Fischmann has 12,853 votes, or 51 percent, to Rawson\u2019s 12,348 votes, or 49 percent.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That led Senate Majority Leader <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=286&amp;Submit=Search\" target=\"_blank\">Michael Sanchez<\/a>, D-Belen, to call Fischmann a senator-elect in a news release, and for Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> to call him a newly elected legislator in a statement released by his office. But Fischmann said he\u2019s not ready to declare victory.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe\u2019re feeling very good about the numbers, but I\u2019m a pretty cautious guy, so I\u2019m not declaring anything,\u201d Fischmann said. \u201cWe\u2019ll see how the process goes, but it sure looks like it\u2019s rolling in my favor.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Rawson, who has served in the Senate since 1987, has not responded to requests for comment. Fischmann said he has not heard from Rawson.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename> spokesman Jess Williams said the elections supervisor told him there are approximately 2,100 provisional ballots countywide to be considered, and Fischmann said there are eight provisional ballots from the one precinct in <st1:place st=\"on\"><st1:placename st=\"on\">Sierra<\/st1:placename> <st1:placetype st=\"on\">County<\/st1:placetype><\/st1:place> that is located in the Senate district.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Williams said <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename>  <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place> won\u2019t start sorting its provisional ballots and know how many are relevant to the Rawson\/Fischmann race until Thursday.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">One other potential factor is <st1:place st=\"on\"><st1:placename st=\"on\">Do\u00f1a<\/st1:placename> <st1:placename st=\"on\">Ana<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>\u2019s <a href=\"http:\/\/haussamen.blogspot.com\/2008\/11\/absentee-ballot-snafu-how-many-wont-get.html\">absentee ballot snafu<\/a>. The county didn\u2019t comply during the election cycle with a law requiring that absentee ballots be mailed out within 24 hours of the office receiving requests for the ballots and, as of Tuesday morning, 3,844 people who had requested absentee ballots had not yet voted.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Williams said he doesn\u2019t have updated numbers on how many who requested absentee ballots didn\u2019t vote in the election. Rawson and others raised concerns in the days leading up to the election about would-be voters being disenfranchised by the situation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But it\u2019s not clear that provisional ballots or would-be absentee voters would help Rawson. Historically, Democrats have tended to grab the lion\u2019s share of provisional ballots. And, statewide, absentee ballots tended to swing to Democrats in this election. In this race, 1,523 absentee ballots that were cast went to Fischmann, while 1,154 went to Rawson.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">A change in leadership?<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Rawson is one of two Republican senators trailing in close races. Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=270&amp;Submit=Search\" target=\"_blank\">Steve Komadina<\/a> of Corrales is also on the ropes, trailing <a href=\"http:\/\/sapienforsenate.com\/\" target=\"_blank\">John Sapien<\/a> by 53 votes. In addition, Republican Sen. <a href=\"http:\/\/www.senatorsnyder.com\/\" target=\"_blank\">Diane Snyder<\/a> of <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> was defeated by Democrat <a href=\"http:\/\/eichenbergfornewmexico.com\/\" target=\"_blank\">Tim Eichenberg<\/a> on Tuesday. While there are currently 24 Democrats and 18 Republicans in the state Senate, that could shift to 27-15 if Sapien and Fischmann hold on to win.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Which brings up the Senate\u2019s leadership. The president of the Senate, <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=267&amp;Submit=Search\" target=\"_blank\">Tim Jennings<\/a>, D-Roswell, upset many Democrats last week when he denounced in a robocall <a href=\"http:\/\/haussamen.blogspot.com\/2008\/11\/dems-rip-jennings-for-denouncing.html\">negative attacks against Rawson<\/a>. <st1:city st=\"on\"><st1:place st=\"on\">Jennings<\/st1:place><\/st1:city> pointed out that he didn\u2019t endorse Rawson, but Richardson and others accused him of breaking a pledge to back Fischmann.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\"><st1:place st=\"on\">Jennings<\/st1:place><\/st1:city> is one of a handful of Democratic senators who often band together with Republicans to form a coalition that has kept the governor in check for the last two years. Insiders have said primary losses by two conservative Democrats to progressive challengers in June, coupled with losses by Republican senators on Tuesday, could lead to an overthrow of the Senate\u2019s leadership and a new, more governor-friendly Senate in January.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\">Richardson<\/st1:city>, in decrying <st1:city st=\"on\"><st1:place st=\"on\">Jennings<\/st1:place><\/st1:city>\u2019 robocall, said earlier this week that the senator was trying to protect his leadership position. <st1:city st=\"on\"><st1:place st=\"on\">Jennings<\/st1:place><\/st1:city> said at the time that he opposes negative campaigning and, as the Senate\u2019s leader, was doing what he would for any member &#8212; Democrat or Republican &#8212; who was unfairly attacked.
