{"id":398505,"date":"2017-07-31T09:56:19","date_gmt":"2017-07-31T15:56:19","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=398505"},"modified":"2017-07-31T09:56:19","modified_gmt":"2017-07-31T15:56:19","slug":"its-time-to-let-the-hobbs-city-manager-go","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2017\/07\/its-time-to-let-the-hobbs-city-manager-go\/","title":{"rendered":"It&#8217;s time to let the Hobbs city manager go"},"content":{"rendered":"<p><strong>COMMENTARY:<\/strong> Hobbs city commissioners must vote against any transition, any modified severance, any consulting agreement or any employment extension for City Manager John J. \u201cJ.J.\u201d Murphy before his contract\u2019s end date, which is presumed to be\u00a0<a href=\"http:\/\/digital.olivesoftware.com\/Olive\/APA\/HobbsNews\/SharedView.Article.aspx?href=NHN%2F2017%2F07%2F26&amp;id=Ar00110&amp;sk=B310367C\" target=\"_blank\" rel=\"noopener noreferrer\">Aug. 23<\/a>. I urge them to let the contract expire, and you should urge them, too.<\/p>\n<div id=\"attachment_63580\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-63580\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/07\/Coates-Jeanie-336x244.jpg\" alt=\"Jeanie Coates\" width=\"336\" height=\"244\" \/><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Jeanie Coates<\/p><\/div>\n<p>I wrote in an April 20, 2016, opinion editorial that <a href=\"http:\/\/nmpolitics.net\/index\/2016\/04\/hobbs-should-terminate-city-managers-contract-pay-severance\/\" target=\"_blank\" rel=\"noopener noreferrer\">appeared on NMPolitics.net<\/a>, \u201cFor all the free-wheeled spending Murphy has either gotten away with or attempted, why not just terminate Murphy\u2019s employment and pay him his severance now?\u201d<\/p>\n<p>If the commission had listened to me and terminated his contract that next month, Murphy would only be a memory, because the year\u2019s worth of salary and benefits that are listed in the severance of his current contract would all be paid off by now. But no.<\/p>\n<p>Last October, the commission considered a \u201ctransition\u201d contract for Murphy. Mayor Sam Cobb made a hard sell for the proposed contract, which would transition Murphy to a \u201cspecial consultant to the Mayor and City Commission through\u00a0July 2nd, 2018,\u201d he wrote in the <a href=\"http:\/\/digital.olivesoftware.com\/olive\/apa\/hobbsnews\/SharedView.Article.aspx?href=NHN%2F2016%2F10%2F02&amp;id=Ar00400&amp;sk=86DD877D\" target=\"_blank\" rel=\"noopener noreferrer\">Oct. 2, 2016, edition<\/a> of the Hobbs News-Sun. He said the agreement would \u201cbenefit all stakeholders, including the residents of Hobbs.\u201d<\/p>\n<p>More than once, I\u2019ve read the News-Sun\u2019s claim that there would have been <a href=\"http:\/\/digital.olivesoftware.com\/Olive\/APA\/HobbsNews\/SharedView.Article.aspx?href=NHN%2F2016%2F10%2F09&amp;id=Ar00407&amp;sk=7C458770\" target=\"_blank\" rel=\"noopener noreferrer\">about $100,000 in cost savings<\/a> if the city commission had agreed to the proposed transition contract last October. Be that as it may, I thank the commission for rejecting the proposal, and I implore commissioners to reject any new proposal. No amount of \u201csavings\u201d is worth Murphy being involved with Hobbs city government another year.<\/p>\n<p>If a new proposal to make him a \u201cspecial consultant\u201d is in the works, the public will not learn the details until one business day before the\u00a0Aug. 7\u00a0commission meeting. That leaves no time for the public to debate in a public forum what the commission should do. In case a one-year \u201cspecial consultant\u201d proposal is what\u2019s coming, I think it\u2019s at least valuable to review <a href=\"http:\/\/wethefourth.org\/files\/pdf\/proposed-murphy-agreement-2016-10-03.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">last October\u2019s proposal<\/a> for clues:<\/p>\n<ul>\n<li>The city would continue to pay Murphy\u2019s more than $180,000 salary, as well as his $750-per-month car allowance, his short-term disability insurance premiums, and his health insurance premiums for him and up to six dependents. A consultant! Hello!? And he doesn\u2019t even have to be in City Hall. How \u201cspecial\u201d can one consultant be? We\u2019ll just be paying him to look for a new job, which is what we\u2019ve already been doing <a href=\"http:\/\/wethefourth.org\/hobbs-ongoing-debacle.html#msg-box3-5\" target=\"_blank\" rel=\"noopener noreferrer\">for the last three years<\/a>.<\/li>\n<li>Murphy would be \u201ccompensated for all PTO accrued\u2026 as well as all paid holidays and military leave.\u201d The city\u2019s past auditing firm questioned Murphy\u2019s PTO accounting and the resulting PTO payouts. And since his cover letter for the Treasure Island, Fla., city manager position <a href=\"http:\/\/wethefourth.org\/files\/pdf\/JJ-resume-ti-fl.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">says<\/a>, \u201cI am set to retire in June 2017,\u201d I\u2019m figuring compensation for military leave should be a nonissue.<\/li>\n<li>The city would \u201cpay all reasonable litigation expenses of Murphy throughout the pendency of any litigation to which Murphy is a party, witness or advisor to the City.\u201d So long as a lawsuit is not between Murphy and the city, Murphy \u201cshall be compensated his current hourly rate at up to eight hours per day.\u201d<\/li>\n<li>The last slap in the face is that Murphy and the city would \u201crelease any claims that they may have against one another for events occurring prior to the Effective Date.\u201d Essentially, \u201cGive me what I want, or else I\u2019ll sue.\u201d<\/li>\n<\/ul>\n<p>Last October, when Mayor Cobb pitched Murphy\u2019s last proposed transition agreement, he said \u201call stakeholders\u201d would benefit. If the latest version of a proposed transition contract looks much like the last, the benefit is Murphy\u2019s alone.<!--more--><\/p>\n<p>Hobbs voters want their commissioners to protect their interests, not the city manager\u2019s. In July 2015, I chronicled <a href=\"http:\/\/nmpolitics.net\/index\/2015\/07\/hobbs-managers-contract-evolution-exposes-sense-of-entitlement\/\" target=\"_blank\" rel=\"noopener noreferrer\">here on NMPolitics.net<\/a> the amendments of Murphy\u2019s employment contract, which evolved as his sense of entitlement grew, but only in proportion to our commissioners\u2019 inability to say \u201cno.\u201d Since 2015, more than a dozen city councils have <a href=\"http:\/\/wethefourth.org\/hobbs-ongoing-debacle.html#msg-box3-5\" target=\"_blank\" rel=\"noopener noreferrer\">rejected Murphy for city manager jobs<\/a>, and yet Murphy\u2019s greed and self-importance are unabashed; he still thinks he deserves benefits that no Hobbs taxpayers would ever receive if they were terminated from their jobs.<\/p>\n<p>Let his contract run out. Hobbs has been bled enough.
