Public funds paid for boosters to attend, which Balderas says appears to violate the anti-donation clause in the N.M. Constitution. The university illegally hid the use of public money for the boosters\u2019 travel from the media. State Auditor Tim Keller is conducting <a href=\"https:\/\/www.abqjournal.com\/1011840\/state-auditor-expands-probe-into-unm-athletics-spending-fundraising.html\" target=\"_blank\" rel=\"noopener noreferrer\">a wide-ranging special audit of UNM athletics<\/a>.<\/p>\n<p>The university says an anonymous donor has given the UNM Foundation, its nonprofit fundraising arm, $25,000 to cover the inappropriate use of public money.<\/p>\n<p>That anonymity is concerning. A secret donor is helping UNM whitewash a gross misuse of public dollars.<\/p>\n<p>These aren\u2019t new issues. I raised questions a decade ago about the New Mexico State University Foundation <a href=\"http:\/\/nmpolitics.net\/index\/2007\/05\/nmsu-steps-into-gray-area-by-letting-secret-donors-help-pay-salaries-of-president-and-basketball-coach\/\" target=\"_blank\" rel=\"noopener noreferrer\">keeping its donor list secret<\/a>. At the time, the foundation was supplementing the compensation of the university president and men\u2019s basketball coach with money from secret donors. Regents gave then-President Michael Martin a retention bonus of $100,000 \u2013 with 70 percent anonymously funded \u2013 and a $6,000-a-month housing allowance that was also anonymously funded.<\/p>\n<p>Here\u2019s the concern: University officials decide which businesses get contracts. They <a href=\"http:\/\/nmpolitics.net\/index\/2007\/02\/university-economic-development-gets-senate-ok\/\" target=\"_blank\" rel=\"noopener noreferrer\">engage in economic development<\/a> with the land they own. They can form partnerships <a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/getting-to-know-nms-first-college-of-osteopathic-medicine\/\" target=\"_blank\" rel=\"noopener noreferrer\">with medical schools<\/a> and others.<\/p>\n<p>Without sunshine, the potential for pay-to-play is immense. Give me that contract and I\u2019ll give you a raise.<\/p>\n<p>The issue became clear for me in 2007 when then-NMSU men\u2019s basketball coach Reggie Theus showed up at a Las Cruces City Council meeting to <a href=\"http:\/\/nmpolitics.net\/index\/2007\/06\/endorsement-of-developers-project-raises-further-questions-about-how-aggie-coach-is-being-paid\/\" target=\"_blank\" rel=\"noopener noreferrer\">endorse a developer\u2019s planned 6,000-acre project<\/a>. That came days after NMSU decided that Theus\u2019 contract would include $100,000 in compensation from an anonymous donor.<!--more--><\/p>\n<p>That developer later said he wasn\u2019t the donor helping <a href=\"http:\/\/nmpolitics.net\/index\/2007\/06\/developer-says-he-isnt-helping-pay-theus-and-martin\/\" target=\"_blank\" rel=\"noopener noreferrer\">compensate Martin and Theus<\/a>. But without formal disclosure, how would we know for certain?<\/p>\n<p>This battle for transparency is playing out <a href=\"http:\/\/www.splc.org\/article\/2015\/09\/shaking-the-foundation\" target=\"_blank\" rel=\"noopener noreferrer\">across the nation<\/a>. The Chicago Tribune, for example, has <a href=\"https:\/\/www.cjr.org\/united_states_project\/how_university_foundations_try_to_avoid_public_scrutiny_and_what_reporters_can_do.php\" target=\"_blank\" rel=\"noopener noreferrer\">gone after records<\/a> from the foundation that supports the College of DuPage in Illinois.<\/p>\n<p>Legally, the question of whether donor records are public comes down to the degree of separation between a university and its nonprofit foundation, in addition to a state\u2019s public records laws. In response to a complaint I filed in 2007, then-N.M. Attorney General Gary King\u2019s office said state law allows the NMSU Foundation to <a href=\"http:\/\/nmpolitics.net\/index\/2007\/11\/ag-says-nmsu-foundation-can-keep-donor-info-secret\/\" target=\"_blank\" rel=\"noopener noreferrer\">keep its donor list secret<\/a>, in addition to government officials\u2019 emails related to foundation business.<\/p>\n<p>Conveniently, King\u2019s wife served on the UNM Foundation Board of Directors <a href=\"https:\/\/www.unmfund.org\/wp-content\/uploads\/2013\/08\/unmf-rog-2006-2007.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">at the time<\/a>.<\/p>\n<p>UNM\u2019s foundation took in more than $36 million in donations <a href=\"https:\/\/www.unmfund.org\/wp-content\/uploads\/2013\/06\/990_FY2016-with-990-T-Public-Disclosure-Copy.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">in 2015<\/a>. NMSU\u2019s received more than $18 million <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/850170157\" target=\"_blank\" rel=\"noopener noreferrer\">in 2014<\/a>. Both often conceal the identities of donors who are funding public projects and salaries.<\/p>\n<p>That violates at least the spirit of the state\u2019s <a href=\"http:\/\/www.nmag.gov\/uploads\/files\/Publications\/ComplianceGuides\/Inspection%20of%20Public%20Records%20Compliance%20Guide%202015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Inspection of Public Records Act<\/a>. That law intends \u201cthat all persons are entitled to the greatest possible information regarding the affairs of government and the official acts of public officers and employees,\u201d which it calls \u201can essential function of a representative government.\u201d<\/p>\n<p>The state spends hundreds of millions of dollars each year on our public universities to give our children better opportunities and build a stronger economy.<\/p>\n<p>In recognition of the potential for government corruption, our political system requires that elected officials and candidates for office disclose their donors and spending.
