Tuesday\u2019s lawsuit filed by <a href=\"http:\/\/www.swop.net\/\" target=\"_blank\">SouthWest Organizing Project<\/a> (SWOP) and the <a href=\"http:\/\/www.civicpolicy.com\/\" target=\"_blank\">Center for Civic Policy\u2019s<\/a> New Mexico Youth Organized (NMYO) is their attempt to stop what the lawsuit calls the \u201cchilling effect\u201d the state agencies\u2019 action has had on their right to free speech.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cAlthough NMYO and SWOP do not intend to register as political committees, the defendant\u2019s threats to impose civil and criminal sanctions on them if they fail to register has had, and continues to have, a chilling effect on NMYO\u2019s and SWOP\u2019s protected activities,\u201d the lawsuit states, adding that the groups have ceased sending out what they call issue-based mailers \u201cbecause they fear enforcement of the <a href=\"http:\/\/www.sos.state.nm.us\/pdf\/campaign.pdf\" target=\"_blank\">(Campaign Reporting) Act<\/a> against them and the Act\u2019s related criminal and civil penalties.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">You can read the entire complaint, which was filed in U.S. District Court in Albuquerque, by clicking <a href=\"http:\/\/www.haussamen.com\/CCPComplaint.pdf\" target=\"_blank\">here<\/a>. Spokesmen for Secretary of State <a href=\"http:\/\/www.sos.state.nm.us\/sos-SecBio.html\" target=\"_blank\">Mary Herrera<\/a>, the named defendant in the lawsuit, and Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King<\/a>, the secretary of state\u2019s attorney, did not immediately respond to requests for comment.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\" style=\"\">The primary purpose of NMYO, according to the complaint, \u201cis to educate young New Mexicans regarding issues that are important to them,\u201d while SWOP\u2019s purpose is \u201cto empower the New Mexico communities that it serves across the state &#8212; including Latinos and other people of color, low-income individuals, and young people &#8212; to realize racial and gender equality and social and economic justice.\u201d<o:p><\/o:p><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Earlier this year, King advised the secretary of state that the nonprofits had resorted to political campaigning in mailers <a href=\"http:\/\/www.haussamen.com\/M1RobinsonFF.pdf\" target=\"_blank\">like this one<\/a> sent two to three months before the June primary targeting several lawmakers, including some who had primary opponents. The secretary of state ordered both groups to register as political committees and comply with the Campaign Reporting Act by regularly reporting contributions and expenditures publicly, just like candidates, campaigns and political action committees.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The groups say their mailers were related to a coming special session of the Legislature, not the election, and they shouldn\u2019t have to register. King hasn\u2019t shared the reasoning behind his advice beyond saying the key issue is the meaning of the phrase \u201cpolitical purpose\u201d in the act. Attorneys for NMYO and SWOP, on the other hand, have <a href=\"http:\/\/www.haussamen.com\/sosLTR_080606.pdf\" target=\"_blank\">laid out their legal arguments publicly<\/a> in a letter to the secretary of state.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\" style=\"font-weight: bold;\"><span style=\"font-size:130%;\">\u2018We were left with no choice\u2019<\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\" style=\"\">In addition to the legal arguments laid out in that letter, attorneys for the nonprofits make one new argument in Tuesday\u2019s complaint: that the statutes in the campaign reporting act that King\u2019s office interprets to mean the nonprofits must register as political committees are unconstitutional because \u201cthey purport to regulate &#8212; and defendant has asserted that they do regulate &#8212; organizations engaging in issue advocacy rather than express political advocacy or its functional equivalent.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Even if the statutes are constitutional as applied to some other groups, the complaint states, they are unconstitutional \u201cas applied to Plaintiffs because the defendant cannot lawfully regulate Plaintiffs\u2019 conduct.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The groups are asking that a federal judge declare the statutes unconstitutional or, in the alternative, declare that they don\u2019t apply to the nonprofits; that a judge stop the secretary of state from requiring them to register as political committees and imposing sanctions if they do not; and the a judge order that the state pay their legal fees.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe\u2019re concerned that if the secretary of state is allowed to arbitrarily order nonprofits to register as political committees without explanation it will muzzle the important civic engagement work of our sector,\u201d Matt Brix, CCP\u2019s policy director, said in a news release announcing the lawsuit. \u201cWhile we didn\u2019t want to file suit against the state, we were left with no choice. Nonprofit organizations have a responsibility to inform the public about the votes of elected officials and the source of their contributions. Furthermore, the public has a right to know what elected officials are doing in their name.\u201d<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 2:35 p.m.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Phil Sisneros, spokesman for the AG, said his office has not been served with the lawsuit, but \u201cregarding nonprofits engaging in electioneering activities, our position has not changed.\u201d<\/p>\n<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-style: italic;\" class=\"MsoNormal\">By way of disclosure, I also write for the <a href=\"http:\/\/www.newmexicoindependent.com\/\" target=\"_blank\">New Mexico Independent<\/a>, which is owned by the <a href=\"http:\/\/www.newjournalist.org\/\" target=\"_blank\">Center for Independent Media<\/a> in Washington. When the group was starting up its New Mexico news site earlier this year, the Center for Civic Policy helped it locate funding sources.
