Constitution to require increased qualifications for commissioners (<a href=\"http:\/\/www.nmlegis.gov\/Sessions\/12%20Regular\/resolutions\/house\/HJR11VES.html\" target=\"_blank\">HJR 11<\/a>), move corporation responsibilities to the Secretary of State\u2019s Office (<a href=\"http:\/\/www.nmlegis.gov\/Sessions\/12%20Regular\/resolutions\/house\/HJR16.html\" target=\"_blank\">HJR 16<\/a>) and create an independent superintendent of insurance (<a href=\"http:\/\/www.nmlegis.gov\/Sessions\/12%20Regular\/resolutions\/house\/HJR17.html\" target=\"_blank\">HJR 17<\/a>). Joseph Cervantes<\/p><\/div>\n<p>Sanchez gave the issue a pretty close look in 2002, when he <a href=\"http:\/\/www.nmlegis.gov\/lcs\/_session.aspx?Chamber=S&amp;LegType=JM&amp;LegNo=41&amp;year=01\" target=\"_blank\">co-chaired a committee<\/a>\u00a0that examined PRC reform and made two particular recommendations: creating an independent department of insurance and moving corporation functions to the Secretary of State\u2019s Office.<\/p>\n<p>Asked about the 10-year-old report, Sanchez said he didn\u2019t recall it.<\/p>\n<p>But the House sponsor of one of the proposals is insistant that the time is ripe for reform.<\/p>\n<p>\u201cWe need to do this now,\u201d Rep. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=HCERV\" target=\"_blank\">Joseph Cervantes<\/a>, D-Las Cruces, said Tuesday. \u201cThe PRC has been a continuing source of a lack of public confidence. Linda Lopez<\/p><\/div>\n<p>Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SLOPE\" target=\"_blank\">Linda Lopez<\/a>, D-Albuquerque, has agreed to present the proposals in the Senate, but first they need to make it through the powerful Rules Committee, which she chairs.<\/p>\n<p>\u201c\u2026With all the difficulties that we\u2019ve had with the PRC over the last several years\u2026 it is time for us to look at it and see what we can do. \u2026 I do believe something can come out of the Senate this time,\u201d Lopez said (See more in the video).<\/p>\n<p>Lopez said she\u2019ll schedule the proposals as soon as her committee has finished looking at Senate bills, which will probably be this weekend.<\/p>\n<p>The session ends at noon on Feb. 16.<\/p>\n<h3><strong>Sanchez skeptical that increased qualifications will help<\/strong><\/h3>\n<p>The majority leader, an attorney by trade, said he isn\u2019t sure that increasing qualifications for commissioners would guarantee better candidates.<!--more--><\/p>\n<p>\u201cDo you honestly believe that if you have a degree you can\u2019t mess up?\u201d Sanchez asked.<\/p>\n<p>Messing up has been too common for elected PRC members, whose only required qualifications are being at least 18 years old, residents of New Mexico for at least a year and not having any felony convictions.<\/p>\n<p>In the past five years, two commissioners have been convicted of felony crimes and forced to leave office. Another had a civil jury rule against him in a sexual harassment lawsuit, and the state was forced to pay $840,000 to the woman.<\/p>\n<p>The job requires oversight of utilities, telecommunications, insurance, transportation and oil and gas pipelines, among other things. But according to Think New Mexico, 44 percent of commissioners have lacked college degrees \u2014 compared to an average of 11 percent of those who hold similar positions in other states.<\/p>\n<p>Cervantes, who sponsored the House proposal to increase commissioners\u2019 qualifications, said now is the time to move on reform.<\/p>\n<p>\u201cThere\u2019s really no reason for us to delay any further in trying to establish some minimum requirements for PRC commissioners,\u201d Cervantes said.<\/p>\n<h3>PRC has too much control over insurance, Leavell says<\/h3>\n<p>The PRC has too much control over the Insurance Division, said Sen. <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SLEAV\" target=\"_blank\">Carroll Leavell<\/a>, R-Jal, who ran his own insurance agency for nearly 40 years and is a member of the <a href=\"http:\/\/www.ncoil.org\/\" target=\"_blank\">National Conference of Insurance Legislators<\/a>.<\/p>\n<div  class=\"wp-caption module image alignright\" style=\"max-width: 270px;\"><object width=\"270\" height=\"167\" classid=\"clsid:d27cdb6e-ae6d-11cf-96b8-444553540000\" codebase=\"http:\/\/download.macromedia.com\/pub\/shockwave\/cabs\/flash\/swflash.cab#version=6,0,40,0\"><param name=\"allowFullScreen\" value=\"true\" \/><param name=\"allowscriptaccess\" value=\"always\" \/><param name=\"src\" value=\"http:\/\/www.youtube.com\/v\/5yHfjuK55v8?version=3&amp;hl=en_US&amp;rel=0\" \/><param name=\"allowfullscreen\" value=\"true\" \/><embed width=\"270\" height=\"167\" type=\"application\/x-shockwave-flash\" src=\"http:\/\/www.youtube.com\/v\/5yHfjuK55v8?version=3&amp;hl=en_US&amp;rel=0\" allowFullScreen=\"true\" allowscriptaccess=\"always\" allowfullscreen=\"true\" \/><\/object><p class=\"wp-caption-text\">Sen. Carroll Leavell<\/p><\/div>\n<p>\u201cMoving it, in my opinion, will free the superintendent of insurance up to manage that department the way it should be,\u201d Leavell said. \u201cThere have been too many problems over the past 16 years that I\u2019ve watched that department&#8230;\u201d<\/p>\n<p>Leavell also noted support from within the organization; three of the five current PRC members &#8212; Republican <a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/patricklyons\/index.html\" target=\"_blank\">Pat Lyons<\/a>\u00a0and\u00a0Democrats\u00a0<a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/jasonmarks\/index.html\" target=\"_blank\">Jason Marks<\/a> and\u00a0<a href=\"http:\/\/nmprc.state.nm.us\/commissioners\/doug-howe\/index.html\" target=\"_blank\">Doug Howe<\/a> &#8212; have all said they\u2019re in favor of the reform proposals.<\/p>\n<p>But moving insurance regulation to the executive branch, and hypothetically giving the governor more control over it, is a concern, said Sanchez, who is famously protective of the Senate\u2019s powers.<\/p>\n<p><em>A prior version of this posting identified Howe as an independent, which was his status when he was appointed to the PRC. But he recently switched to Democrat.
