{"id":3969,"date":"2008-11-07T01:05:00","date_gmt":"2008-11-07T07:05:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/11\/judge-dismisses-defeated-legislators-lawsuit\/"},"modified":"2008-11-07T01:05:00","modified_gmt":"2008-11-07T07:05:00","slug":"judge-dismisses-defeated-legislators-lawsuit","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/11\/judge-dismisses-defeated-legislators-lawsuit\/","title":{"rendered":"Judge dismisses defeated legislators&#8217; lawsuit"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SRPkEl82J-I\/AAAAAAAAJTE\/vLft04z43MQ\/s1600-h\/Robinson,+Shannon.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SRPkEl82J-I\/AAAAAAAAJTE\/vLft04z43MQ\/s200\/Robinson,+Shannon.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5265803156884170722\" border=\"0\" \/><\/a>A lawsuit alleging an illegal conspiracy to defeat three incumbent lawmakers in the June primary was tossed out by a district judge on Thursday because the lawmakers failed to state a proper claim and have no basis to sue many of the defendants named in the suit.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The <a href=\"http:\/\/www.civicpolicy.com\/\" target=\"_blank\">Center for Civic Policy<\/a> (CCP), one of the groups named in the lawsuit, hailed the dismissal as vindication of its claim that the lawsuit was frivolous.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe are pleased with today\u2019s news and we certainly feel vindicated,\u201d Matt Brix, policy director for the group, said in a statement released Thursday evening. \u201cThis lawsuit was nothing more than an attempt to muzzle nonprofit organizations from educating the public about how their legislators vote. We look forward to continuing our work, including educating the public about how elected officials vote and from whom they receive contributions.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SRPkE5bNh7I\/AAAAAAAAJTM\/hT1_215ZMSc\/s1600-h\/Taylor,+James.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/SRPkE5bNh7I\/AAAAAAAAJTM\/hT1_215ZMSc\/s200\/Taylor,+James.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5265803162111805362\" border=\"0\" \/><\/a>In dismissing the lawsuit filed by outgoing Sens. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=282&amp;Submit=Search\" target=\"_blank\">Shannon Robinson<\/a> and <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=232&amp;Submit=Search\" target=\"_blank\">James Taylor<\/a> and Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=226&amp;Submit=Search\" target=\"_blank\">Dan Silva<\/a>, Judge <a href=\"http:\/\/www.votevanzi.com\/\" target=\"_blank\">Linda Vanzi<\/a> wrote that, under state law, candidates who contest elections can sue their opponents but not third-party groups. The lawmakers named their opponents, along with CCP and other groups, in their lawsuit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In addition, the judge wrote, the lawmakers alleged that the conspiracy against them involved violations of criminal statutes and the IRS code, but neither is enforceable in civil court. Because of that, Vanzi wrote, \u201cabsent any allegation from contestants that the votes were miscounted or uncounted, that voters cast their votes illegally or that election officials committed fraud, contestants have not asserted a claim\u2026 for which relief can be granted.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">To top it off, the lawsuit improperly named some defendants as officers in organizations in which they are not officers, and even named as a defendant one organization that no longer exists. Read the judge\u2019s dismissal by clicking <a href=\"http:\/\/www.haussamen.com\/CCPLawsuitDismissed.PDF\" target=\"_blank\">here<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/SRPkE0leylI\/AAAAAAAAJTU\/IA2fGpTabdk\/s1600-h\/Silva,+Dan.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer; width: 120px; height: 160px;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/SRPkE0leylI\/AAAAAAAAJTU\/IA2fGpTabdk\/s200\/Silva,+Dan.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5265803160812702290\" border=\"0\" \/><\/a>In June, <a href=\"http:\/\/www.ericgriegofornewmexico.com\/\" target=\"_blank\">Eric Griego<\/a> defeated <st1:city st=\"on\"><st1:place st=\"on\">Taylor<\/st1:place><\/st1:city> by 24 percentage points, <a href=\"http:\/\/www.timkellerfornewmexico.com\/\" target=\"_blank\">Tim Keller<\/a> defeated Robinson by 32 points and <a href=\"http:\/\/www.eleanorchavez.com\/\" target=\"_blank\">Eleanor Chavez<\/a> defeated Silva by eight points. The lawmakers <a href=\"http:\/\/haussamen.blogspot.com\/2008\/08\/legislators-lawsuit-is-baseless.html\">filed the lawsuit in August<\/a>, claiming that the nonprofits and their opponents conspired to illegally hide the spending of at least $180,000 on a secret campaign against them. They alleged that the money was funneled through CCP and the <a href=\"http:\/\/theleague.com\/\" target=\"_blank\">League of Young Voters<\/a> &#8212; which no longer exists in <st1:state st=\"on\"><st1:place st=\"on\">New   Mexico<\/st1:place><\/st1:state> &#8212; to at least six other nonprofits.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Some of the groups named in the lawsuit endorsed the defeated lawmakers\u2019 challengers in the primary. Others, including CCP, engaged in what they call a \u201cLegislative Accountability Project\u201d that used mailers, radio ads and phone calls to highlight lawmakers\u2019 voting records two to three months before the primary.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The groups say the accountability project was related to a coming special session of the Legislature, not the election. The attorney general and secretary of state disagreed, and have tried to force CCP and a second group involved in the situation, <a href=\"http:\/\/swop.net\/\" target=\"_blank\">SouthWest Organizing Project<\/a> (SWOP), to register as political committees and comply with the state\u2019s campaign reporting act.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The attorney general and attorneys for the groups have agreed to a stay on any action by the secretary of state so the case can instead be resolved through legal action.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">At stake is what nonprofits can and can\u2019t do when spreading information about elected officials, and the question is whether the mailers crossed the line between issue advocacy and political campaigning.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">If I get comment from the lawmakers on Vanzi\u2019s action, you\u2019ll read it here.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 8 a.m.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Silva and <st1:city st=\"on\"><st1:place st=\"on\">Taylor<\/st1:place><\/st1:city> told the <a href=\"http:\/\/newmexicoindependent.com\/9236\/lawsuit-filed-by-defeated-state-lawmakers-dismissed\" target=\"_blank\">New Mexico Independent<\/a> that they are ready to keep fighting. Robinson, according to the Independent, told <a href=\"http:\/\/www.kunm.org\/\" target=\"_blank\">KUNM-AM radio<\/a> that he believes Vanzi is an ally of the nonprofits, so the judge\u2019s ruling didn\u2019t surprise him. He said he plans to take the case to the state Supreme Court and expects a different result there.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Meanwhile, <a href=\"http:\/\/cvnm.org\/index.html\" target=\"_blank\">Conservation Voters of New Mexico<\/a>, another nonprofit named in the lawsuit, put out a news release applauding the judge\u2019s decision.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe are pleased and redeemed that the judge has dismissed this baseless complaint,\u201d said Sandy Buffett, the group\u2019s executive director. \u201cThese legislators lost their seats because the voters spoke and voted against entrenched and out-of-touch incumbents who had consistently sided with the polluters and industry special interests over the protection of clean air, clean water and public health.\u201d<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-style: italic;\" class=\"MsoNormal\">By way of disclosure, I also write for the <a href=\"http:\/\/www.newmexicoindependent.com\/\" target=\"_blank\">New Mexico Independent<\/a>, which is owned by the <a href=\"http:\/\/www.newjournalist.org\/\" target=\"_blank\">Center for Independent Media<\/a> in <st1:state st=\"on\"><st1:place st=\"on\"><st1:state st=\"on\"><st1:place st=\"on\">Washington<\/st1:place><\/st1:state><\/st1:place><\/st1:state>. When the group was starting up its <st1:state st=\"on\"><st1:place st=\"on\"><st1:state st=\"on\"><st1:place st=\"on\">New   Mexico<\/st1:place><\/st1:state><\/st1:place><\/st1:state> news site earlier this year, the Center for Civic Policy helped it locate funding sources.
