{"id":41421,"date":"2012-07-11T13:47:20","date_gmt":"2012-07-11T19:47:20","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=41421"},"modified":"2012-07-11T13:47:23","modified_gmt":"2012-07-11T19:47:23","slug":"aps-board-member-will-start-using-public-e-mail-account","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2012\/07\/aps-board-member-will-start-using-public-e-mail-account\/","title":{"rendered":"APS Board member will start using public e-mail account"},"content":{"rendered":"<div id=\"attachment_41422\"  class=\"wp-caption module image alignright\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-41422\" title=\"Esquivel, Martin\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2012\/07\/Esquivel-Martin.jpg\" alt=\"Martin Esquivel\" width=\"120\" height=\"160\" \/><\/a><p class=\"wp-caption-text\">Martin Esquivel<\/p><\/div>\n<h4>\u2018I think transparency trumps convenience in this regard and hope others follow my lead,\u2019 Martin Esquivel says.<\/h4>\n<p>Albuquerque Public Schools Board of Education Member <a href=\"http:\/\/www.aps.edu\/about-us\/board\/about-the-board\/board-members\/martin-esquivel\" target=\"_blank\">Martin Esquivel<\/a> has decided to use an official APS e-mail account for communication with constituents.<\/p>\n<p>Esquivel decided to make the change earlier this week, after I published <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/07\/personal-e-mail-issue-begs-for-clarity\/\" target=\"_blank\">a column<\/a> about the issue and reported that he used a private e-mail address as his official APS contact.<\/p>\n<p>\u201cAfter much thought, I have instructed the APS Board office to list my official APS e-mail address for constituent contacts off the website,\u201d Esquivel, who is also a N.M. Foundation for Open Government (FOG) <a href=\"http:\/\/nmfog.org\/Board_Members.aspx\" target=\"_blank\">Board member<\/a>, wrote in an e-mail earlier this week. \u201cI think transparency trumps convenience in this regard and hope others follow my lead.\u201d<\/p>\n<p>There are other APS board members and local-government officials around the state who use personal e-mail for official business, in addition to a number of legislators and others, though many others use government e-mail. A debate has been raging lately about public officials\u2019 use of personal e-mail accounts and whether such e-mails, when they relate to public business, are subject to the state\u2019s <a href=\"https:\/\/docs.google.com\/viewer?a=v&amp;pid=sites&amp;srcid=bm1hZy5nb3Z8dGVzdC1ubWFnfGd4OjYyNzRhYTU2OWY1YzQ3ZTY&amp;pli=1\" target=\"_blank\">Inspection of Public Records Act<\/a> (IPRA).<\/p>\n<p>When I asked Esquivel about the issue last week, he told me he had no problem turning over constituent e-mails sent to his personal address.<\/p>\n<p>\u201cI don\u2019t consider myself a records custodian, but the way I look at it, if Mr. and Mrs. Smith send me an e-mail complaining about the operations at a middle school, is there any expectation of privacy there? I don\u2019t think so,\u201d he said, though he added that one person who feared retaliation was recently upset with him for passing on a complaint to an APS administrator.<\/p>\n<p>In addition to listing a personal e-mail address for constituent contact, Esquivel had been using a personal account for contact with APS administration and staff.
