{"id":36551,"date":"2012-02-11T20:13:54","date_gmt":"2012-02-12T03:13:54","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=36551"},"modified":"2012-02-13T05:44:43","modified_gmt":"2012-02-13T12:44:43","slug":"one-prc-reform-bill-advances","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2012\/02\/one-prc-reform-bill-advances\/","title":{"rendered":"One PRC reform bill advances"},"content":{"rendered":"<div id=\"attachment_27688\"  class=\"wp-caption module image alignright\" style=\"max-width: 270px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-27688 \" title=\"Roundhouse\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2011\/03\/Roundhouse1.jpeg\" alt=\"The Roundhouse in Santa Fe (Photo by Peter St. Cyr)\" width=\"270\" height=\"219\" \/><\/a><p class=\"wp-caption-text\">The Roundhouse in Santa Fe (Photo by Peter St. Cyr)<\/p><\/div>\n<h4>The legislation, which would let voters decide whether to move the Corporations Division to the Secretary of State&#8217;s Office, must still pass another committee and win the approval of the full Senate.<\/h4>\n<p>A proposal to move the <a href=\"http:\/\/www.nmprc.state.nm.us\/corporations\/index.html\" target=\"_blank\">Corporations Division<\/a> of the Public Regulation Commission to the Secretary of State&#8217;s office passed the <a href=\"http:\/\/www.nmlegis.gov\/lcs\/committeedisplay.aspx?CommitteeCode=SRC\" target=\"_blank\">Senate Rules Committee<\/a>\u00a0today by a unanimous vote.<\/p>\n<p>The Secretary of State&#8217;s Office supported the measure (<a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=16&amp;year=12\" target=\"_blank\">HJR 16<\/a>), which is perceived by many to be the least controversial of the three pieces of reform being pushed by <a href=\"http:\/\/thinknewmexico.org\/\" target=\"_blank\">Think New Mexico<\/a>.<\/p>\n<p>It must now pass the <a href=\"http:\/\/www.nmlegis.gov\/lcs\/committeedisplay.aspx?CommitteeCode=SJC\" target=\"_blank\">Judiciary Committee<\/a> before it can be heard on the Senate floor. Senate passage of the joint resolution would mean a constitutional amendment would appear on the ballot in the November general election. The Legislature would have the opportunity to decide the final details during the 2013 session.<\/p>\n<p>The Corporations Division issues certificates of incorporation, handles the registration of limited liability companies (LLCs) and processes charter documents. PRC Member\u00a0<a href=\"http:\/\/www.nmprc.state.nm.us\/commissioners\/jasonmarks\/index.html\" target=\"_blank\">Jason Marks<\/a>,\u00a0an Albuquerque Democrat who helped present the bill to the Rules Committee, said 16 full-time employees of the division \u2014 and their budget \u2014 would be transferred to the Secretary of State&#8217;s office, where the <a href=\"http:\/\/www.sos.state.nm.us\/sos-business.html\" target=\"_blank\">Business Services<\/a> office already processes limited liability partnerships (LLPs).<\/p>\n<p>Proponents say the move would be budget-neutral. In an interview after the meeting, Secretary of State <a href=\"http:\/\/www.sos.state.nm.us\/sos-SecBio.html\" target=\"_blank\">Dianna Duran<\/a> said she&#8217;s in the process of evaluating how the Corporations Division could be integrated into her office.<!--more--><\/p>\n<p>Rules Committee Chair <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SLOPE\" target=\"_blank\">Linda Lopez<\/a>, D-Albuquerque, said the other PRC reform bills, <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=11&amp;year=12\" target=\"_blank\">HJR 11<\/a> and <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=17&amp;year=12\" target=\"_blank\">HJR 17<\/a>, could be heard in the committee on Sunday.<\/p>\n<h3>Unanimous vote, unanimous support<\/h3>\n<p>In introducing the bill, which is\u00a0sponsored by House Minority Leader\u00a0<a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HTAYT\" target=\"_blank\">Tom Taylor<\/a>, R-Farmington, Marks said he has learned during his tenure at the PRC that the agency has &#8220;too broad a scope.&#8221; He got laughs from the room when he said the agency regulates things &#8220;from soup to nuts,&#8221; including utilities, insurance, taxi cabs and even ski areas.<\/p>\n<p>Commissioner <a href=\"http:\/\/www.nmprc.state.nm.us\/commissioners\/doug-howe\/index.html\" target=\"_blank\">Doug Howe<\/a>\u00a0stood up to support the measure, and Think NM&#8217;s Fred Nathan said Commissioner <a href=\"http:\/\/www.nmprc.state.nm.us\/commissioners\/patricklyons\/index.html\" target=\"_blank\">Pat Lyons<\/a> had also signed on to the idea.<\/p>\n<p>The measure also had strong support in the committee meeting as business groups and current and former PRC officials spoke in favor; no one voiced opposition to the proposal, although several members of the committee asked pointed questions.<\/p>\n<p>Senate Majority Leader <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SSANC\" target=\"_blank\">Michael Sanchez<\/a>, D-Belen and a member of the Rules and Judiciary committees, has said he doesn&#8217;t think the 30-day session is long enough <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/prc-reform-may-hit-snag-in-senate\/\" target=\"_blank\">to fully consider PRC reform<\/a>.
