{"id":38378,"date":"2012-03-26T18:51:27","date_gmt":"2012-03-27T00:51:27","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=38378"},"modified":"2012-03-27T07:16:57","modified_gmt":"2012-03-27T13:16:57","slug":"duran-oks-candidates-garcia-to-sue","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2012\/03\/duran-oks-candidates-garcia-to-sue\/","title":{"rendered":"Duran OKs candidates; Garcia to sue"},"content":{"rendered":"<div id=\"attachment_28695\"  class=\"wp-caption module image alignright\" style=\"max-width: 270px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-28695 \" title=\"Duran, Dianna\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2011\/04\/Duran-Dianna.jpg\" alt=\"Secretary of State Dianna Duran\" width=\"270\" height=\"249\" \/><\/a><p class=\"wp-caption-text\">Secretary of State Dianna Duran<\/p><\/div>\n<p>Following the advice of the attorney general, Secretary of State <a href=\"http:\/\/www.sos.state.nm.us\/sos-SecBio.html\" target=\"_blank\">Dianna Duran<\/a> today certified the candidacies of at least a dozen hopefuls who improperly left the number of the district or division they\u2019re seeking off their nominating petitions.<\/p>\n<p>Duran\u2019s decision came after Assistant Attorney General Tania Maestas sent her a letter Friday <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/03\/ag-candidates-should-survive-petition-snafu\/\" target=\"_blank\">advising that,<\/a> \u201cIn the absence of any evidence of fraud or bad faith, it is unlikely that a court would require strict adherence to the statutory requirements at the cost of denying a significant number of voters their constitutional right to participate in the election process.\u201d<\/p>\n<p>You can read the full letter <a href=\"http:\/\/nmpolitics.net\/Documents\/03.23.12.AGonPetitions.pdf\" target=\"_blank\">here<\/a>.<\/p>\n<p>At least 12 candidates who filed to run in the June 5 primary <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/03\/another-lawmaker-drops-out-more-could-be-kicked-off-ballot\/\" target=\"_blank\">failed to comply<\/a> with a new law that requires that district or division numbers be listed on their nominating petitions. They include, according to Duran:<\/p>\n<ul>\n<li>Sen.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SCAMP\" target=\"_blank\">Pete Campos<\/a>, D-Las Vegas, whose candidacy has been challenged by primary opponent\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HGART\" target=\"_blank\">Thomas Garcia<\/a>\u00a0of Ocate.<\/li>\n<li>Rep.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HLITT\" target=\"_blank\">Rick Little<\/a>, R-Chaparral.<\/li>\n<p><!--more--><\/p>\n<li>Sen.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SBEFF\" target=\"_blank\">Sue Wilson Beffort<\/a>, R-Sandia Park.<\/li>\n<li>Senate President Pro Tem\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SJENT\" target=\"_blank\">Tim Jennings<\/a>, D-Roswell.<\/li>\n<li>Rep.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HHAMI\" target=\"_blank\">Dianne Hamilton<\/a>, R-Silver City.<\/li>\n<li>Rep.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HMADA\" target=\"_blank\">James Roger Madalena<\/a>, D-Jemez Pueblo.<\/li>\n<li>Rep.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HMARR\" target=\"_blank\">Rodolpho Martinez<\/a>, D-Bayard.<\/li>\n<li>Democrat Guadalupe Cano, who is running for the seat Hamilton now holds.<\/li>\n<li>Democrat Joshua Madalena of Jemez Pueblo, who is running against Sen.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SLOVE\" target=\"_blank\">Lynda Lovejoy<\/a>, D-Crownpoint.<\/li>\n<li>Democrat Louis Luna of Deming, who is running against Rep.\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HIRWI\" target=\"_blank\">Dona Irwin<\/a>, D-Deming.<\/li>\n<li>Public Education Commissioner Vince Bergman, a Republican.<\/li>\n<li>Democrat Karen Montoya, who is running for the District 1 seat on the Public Regulation Commission.<\/li>\n<\/ul>\n<p>NMPolitics.net has learned that Virginia Vigil, a Democrat seeking the District 3 seat on the PRC, and Mark D&#8217;Antonio, the Democrat running for district attorney in Do\u00f1a Ana County\u2019s Third Judicial District, also left the numbers off their petitions.<\/p>\n<div id=\"attachment_23452\"  class=\"wp-caption module image alignright\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-23452\" title=\"Garcia, Thomas\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/11\/Garcia-Thomas.jpg\" alt=\"Thomas Garcia\" width=\"120\" height=\"160\" \/><\/a><p class=\"wp-caption-text\">Thomas Garcia<\/p><\/div>\n<h3>Let the lawsuits commence<\/h3>\n<p>Garcia plans to sue to challenge Campos\u2019 candidacy, according to <a href=\"http:\/\/www.capitolreportnewmexico.com\/?p=8859\" target=\"_blank\">Capital Report New Mexico<\/a>.<\/p>\n<p>\u201cEverybody was playing by the same rules and everybody else complied,\u201d the news website quoted Garcia as saying. \u201cThe rules were clear \u2026\u00a012 out of 250 (candidates for statewide office) didn\u2019t follow the correct rules.
