All that stands in the way of voters getting the chance to implement it is Senate Majority Leader Michael Sanchez.<\/h4>\n<p>I literally laughed out loud when I read this quote from Senate Majority Leader <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SSANC\" target=\"_blank\">Michael Sanchez<\/a> the other day:<\/p>\n<p>\u201cDo you honestly believe that if you have a degree you can\u2019t mess up?\u201d he asked NMPolitics.net\u2019s Gwyneth Doland.<\/p>\n<p>Sanchez was explaining to Doland his skepticism that increased qualifications for <a href=\"http:\/\/nmprc.state.nm.us\" target=\"_blank\">Public Regulation Commission<\/a> members would help clean up the scandal-plagued agency. Doland later <a href=\"http:\/\/www.nmpolitics.net\/index\/2012\/02\/prc-reform-may-hit-snag-in-senate\/\" target=\"_blank\">broke the news<\/a> that Sanchez\u2019s stance might doom three proposed constitutional amendments to reform the PRC in the current legislative session.<\/p>\n<p>The quote made me laugh because, while a degree obviously doesn\u2019t mean someone won\u2019t \u201cmess up,\u201d a legislative subcommittee Sanchez co-chaired in 2002 studied the issue and recommended \u2013 you guessed it \u2013 increasing qualifications for PRC members.<\/p>\n<p>\u201cThe members agreed that defining qualifications in law is important to ensure that commissioners have the background and experience necessary to understand the complex issues involved in decisions that impact the business and citizens of New Mexico,\u201d that committee\u2019s report states. Read the executive summary <a href=\"http:\/\/nmpolitics.net\/Documents\/2002PRCReportExecSummary.pdf\" target=\"_blank\">here<\/a>.<\/p>\n<p>Sanchez is now saying that 2002 report was intended to suggest options the Legislature could consider, <a href=\"http:\/\/www.abqjournal.com\/main\/2012\/02\/09\/politics\/3-measures-to-reform-prc-hit-snag-in-senate.html\" target=\"_blank\">not to endorse any specific idea<\/a>.<\/p>\n<p>Wrong! The report makes clear what the committee wanted:<\/p>\n<ul>\n<li>Though it didn\u2019t endorse any specific proposals, the committee made clear that it thought commissioners needed to be better qualified: \u201cThis would include debate on whether commissioners should be appointed or elected, and would address the need for qualifications to ensure that commissioners have the background and experience necessary to understand complex regulatory issues,\u201d the report states.<\/li>\n<li>An independent insurance office: \u201cThe regulation of insurance should be elevated from its current status as a division of the PRC to an independent department of insurance.\u201d<\/li>\n<li>Moving corporate functions: \u201cThe responsibilities for corporations should be transferred to the secretary of state to consolidate commerce and industry documentation and records and create a more efficient system for business transactions in New Mexico.\u201d<\/li>\n<\/ul>\n<h3>Saying you did something without doing anything<\/h3>\n<p><!--more--><\/p>\n<p>The report sat on a shelf for 10 years. It was the ultimate example of being able to say you did something without actually doing anything. Meanwhile, the PRC grew into one of the most scandal-plagued government agencies in New Mexico \u2013 one that has seen two elected officials forced from office because of felony convictions in recent years.<\/p>\n<p>Now <a href=\"http:\/\/www.thinknewmexico.org\/homepage.html\" target=\"_blank\">Think New Mexico<\/a> proposes the same three ideas I highlighted from that 2002 report as constitutional amendments (Rep. Joseph Cervantes\u2019 <a href=\"http:\/\/www.nmlegis.gov\/Sessions\/12%20Regular\/resolutions\/house\/HJR11VES.html\" target=\"_blank\">HJR 11<\/a>, House Minority Leader Tom Taylor\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=16&amp;year=12\" target=\"_blank\">HJR 16<\/a>, and Rep. Kiki Saavedra\u2019s <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=H&amp;LegType=JR&amp;LegNo=17&amp;year=12\" target=\"_blank\">HJR 17<\/a>). All three have passed the House unanimously.<\/p>\n<p>But Sanchez told Doland he didn\u2019t recall the 2002 report (he later read it and made the comments about it to other media), and he thinks lawmakers need to look at PRC reform \u201cmore carefully than in a 30-day session.\u201d<\/p>\n<p>In other words, he wants the Legislature to go back and redo the very thing it \u2013 and he \u2013 did a decade ago. Ten years and scandal after scandal after scandal after scandal later, he wants to start over again.<\/p>\n<p>That\u2019s outrageous. It\u2019s preposterous. It\u2019s laughable.<\/p>\n<h3>The importance of qualifications<\/h3>\n<p>The majority leader\u2019s skepticism about increasing qualifications is common among anti-reformers and is shared by Republican Commissioner <a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/benhall\/index.html\" target=\"_blank\">Ben Hall<\/a>. The fact that Sanchez and Hall, who has had his own problems (<a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/08\/the-prc-needs-more-public-scrutiny-not-less\/\" target=\"_blank\">here<\/a> and <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/10\/prc%E2%80%99s-hall-being-sued-allegedly-didn%E2%80%99t-repay-54k-loan\/\" target=\"_blank\">here<\/a>), share skepticism about anything makes me chuckle.<\/p>\n<p>Sanchez\u2019s position is also laughable because he has been at the forefront of questioning whether Hanna Skandera should be confirmed as public education secretary, saying because she has never been a teacher she may not meet the constitutional requirement of <a href=\"http:\/\/www.capitolreportnewmexico.com\/?p=8011\" target=\"_blank\">being a \u201cqualified, experienced educator.\u201d<\/a> Does he think government officials should be required to meet certain qualifications or not?<\/p>\n<p>Finally, the answer to the underlying question \u2013 would having better-qualified commissioners help our scandal-plagued PRC \u2013 seems obvious to me.<\/p>\n<p>\u201cDuh.\u201d<\/p>\n<p>The PRC regulates all sort of complicated industries. It\u2019s arguably the most powerful regulatory board of its kind in any state in America. We ask commissioners to approve potentially lucrative regulatory changes. They make those decisions in part based lots of technical information tossed at them by companies that stand to profit, and who may also be wining and dining them and financing their campaigns.<\/p>\n<p>In other words, make friends with the guy who has a vote but doesn\u2019t know what he\u2019s doing. He won\u2019t understand what you\u2019re asking him for, but if you\u2019re his friend he\u2019ll trust you and do what you ask.<\/p>\n<p>It would help to have people on the commission who have the knowledge, experience or educational background that comes from having a college degree or five years of relevant experience, as Cervantes has proposed and members of the House unanimously agreed was a good idea. It would help to have people who have shown the discipline to earn that degree or experience on the commission.<\/p>\n<p>Of course that doesn\u2019t mean that those who have degrees \u201ccan\u2019t mess up.\u201d Sanchez\u2019s question deflects attention from the real issue. For technical jobs like these, having some basic qualifications would help in the same way that being a lawyer helps the attorney general do his job (we do require that our AG be a lawyer).<\/p>\n<h3>Michael Sanchez stands in the way<\/h3>\n<p>The reality is that the PRC is the ultimate mid-ballot race that gets no attention. Voters tend to know who\u2019s running for president, governor, and maybe U.S. Senate and House. Many know their local county commission and legislative candidates. In between are races for seats on a regulatory board no one notices.<\/p>\n<p>That\u2019s <a href=\"http:\/\/www.nmpolitics.net\/index\/2008\/10\/block-has-no-business-being-elected-to-the-prc\/\" target=\"_blank\">why Jerome Block Jr. got elected<\/a> even though anyone who was paying attention should have known he had probably committed felony crimes before they voted for him. As I\u2019ve written, inattention was also a big factor in <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/08\/the-prc-needs-more-public-scrutiny-not-less\/\" target=\"_blank\">Hall\u2019s 2010 victory<\/a>.<\/p>\n<p>Voters <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/10\/an-excerpt-from-%E2%80%98rethinking-the-prc%E2%80%99\/\" target=\"_blank\">agreed in 1996<\/a> to create an uber-powerful regulatory board but have since given little thought to what it is or does. Largely because voters aren\u2019t acting as a watchdog, other structural reforms must be put in place to help the PRC function better. Hence, the proposed constitutional amendments.<\/p>\n<p>Voters only get that chance to implement such reforms if the Legislature gives it to them.
