Susana Martinez&#8217;s <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/martinez-vetoes-tax-hikes-funding-for-higher-education-and-legislature\/\" target=\"_blank\" rel=\"noopener noreferrer\">March vetoes<\/a> of\u00a0funding for the state&#8217;s public colleges and universities and the Legislature for the fiscal year that begins July 1. Martinez also vetoed a bill that would have raised the tax on gasoline and other\u00a0taxes and fees to help balance the budget and put some money in reserves.<\/p>\n<p>There&#8217;s <a href=\"http:\/\/nmpolitics.net\/index\/2017\/05\/state-leaders-say-theyre-closer-to-a-deal-on-budget\/\" target=\"_blank\" rel=\"noopener noreferrer\">no certainty<\/a> policymakers will reach an agreement during the session. Martinez, a Republican, has said she wants the Senate to confirm her university regents appointees as part of a deal. Senate President Pro Tem Mary Kay Papen, D-Las Cruces, says <a href=\"http:\/\/krwg.org\/post\/papen-says-governors-appointments-can-wait\" target=\"_blank\" rel=\"noopener noreferrer\">that won&#8217;t happen<\/a> during the special session.<!--more--><\/p>\n<p>Martinez also says she wants approval of legislation to reform the state&#8217;s gross receipts tax. That proposal would eliminate some or all of the hundreds of exemptions to the tax, lower the overall rate, and possibly reduce some of the pyramiding in the tax code.<\/p>\n<p>But House Speaker Brian Egolf, D-Santa Fe, says the proposal is <a href=\"https:\/\/www.abqjournal.com\/1007608\/house-speaker-no-action-on-tax-overhaul-this-week.html\" target=\"_blank\" rel=\"noopener noreferrer\">dead on arrival<\/a> in the special session. Some Democratic lawmakers have said reform\u00a0is too complex to approve in a short session without much fiscal analysis or public input. The public hasn&#8217;t yet seen the proposed legislation.<\/p>\n<p>Democratic leaders say they&#8217;ll instead focus on restoring the funding Martinez vetoed. The higher education veto\u00a0has\u00a0put the state\u2019s colleges and universities in the difficult position of not being able to plan for the fiscal year that begins in a few weeks \u2014 and comes at a time when high-school seniors are deciding whether to attend college in state or out of state. Several <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/higher-education-must-receive-its-state-funding\/\" target=\"_blank\" rel=\"noopener noreferrer\">university presidents<\/a> and <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/student-body-presidents-decry-politics-plead-for-university-funding\/\" target=\"_blank\" rel=\"noopener noreferrer\">student body presidents<\/a>\u00a0from around New Mexico\u00a0have spoken out <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/former-gov-carruthers-pushes-back-against-higher-education-veto\/\" target=\"_blank\" rel=\"noopener noreferrer\">against the veto<\/a>.<\/p>\n<p>But how lawmakers will\u00a0fund the budget without tax increases &#8212; which Martinez has said\u00a0must be part of\u00a0the comprehensive reform Egolf says won&#8217;t happen &#8212; isn&#8217;t clear.<\/p>\n<p>Martinez wants to take $12.5 million from the state employees&#8217; retirement fund, which also goes to lawmakers&#8217; retirements, to help plug the budget hole. The Public Employees Retirement Association, which manages that fund, says taking money from it <a href=\"http:\/\/nmpolitics.net\/index\/2017\/05\/taking-lawmakers-retirement-funds-is-unconstitutional-pera-says\/\" target=\"_blank\" rel=\"noopener noreferrer\">is unconstitutional<\/a>. While House Republicans, the minority party in that chamber, back the proposal, it&#8217;s unlikely to clear the House or Senate.<\/p>\n<p>An attempt to override Martinez&#8217;s vetoes is possible, but unlikely.<\/p>\n<p>Martinez decides the agenda for the session and when it begins, but the House and Senate decide when they adjourn. The length of the session is unclear.<\/p>\n<p>If the governor and lawmakers can\u2019t reach agreement, the Legislative Council could go back to the N.M. Supreme Court after the session and ask it to restore higher education and legislative funding. The high court dismissed the Legislative Council\u2019s petition <a href=\"http:\/\/nmpolitics.net\/index\/2017\/05\/supreme-court-tosses-budget-standoff-back-to-lawmakers-and-governor\/\" target=\"_blank\" rel=\"noopener noreferrer\">earlier this month<\/a>, which argued that the vetoes were unconstitutional, saying it wasn\u2019t ripe for judicial review.<\/p>\n<p>You&#8217;ll be able to watch webcasts of the House and Senate <a href=\"http:\/\/sg001-harmony.sliq.net\/00293\/harmony\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.
