Two 4&#215;8-foot signs were erected on private property adjacent to <st1:street st=\"on\"><st1:address st=\"on\">Roadrunner Parkway<\/st1:address><\/st1:street> and <st1:street st=\"on\"><st1:address st=\"on\">Lohman Avenue<\/st1:address><\/st1:street>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But the city\u2019s ordinance prohibits the erecting of campaign signs until 90 days before an election. That would be Aug. 9 for the November general election.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">No other candidates have begun putting up signs for the November election in <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:City>. Several, Republican and Democrat, have told me they believe it would be illegal to do so before Aug. 9.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Kristin Haase, Lyons\u2019 campaign manager, said she is trying to learn more about a case Lyons recalls from 1988 in which a court in New Mexico ruled that campaign signs can\u2019t be restricted by cities and counties unless they impede traffic or cause other hazards.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Thus far, Ruidoso and <st1:city st=\"on\"><st1:place st=\"on\">Las   Cruces<\/st1:place><\/st1:city> are the only municipalities to complain about the signs, which have gone up around the state, Haase said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename>, <st1:place st=\"on\"><st1:placename st=\"on\">Sunland<\/st1:placename> <st1:placetype st=\"on\">Park<\/st1:placetype><\/st1:place> and Hatch also allow signs 90 days before elections. Mesilla allows them 30 days before elections.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Hoyt Clifton with the secretary of state\u2019s office said Monday that city ordinances do apply on private property, unless private property is exempted in the ordinances. It is not exempted in the <st1:place st=\"on\"><st1:city st=\"on\">Las Cruces<\/st1:city><\/st1:place> rule.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">City codes enforcement officers began removing smaller <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> campaign signs that were placed in medians and right-of-way areas several days ago, said City Manager Terrence Moore.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cNow we\u2019re working with property owners to remove the larger signs on private property,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The maximum fine for violating the ordinance is $500. <st1:city st=\"on\"><st1:place st=\"on\">Moore<\/st1:place><\/st1:city> said Monday the first step would be to ask property owners to remove the signs, and only if they refuse will further action be taken.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/1600\/Baca%2C%20Jim.18.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/photos1.blogger.com\/blogger\/5892\/2386\/200\/Baca%2C%20Jim.13.jpg\" alt=\"\" border=\"0\" \/><\/a>Incumbent <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> faces Democrat Jim Baca in the November election. The race could be the closest of all statewide races this year. Donations to the <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> campaign are dwarfing those to Baca, but a recent poll by Baca showed he has a slight lead.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The poll also showed that <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> lacks name recognition. One consequence of this snafu: More people will know <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city>\u2019 name.
