{"id":4211,"date":"2009-02-05T00:05:00","date_gmt":"2009-02-05T06:05:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2009\/02\/lawmakers-propose-land-office-reforms\/"},"modified":"2009-02-05T00:05:00","modified_gmt":"2009-02-05T06:05:00","slug":"lawmakers-propose-land-office-reforms","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2009\/02\/lawmakers-propose-land-office-reforms\/","title":{"rendered":"Lawmakers propose land office reforms"},"content":{"rendered":"<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SYqCHmhZuoI\/AAAAAAAAKy8\/Y0p4NdWL4g8\/s1600-h\/2009Legislature.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 100px; height: 150px;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SYqCHmhZuoI\/AAAAAAAAKy8\/Y0p4NdWL4g8\/s200\/2009Legislature.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5299190978666150530\" border=\"0\" \/><\/a>In response to a controversy involving the <a href=\"http:\/\/www.nmstatelands.org\/\" target=\"_blank\">State Land Office<\/a> and a Las Cruces developer, three Do\u00f1a Ana County lawmakers are proposing reforms that would increase transparency and accountability in the land commissioner\u2019s dealings.<\/p>\n<p class=\"MsoNormal\">The proposals follow Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King\u2019s<\/a> finding fault last year with Land Commissioner <a href=\"http:\/\/www.nmstatelands.org\/default.aspx?PageID=2\" target=\"_blank\">Pat Lyons\u2019<\/a> leasing of land on Las Cruces\u2019 East Mesa to Philip Philippou so it could be developed. The AG\u2019s <a href=\"http:\/\/www.haussamen.com\/AGOpinionOnSoloLandDeal.pdf\" target=\"_blank\">formal opinion<\/a> on The Vistas at Presidio land deal states that the <a href=\"http:\/\/www.haussamen.com\/LandOfficeAgreement.pdf\" target=\"_blank\">lease agreement\u2019s<\/a> method of compensating Philippou\u2019s company for developing the land is \u201cnot comprehended by and in conflict with\u201d a statute that allows developers who improve land for the state to be compensated only for the appraised value of the improvements.<\/p>\n<p class=\"MsoNormal\" style=\"\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SYqCXZUMp4I\/AAAAAAAAKzE\/2XseRyh9KFc\/s1600-h\/Cote,+Nate.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer; width: 120px; height: 161px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SYqCXZUMp4I\/AAAAAAAAKzE\/2XseRyh9KFc\/s200\/Cote,+Nate.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5299191249999013762\" border=\"0\" \/><\/a>In the lease, the land office also agrees to compensate Philippou for other project costs and 40 percent of the change in value of the land as a result of the improvements.<\/p>\n<p class=\"MsoNormal\" style=\"\">The first bill in the package proposed by Reps. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HCOTE\" target=\"_blank\">Nate Cote<\/a> and <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HSTEI\" target=\"_blank\">Jeff Steinborn<\/a> and Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SFISC\" target=\"_blank\">Steve<\/a><a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SFISC\" target=\"_blank\"> Fischmann<\/a>, all Las Cruces Democrats, directly deals with the issue identified in the AG opinion. Cote\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=607&amp;year=09\" target=\"_blank\">House Bill 607<\/a> and Fischmann\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?chamber=S&amp;legtype=B&amp;legno=%20474&amp;year=09\" target=\"_blank\">Senate Bill 474<\/a> would make clear that developers can be compensated for tangible improvements to the land but nothing else.<\/p>\n<p class=\"MsoNormal\" style=\"\">The other bills in the package are:<\/p>\n<p class=\"MsoNormal\" style=\"\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SYqCXm0HYEI\/AAAAAAAAKzM\/UepRVZvhnRQ\/s1600-h\/Steinborn,+Jeff.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer; width: 120px; height: 162px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SYqCXm0HYEI\/AAAAAAAAKzM\/UepRVZvhnRQ\/s200\/Steinborn,+Jeff.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5299191253622546498\" border=\"0\" \/><\/a>\u2022 Steinborn\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=606&amp;year=09\" target=\"_blank\">House Bill 606<\/a>, which would require the land office to issue development leases only following public notice and a competitive bidding process.<\/p>\n<p class=\"MsoNormal\" style=\"\">\u2022 Cote\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=610&amp;year=09\" target=\"_blank\">House Bill 610<\/a>, which would require the land office to develop uniform systems for classifying accounts, budgeting and reporting.<\/p>\n<p class=\"MsoNormal\"> \u2022 Steinborn\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=B&amp;LegNo=605&amp;year=09\" target=\"_blank\">House Bill 605<\/a>, which would require local government review before the land office\u2019s development leases take effect.<\/p>\n<p class=\"MsoNormal\"> \u2022 Fischmann\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=S&amp;LegType=B&amp;LegNo=475&amp;year=09\" target=\"_blank\">Senate Bill 475<\/a>, which would require that the AG review development leases before they take effect.<\/p>\n<p class=\"MsoNormal\"><span style=\"font-size:130%;\"><span style=\"font-weight: bold;\">Las Cruces is \u2018ground zero\u2019 for statewide issue<\/span><\/span><\/p>\n<p class=\"MsoNormal\"> <a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SYqCHnY9tjI\/AAAAAAAAKy0\/ciYYyEJ8p-U\/s1600-h\/Fischmann,+Steve.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SYqCHnY9tjI\/AAAAAAAAKy0\/ciYYyEJ8p-U\/s200\/Fischmann,+Steve.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5299190978899195442\" border=\"0\" \/><\/a>Steinborn\u2019s bill that requires the land office to follow a competitive bidding process is significant because, in the Las Cruces situation, Lyons bypassed his own bidding process &#8212; which he\u2019s not currently required by law to use &#8212; and leased the thousands of acres of land in question to Philippou in December 2006. Months earlier, while the Republican Lyons was running for re-election, Philippou gave $20,500 to a political action committee run by lobbyists he employs. The PAC gave most of it to <st1:place st=\"on\"><st1:city st=\"on\">Lyons<\/st1:city><\/st1:place>\u2019 campaign, and the lobbyists gave another $3,600. After Lyons leased the land to Philippou, the developer gave another $6,000 to Lyons.<\/p>\n<p class=\"MsoNormal\">On a conference call about the bills on Wednesday, Steinborn called the Las Cruces situation \u201cground zero\u201d for \u201cproblems\u201d in the land office that affect the entire state, because Lyons has entered into similar agreements for land in Albuquerque, Rio Rancho, Santa Fe and elsewhere. The AG has refused to back up his opinion with a lawsuit, and Lyons has effectively ignored it.<\/p>\n<p class=\"MsoNormal\">Cote said the legislation is an important response to the concerns of his constituents and others in the Las Cruces area, and it shouldn\u2019t be viewed as an attempt to impede the work of the land office.<\/p>\n<p class=\"MsoNormal\">\u201cThe public, the people of my district and new Mexicans, want government accountability,\u201d Cote said. <\/p>\n<p class=\"MsoNormal\">Fischmann said it\u2019s now clear that the land office \u201cwas somehow operating out of sync with what the public needs were,\u201d but Steinborn said he\u2019s hoping that, in spite of that, Lyons will support the reform proposals.<\/p>\n<p class=\"MsoNormal\">A spokeswoman for Lyons did not immediately respond to a request for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In response to a controversy involving the State Land Office and a Las Cruces developer, three Do\u00f1a Ana County lawmakers are proposing reforms that would increase transparency and accountability in the land commissioner\u2019s dealings.
