He filed another lawsuit against the <a href=\"http:\/\/www.sic.state.nm.us\/\" target=\"_blank\">State Investment Council (SIC)<\/a> today for the same reason.<\/p>\n<p class=\"MsoNormal\">Foy, who has also filed a third lawsuit alleging a pay-to-play scheme involving the Richardson administration, filed requests under the state <a href=\"http:\/\/nmag.gov\/pdf\/AGO%20IPRA%20Guide.pdf\" target=\"_blank\">Inspection of Public Records Act<\/a> in January seeking a myriad of documents from the two state agencies. As the ERB did last week, SIC also rejected Foy\u2019s request &#8212; but for a different reason.<\/p>\n<p class=\"MsoNormal\">While ERB rejected the request on the basis that it was \u201cexcessively burdensome and broad\u201d &#8212; which Foy alleges in that lawsuit is not a valid justification for rejecting a request for public records &#8212; the SIC\u2019s rejection letter states as its basis \u201cthe well settled public policy and case law that freedom of information laws cannot be used to evade a court\u2019s discovery process.\u201d<\/p>\n<p class=\"MsoNormal\">Translation: Any records Foy wants, the SIC is saying, will have to be obtained through a subpoena.<\/p>\n<p class=\"MsoNormal\">Foy\u2019s lawsuit against SIC, which you can read by clicking <a href=\"http:\/\/www.haussamen.com\/FoyIPRAComplaint2.pdf\" target=\"_blank\">here<\/a>, states that the refusal, in addition to being a violation of the public records act, \u201cis dilatory and in bad faith. \u2026 The SIC has denied the request in order to prevent the public from learning about malfeasance, nonfeasance and incompetence at the SIC.\u201d<\/p>\n<p class=\"MsoNormal\">Foy\u2019s <a href=\"http:\/\/haussamen.blogspot.com\/2009\/01\/guvs-administration-faces-new-pay-to.html\">pay-to-play lawsuit<\/a>, which he has filed on behalf of the state, alleges that the state made investments with Vanderbilt and affiliated companies in exchange for a little more than $15,000 in contributions to Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson\u2019s<\/a> 2008 presidential campaign.
