{"id":37433,"date":"2012-03-01T06:43:16","date_gmt":"2012-03-01T13:43:16","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=37433"},"modified":"2012-03-01T10:14:09","modified_gmt":"2012-03-01T17:14:09","slug":"republicans-still-win-house-redistricting-battle","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2012\/03\/republicans-still-win-house-redistricting-battle\/","title":{"rendered":"Republicans still win House redistricting battle"},"content":{"rendered":"<div id=\"attachment_35606\"  class=\"wp-caption module image alignnone\" style=\"max-width: 600px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-35606\" title=\"Roundhouse\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2012\/01\/Roundhouse.jpg\" alt=\"The Roundhouse in Santa Fe\" width=\"600\" height=\"322\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2012\/01\/Roundhouse.jpg 600w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2012\/01\/Roundhouse-336x180.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2012\/01\/Roundhouse-300x161.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p class=\"wp-caption-text\">The Roundhouse in Santa Fe (Photo by Heath Haussamen)<\/p><\/div>\n<h4>While the new map isn\u2019t as GOP leaning as the map Judge James Hall initially approved, it\u2019s much better for Republicans than the plan the Democratic-controlled Legislature approved.<\/h4>\n<p>The best anecdotal evidence of which political party benefits most from the House redistricting map finalized Wednesday is Republican Rep. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HJAME\" target=\"_blank\">Conrad James\u2019<\/a> decision to defend a contested House seat rather than run for an open Senate seat and Democratic Rep. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HONEI\" target=\"_blank\">Bill O\u2019Neill\u2019s<\/a> decision to do the opposite.<\/p>\n<p>Though there\u2019s no certainty it will happen, the new map gives Republicans a fighting chance of taking control of the House sometime in the next decade. Faced with that possibility, James is staying to <a href=\"http:\/\/www.capitolreportnewmexico.com\/?p=8476\" target=\"_blank\">fight it out<\/a> rather than becoming the likely anointed candidate for a relatively safe Republican Senate seat.<!--more--><\/p>\n<p>O\u2019Neill, on the other hand, decided to risk <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/open-government-champion-retiring-from-senate\/\" target=\"_blank\">a tough Senate primary<\/a> rather than a tough House general election. Either way he would face the possibility of losing, but in the Senate he\u2019s much more likely to be serving with a Democratic majority if he wins.<\/p>\n<p>Here are some numbers to illustrate the point:<\/p>\n<ul>\n<li>At the end of the last decade, the makeup of the House included 32 districts out of 70 with a political performance measure of 50 percent or more Republican. Some 36 districts had a GOP performance measure of 48 percent or better.<\/li>\n<li>The new map still has 32 districts with a GOP performance measure of 50 percent or better, but 37 districts with a GOP performance measure of 48 percent or better.<\/li>\n<li>More telling is an analysis of districts former President George W. Bush won during his 2004 re-election campaign. The previous map had 36 districts won by Bush; the new map has 39.<\/li>\n<\/ul>\n<p>You can view the new map <a href=\"http:\/\/www.nmlegis.gov\/Sessions\/11Redistricting\/199999\/HD_District_Court_1_Packet.pdf\" target=\"_blank\">here<\/a> and read about it being finalized <a href=\"http:\/\/www.therepublic.com\/view\/story\/0677aa59d4e149d98712e3c270192c09\/NM--House-Redistricting\/\" target=\"_blank\">here<\/a>.<\/p>\n<p>While the new map isn\u2019t as GOP leaning as the map Judge James Hall initially approved \u2013 which is one reason Democrats chose not to appeal this final map \u2013 it\u2019s much better for Republicans than the plan the Democratic-controlled Legislature approved.<\/p>\n<p>The Legislature\u2019s map had 30 districts with a GOP performance measure of 50 percent or better and 33 with a GOP performance measure of 48 percent or better. Some 36 districts in the map the Legislature approved were won by Bush in 2004.<\/p>\n<h3>Analysis is all over the place<\/h3>\n<p>What\u2019s interesting is that analysis of the map was all over the place leading up to the decision by both sides to accept it. A reporter for several New Mexico newspapers quoted Majority Leader <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HMART\" target=\"_blank\">Ken Martinez<\/a>, D-Grants, as saying Hall <a href=\"http:\/\/elpasotimes.typepad.com\/newmexico\/2012\/02\/new-redistricting-plan-likely-to-fly.html\" target=\"_blank\">\u201cdid a really good job\u201d<\/a> and produced a \u201cvery fair\u201d plan.<\/p>\n<p>In that same article, Minority Leader <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HTAYT\" target=\"_blank\">Tom Taylor<\/a>, R-Farmington, complained that the map \u201cis negative for us\u201d and \u201cdoesn\u2019t maintain our presence in the House.\u201d<\/p>\n<p>On the other hand, Republican Gov. <a href=\"http:\/\/governor.state.nm.us\" target=\"_blank\">Susana Martinez\u2019s<\/a> office praised the map in <a href=\"http:\/\/www.capitolreportnewmexico.com\/?p=8426\" target=\"_blank\">a statement<\/a> to Capitol Report New Mexico, saying it \u201cequalizes population and gives the voters on Albuquerque\u2019s west side and Rio Rancho the representation they deserve.\u201d<\/p>\n<p>And House Speaker <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HLUJA\" target=\"_blank\">Ben Luj\u00e1n<\/a>, D-Nambe, complained that Hall made \u201cvery miniscule changes\u201d from his earlier map Democrats appealed and the Supreme Court directed Hall to redraw.<\/p>\n<h3>The reality<\/h3>\n<p>Rep. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HEGOL\" target=\"_blank\">Brian Egolf<\/a>, D-Santa Fe, who <a href=\"http:\/\/www.santafenewmexican.com\/Local%20News\/House-district-plan-shifts-Eldorado\" target=\"_blank\">loses the Eldorado subdivision<\/a> from his district in the new map, pointed to reality on Twitter.<\/p>\n<p>\u201cIt\u2019s the governor\u2019s map with a few tweaks,\u201d <a href=\"https:\/\/twitter.com\/#!\/BrianEgolf\/status\/174346215515885569\" target=\"_blank\">he tweeted<\/a>.<\/p>\n<p>That\u2019s exactly right. Hall chose to go with Martinez\u2019s map initially because it shifted the advantage to Republicans less than the Legislature\u2019s map shifted the advantage to Democrats. In other words, <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/01\/judge%E2%80%99s-ruling-means-a-more-competitive-n-m-house\/\" target=\"_blank\">he viewed it as less partisan<\/a>.<\/p>\n<p>The N.M. Supreme Court told him to <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/high-court-rejects-house-redistricting-plan-guv-to-appeal\/\" target=\"_blank\">go back to the drawing board<\/a> and come up with a new map.<\/p>\n<p>Hall essentially rejected their order, instead making only minor tweaks to the Martinez-drawn map he had already approved. And he had some choice words for the Supreme Court.<\/p>\n<p>At one point, he wrote, \u201cwith all due respect\u2026 the Findings of Fact and Conclusions of law do not support\u201d the Supreme Court\u2019s interpretation of his initial map. At another point he criticized the Supreme Court for making a \u201cvery serious allegation\u201d that he didn\u2019t consider Hispanic citizen voting age. He explained why the Supreme Court was wrong and wrote that its \u201comission\u201d of the facts was important because its order would become a permanent part of N.M. law.<\/p>\n<p>In other words, a Democratic judge stood up to the Democratic-controlled Supreme Court for telling him to come up with a new map instead of picking the Republican map that was less partisan than the Democratic map. Faced with that internal political battle \u2013 and with a panel of federal judges that included two Republicans and one Democrat watching \u2013 what more could Democrats do?<\/p>\n<p>Hall tweaked the map a bit to make it slightly less Republican-leaning than the map he initially approved.<\/p>\n<p>So Democrats get a slight victory. And Republicans get a big victory.<\/p>\n<p>Democrats were already worried about maintaining their 36-33-1 majority in the House \u2013 the slimmest majority they\u2019ve had in decades.
