{"id":36723,"date":"2012-02-14T11:46:00","date_gmt":"2012-02-14T18:46:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=36723"},"modified":"2012-02-14T17:39:47","modified_gmt":"2012-02-15T00:39:47","slug":"prc-reforms-clear-key-committee","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2012\/02\/prc-reforms-clear-key-committee\/","title":{"rendered":"PRC reforms clear key committee"},"content":{"rendered":"<div id=\"attachment_29180\"  class=\"wp-caption module image alignright\" style=\"max-width: 300px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-29180 \" title=\"Roundhouse\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2011\/05\/Roundhouse.jpg\" alt=\"The Roundhouse in Santa Fe (Photo by Peter St. Cyr)\" width=\"300\" height=\"243\" \/><\/a><p class=\"wp-caption-text\">The Roundhouse in Santa Fe (Photo by Peter St. Cyr)<\/p><\/div>\n<h4>Both resolutions still need approval from one committee and the full Senate, in addition to House concurrence on changes.<\/h4>\n<p>Efforts to streamline and improve the embattled Public Regulation Commission cleared a major hurdle this morning as the Senate Rules Committee approved two proposed\u00a0constitutional\u00a0amendments that\u00a0would relieve the commission of insurance regulation duties and ask the Legislature to establish qualifications for commissioners.<\/p>\n<p>On a vote of 6-1, with Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SBURT\" target=\"_blank\">William Burt<\/a>, R-Alamogordo in opposition, the Rules Committee approved <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=11&amp;year=12\" target=\"_blank\">House Joint Resolution 11<\/a>, which would ask voters whether to grant the Legislature the authority to set required qualifications for commissioners. Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SMUNO\" target=\"_blank\">George Mu\u00f1oz<\/a>, D-Gallup, was the lone dissenter on a 7-1 vote for <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=17&amp;year=12\" target=\"_blank\">HJR 17<\/a>, which would move the insurance regulation office out from under the supervision of the PRC to make it a separate, independent agency.<\/p>\n<p>Though he had previously\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/prc-reform-may-hit-snag-in-senate\/\" target=\"_blank\">expressed\u00a0skepticism<\/a>\u00a0about both pieces of legislation, Majority Leader <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SSANC\" target=\"_blank\">Michael Sanchez<\/a>, D-Belen, voted for them today.<\/p>\n<p>Both resolutions now head to the Senate Judiciary Committee &#8212; of which Sanchez is a member &#8212; and must also receive the backing of the full Senate, in addition to House concurrence on changes. If that happens, both proposals to amend the N.M. Constitution will be asked of voters in November.<\/p>\n<h3><strong>Marks says moving insurance regulation won&#8217;t cost more<\/strong><\/h3>\n<p>PRC Commissioner <a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/jasonmarks\/index.html\" target=\"_blank\">Jason Marks<\/a> joined sponsor <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HSAAV\" target=\"_blank\">Kiki Saavedra<\/a>, D-Albuquerque, to present\u00a0HJR 17\u00a0to the committee.<\/p>\n<p>\u201cI think this will definitely improve the PRC,\u201d Marks said.\u00a0\u201cThe No. 1 reason to do this is to provide the commissioners and our staff with the ability to focus on\u2026 the other things we do. I believe this will improve and enhance insurance as well.\u201d<!--more--><\/p>\n<p>Advocates of reform at the agency, including <a href=\"http:\/\/www.thinknewmexico.org\/homepage.html\" target=\"_blank\">Think New Mexico<\/a>, have said the PRC\u2019s mandate is too broad, and insurance oversight would be better handled by an independent agency.<\/p>\n<p>Marks survived a grilling by Mu\u00f1oz and Sanchez, who asked Marks to promise that the PRC would not come back for more money if the Insurance Division \u2014 and about 100 full-time employees &#8212; were moved out of the agency.<\/p>\n<p>\u201cYou\u2019re telling us you\u2019re not going to come back to us for more money? You\u2019re giving us your word it\u2019s not going to happen and Mr. Franchini, the superintendent of insurance, is going to be satisfied with what you say?\u201d Sanchez asked Marks.<\/p>\n<p>Marks promised.<\/p>\n<p>\u201cI give you my word, but, uh, fortunately for me, at least, I\u2019m term-limited,\u201d Marks said to chuckles.<\/p>\n<p>\u201cThe PRC\u2026 we have some black marks on our history, but one thing we\u2019ve been good at is fiscal management,\u201d he said, adding that the agency has reverted money to the general fund and not furloughed employees in recent years.\u00a0Marks referred to a PRC financial analysis of the move, which <a href=\"http:\/\/www.docstoc.com\/docs\/113206807\/PRC-analysis-of-insurance-move\" target=\"_blank\">you can see here<\/a>.<\/p>\n<p>Although the original proposal specified that the superintendent of insurance would be chosen from a pool of candidates submitted to the governor, Democrats amended the bill to give the Legislature the power to decide how the nominating committee will be created.<\/p>\n<p>\u201cI\u2019m not against the (proposal). This isn\u2019t a bad change\u2026 but there\u2019s going to be a cost, and it\u2019s going to be more expensive at some point in time, and the people have a right to know,\u201d Sanchez said.<\/p>\n<h3><strong>Concerns about implementing qualifications linger<\/strong><\/h3>\n<p>As NMPolitics.net\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/becenti-aguilar-opposes-prc-reform-bills-as-clock-ticks\/\" target=\"_blank\">reported Monday<\/a>, Commissioner <a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/theresabecentiaguilar\/index.html\" target=\"_blank\">Theresa Becenti-Aguilar<\/a> has been a harsh critic of PRC reform proposals. She voiced her concern about implementing qualifications for PRC members to the Rules Committee today while that resolution, sponsored by <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HCERV\" target=\"_blank\">Joseph Cervantes<\/a>, D-Las Cruces, was being discussed.<\/p>\n<p>\u201cI think it\u2019s very important that we take a closer look at this particular bill because it represents minorities throughout the state,\u201d Becenti-Aguilar said. \u201cThe proponents\u2026did they reach far enough? Did they consult with one Indian tribe in New Mexico? \u2026 To my knowledget hey have not done so.\u201d<\/p>\n<p>Sanchez echoed her concerns with a stern rebuke to Think New Mexico, saying, \u201cI\u2019m very concerned about how this was done and the people who\u2026 weren\u2019t in the loop. \u2026 If Think New Mexico is <em>thinking,<\/em> they might want to think about other people.\u201d<\/p>\n<p>Becenti-Aguliar&#8217;s concern has not been shared by Native American lawmakers who voted for the proposals in the House, or by other advocates for Native groups.
