201cIt is an important day for the New Mexico State Senate and it is an important day to pass this bill,\u201d Feldman said in arguing for SB 263.<\/p>\n<p class=\"MsoNormal\">Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SGRIR\" target=\"_blank\">Eric Griego<\/a>, D-Albuquerque, also mentioned the Aragon sentencing in arguing for an outright ban on contributions from contractors.<\/p>\n<p class=\"MsoNormal\">\u201cRather than pile on, or rather than pontificate,\u201d Griego said, \u201cwe ought to just say, \u2018What can we do to better set some rules here?\u2019\u201d<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 9:55 p.m.<\/p>\n<p class=\"MsoNormal\">Oh yeah, I almost forgot to write about a big issue with the ethics commission bill that passed the House today. It would require the public release of reports in cases of ethics violations by members of the executive branch, but would keep investigations against members of the legislative branch completely confidential. The public would never get to know about ethical violations by legislators, the <a href=\"http:\/\/newmexicoindependent.com\/22128\/ethics-commission-bill-would-estabilsh-one-procedure-for-executive-branch-quite-another-for-lawmakers\" target=\"_blank\">New Mexico Independent<\/a> is reporting.<\/p>\n<p class=\"MsoNormal\">There are a number of words that could be used to describe that. Unfair is one. Veto-ready is another. Stupid is the first that comes to my mind.<\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/clearlynewmexico.com\/2009\/03\/17\/12-an-ethics-commission\/\" target=\"_blank\">Clearly New Mexico<\/a> put it this way:<\/p>\n<p class=\"MsoNormal\">\u201cThis is the equivalent of giving the henhouse keys to the fox,\u201d Matt Brix wrote in a posting on the blog. \u201cI doubt the public will buy the line that half of an ethics commission is better than the whole thing.\u201d<\/p>\n<p class=\"MsoNormal\">Agreed.<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>This article has been updated.
