House District 16 race.<\/p>\n<p>Lu\u00e9vano made the comment to NMPolitics.net after a district judge on Monday removed his name from the ballot. He has five days from Monday to appeal.<\/p>\n<p>Here\u2019s more on the judge\u2019s ruling from <a href=\"mailto:http:\/\/www.capitolreportnewmexico.com\/%3Fp=9021\" target=\"_blank\">Capitol Report New Mexico<\/a>:<\/p>\n<blockquote><p>\u201c\u2018If intent was the issue, this court\u00a0would\u00a0have no problem\u201d\u00a0ruling in favor of Luevano,\u00a0District Court Judge Alan Malott\u00a0said, but pointed\u00a0out that by statute, a candidate has to have established residence in the district\u00a0he or she chooses to run in by March 6\u00a0of this year and Luevano and his family had not received a certificate of occupancy for their\u00a0their newly-constructed house on Albuquerque\u2019s Westside until March 13.<\/p>\n<p>\u201cAfter Malott rendered his decision, (Lu\u00e9vanos\u2019 attorney, Mark) Jarmie\u00a0asked the judge to declare that Luevano did not act in violation of a statute regarding the falsifying election documents.\u00a0Vargas\u00a0had no objection and the judge said \u2018the court very emphatically\u2019 reiterated that Luevano \u2018acted with the best of interests and motivations.\u2019\u201d<\/p><\/blockquote>\n<p>Capitol Report also talked with Lu\u00e9vano after the hearing. He says that was his best option for retaining residency while an active-duty Marine. Police are investigating.<\/p>\n<p>And Lu\u00e9vano filed to run for the House seat currently held by Democrat <a href=\"http:\/\/www.moejustice.com\/\" target=\"_blank\">Antonio \u201cMoe\u201d Maestas<\/a>, D-Albuquerque, who challenged his candidacy based on the fact that he didn\u2019t move into the home in District 16 until days after the deadline to live there.<\/p>\n<p>Lu\u00e9vano is <a href=\"mailto:http:\/\/www.nmpolitics.net\/index\/2012\/03\/luevano-running-for-office-no-longer-an-nmpolitics-net-columnist\/\" target=\"_blank\">a former NMPolitics.net columnist<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>VIDEO: Republican Johnny Lu\u00e9vano says he hasn\u2019t decided whether to appeal a judge\u2019s decision to disqualify him from the N.M.
