(<a href=\"https:\/\/creativecommons.org\/licenses\/by-sa\/4.0\/\" target=\"_blank\" rel=\"noopener noreferrer\">photo cc info<\/a>)<\/p><\/div>\n<p>The practice is on stark display in a recent campaign report filed by mayoral candidate Brian Col\u00f3n, who returned contributions from several companies with city contracts on Sept.\u00a012 and then accepted contributions from the owners of those companies about a week later.<\/p>\n<p>Owners are allowed to give as individuals or through other companies they own.<\/p>\n<p>In his report filed Sept.\u00a022, Col\u00f3n showed he had returned contributions from contractors identified previously to him by KOB Channel 4, which was\u00a0<a href=\"http:\/\/www.kob.com\/investigative-news\/mayoral-candidates-accepted-city-contractor-contributions-dan-lewis-brian-colon-wayne-johnson-election-code-violations\/4606228\/\" target=\"_blank\" rel=\"noopener noreferrer\">reported<\/a>\u00a0by KOB on Sept.\u00a019.<\/p>\n<p>The report also reflected that Col\u00f3n had accepted contributions from the owners of those companies, as either individuals or through their other companies.<\/p>\n<p>He returned contributions of $5,000 from both\u00a0<a href=\"http:\/\/data.cabq.gov\/government\/erpcontracts\/PublishProcurementContract\/000000117311708024.1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Ekore<\/a>\u00a0and\u00a0<a href=\"http:\/\/data.cabq.gov\/government\/erpcontracts\/PublishProcurementContract\/000000052311708516.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Mechanical Control Solutions<\/a>, both of which have contracts with the city. He accepted contributions, in turn, from two companies that don\u2019t have city contracts but share the same owner as Ekore and MCS,\u00a0<a href=\"https:\/\/www.bizjournals.com\/albuquerque\/news\/2014\/12\/02\/steve-chavezs-plate-filling-with-wisepies-ics-and.html\" target=\"_blank\" rel=\"noopener noreferrer\">Steve Chavez<\/a>. Those contributions, also for $5,000 each, were from Chavez companies\u00a0<a href=\"http:\/\/www.sc3intl.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">SC3 International<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.sc3intl.com\/#\" target=\"_blank\" rel=\"noopener noreferrer\">Wisepies<\/a>\u00a0Franchise Services.<\/p>\n<p>The city checkbook, which is searchable online, shows the city has paid Ekore $57,210 since 2016. The city has paid PG Enterprises $83,018 since 2011. PG Enterprises is currently a vendor with the city, providing sand and gravel for the Biopark.<\/p>\n<p>Two contributions totaling $1,750 were returned to\u00a0<a href=\"http:\/\/cognospublic.cabq.gov\/cabqcognos\/cgi-bin\/cognos.cgi\" target=\"_blank\" rel=\"noopener noreferrer\">Star Paving<\/a>\u00a0company, whose owner, Joe Cruz, in turn made a $2,000 contribution to Col\u00f3n. The city checkbook reflects payments of $14,952,266 to Star Paving Company since 2010, and $247,153 to \u201cStar Paving Company, division of Cruz Corporation\u201d since 2015. A Star Paving Company holds a current purchasing agreement with the city to provide asphalt.<\/p>\n<p>Albuquerque\u2019s independent elections auditor, John Grisham of Ricci accounting firm, said in an email that such contributions by owners of companies that do business with the city are permissible under current law. Grisham cited what he called a prior opinion that derives from a 2013 court case:<\/p>\n<blockquote><p>The ban on contractor contributions remains for the specific individual or entity who is actually contracted with the City at the time of the proposed contribution. However, the ban does not bar an individual contribution from someone who works for or is associated with an entity who is contracted with an LLC, e.g. an employee, an investor or a shareholder in a corporation, an officer or director of a corporation, an organizer or manager of an LLC, provided that the funds contributed are from the individual\u2019s own income.<\/p><\/blockquote>\n<p>Col\u00f3n told NM\u00a0In Depth that he supported the ban on contributions from city contractors, and that he works to make sure contributions to his campaign are compliant with regulations.<\/p>\n<p>\u201cMy campaign is fully compliant with the city election code and will always be completely transparent,\u201d he said in a text message.<\/p>\n<p>KOB 4 also identified contributions from city contractors to mayoral candidates Dan Lewis and Wayne Johnson, but the Sept.\u00a022 reports filed by Lewis and Johnson don\u2019t indicate that either have returned the contributions.<!--more--><\/p>\n<p><a href=\"http:\/\/data.cabq.gov\/government\/erpcontracts\/PublishProcurementContract\/000000101311709288.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">The Garage, LLC<\/a>\u00a0contributed to $600 to Dan Lewis. That company has a current contract with the city, and has been paid $157,926 since 2010. Lewis also accepted $2,000 from PG Enterprises. Lewis told NM\u00a0In Depth that he has returned the donations, and was surprised to hear that his last report didn\u2019t reflect the returns. He speculated that the companies hadn\u2019t cashed the return checks yet, or that the return happened just after the last report was due. It would be reflected in his next report, due this Friday, he said.<\/p>\n<p><a href=\"http:\/\/data.cabq.gov\/government\/erpcontracts\/PublishProcurementContract\/000000009511707887.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Mosher Enterprises<\/a>\u00a0gave $5,000 to Wayne Johnson.
