{"id":3529,"date":"2008-08-04T11:59:00","date_gmt":"2008-08-04T17:59:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/08\/defeated-lawmakers-allege-conspiracy-in-lawsuit\/"},"modified":"2008-08-04T11:59:00","modified_gmt":"2008-08-04T17:59:00","slug":"defeated-lawmakers-allege-conspiracy-in-lawsuit","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/08\/defeated-lawmakers-allege-conspiracy-in-lawsuit\/","title":{"rendered":"Defeated lawmakers allege conspiracy in lawsuit"},"content":{"rendered":"<p class=\"MsoNormal\">Three lawmakers who were defeated by progressive challengers in the June primary filed a lawsuit Friday alleging a \u201csecret campaign\u201d by nonprofit groups and their opponents that skirted campaign-finance laws and defrauded voters.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Because of the alleged conspiracy, the lawmakers say, their losses should be voided.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">State Sens. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=282&amp;Submit=Search\" target=\"_blank\">Shannon Robinson<\/a> and <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=232&amp;Submit=Search\" target=\"_blank\">James Taylor<\/a> and Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=226&amp;Submit=Search\" target=\"_blank\">Dan Silva<\/a>, all Albuquerque Democrats, say the alleged conspirators funneled at least $180,000 through the nonprofits, which aren\u2019t subject to campaign disclosure laws, and used the money to distribute literature and make phone calls, according to the <a href=\"http:\/\/www.abqjournal.com\/news\/metro\/03112653metro08-03-08.htm\" target=\"_blank\">Albuquerque Journal<\/a>. Without that effort, the lawmakers claim, they would have won the primary races.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Instead, <a href=\"http:\/\/www.ericgriegofornewmexico.com\/\" target=\"_blank\">Eric Griego<\/a> defeated <st1:city st=\"on\"><st1:place st=\"on\">Taylor<\/st1:place><\/st1:city> by 24 percentage points, <a href=\"http:\/\/www.timkellerfornewmexico.com\/\" target=\"_blank\">Tim Keller<\/a> defeated Robinson by 32 points and <a href=\"http:\/\/www.eleanorchavez.com\/\" target=\"_blank\">Eleanor Chavez<\/a> defeated Silva by eight points. Unless the court rules otherwise, the incumbents will leave office at the end of the year.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The lawsuit was filed in district court in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">According to the Journal, the lawsuit names as defendants several progressive groups &#8212; the <a href=\"http:\/\/www.civicpolicy.com\/\" target=\"_blank\">Center for Civic Policy<\/a> and its director, <a href=\"http:\/\/www.cvnm.org\/\" target=\"_blank\">Conservation Voters of New Mexico<\/a> and its director and president, <a href=\"http:\/\/www.swop.net\/\" target=\"_blank\">SouthWest Organizing Project<\/a> and its director, and <a href=\"http:\/\/www.newenergyeconomy.org\/\" target=\"_blank\">New Energy Economy Inc.<\/a> and its president and director. The groups have engaged in what they call a \u201cLegislative Accountability Project\u201d that has used mailers, radio ads and phone calls to highlight lawmakers\u2019 voting records.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The recent work of the nonprofit groups has been controversial. The attorney general\u2019s office earlier this year advised the secretary of state to change the status of one arm of the Center for Civic Policy, New Mexico Youth Organized, to force it to comply with reporting standards for political groups and candidates instead of those for nonprofits. The AG says the group\u2019s targeting of the incumbents who lost crossed the line into campaign activity.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The group has disputed the AG\u2019s opinion. It points to the approaching special session and the fact that it also targeted lawmakers who didn\u2019t face primary challengers as evidence that its work is focused on policy, not politics. In addition, it points out, the mailers were sent out two to three months before the June primary.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The secretary of state has not yet acted, though a final decision on the status of New Mexico Youth Organized could come as early as this week.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Groups\u2019 work has continued<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the meantime, the Legislative Accountability Project has continued. Four lawmakers, including Sen. <a href=\"http:\/\/senatorrawson.com\/\" target=\"_blank\">Leonard Lee Rawson<\/a>, R-Las Cruces, have been targeted in <a href=\"http:\/\/haussamen.blogspot.com\/2008\/07\/group-hits-sen-rawson-with-mailers.html\">recent mailers and radio ads<\/a>. Rawson has accused New Mexico Youth Organized, which sent the mailers targeting him, of conspiring with his Democratic opponent <a href=\"http:\/\/www.stevefornmsenate.com\/\" target=\"_blank\">Steve Fischmann<\/a> to skirt reporting laws, but Fischmann and the group say they are not working together.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In May, Neri Holguin, who managed two of the three <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> challengers\u2019 campaigns, told the Journal that the campaigns did not coordinate with the nonprofits or share campaign money. Eli Il Yong Lee, director of the Center for Civic Policy, said today in a statement that the groups are focused on \u201cworking for ethics reform, good government, health care and a clean environment.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cAs nonpartisan, not-for-profit organizations, it is our responsibility to educate the public about the votes and contributions of our elected officials,\u201d he said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Lee said his group has not seen the lawsuit and can\u2019t comment further at this time.<\/p>\n<p class=\"MsoNormal\">Robinson told the Journal that the groups \u201ccan\u2019t create a scheme to violate campaign finance laws. \u2026 It\u2019s fraud.\u201d The newspaper notes that Robinson declined to share any evidence to back up the claims in the lawsuit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-style: italic;\" class=\"MsoNormal\">\n<p style=\"font-style: italic;\" class=\"MsoNormal\">By way of disclosure, I also write for the <a href=\"http:\/\/www.newmexicoindependent.com\/\" target=\"_blank\">New Mexico Independent<\/a>, which is owned by the <a href=\"http:\/\/www.newjournalist.org\/\" target=\"_blank\">Center for Independent Media<\/a> in <st1:state st=\"on\"><st1:place st=\"on\">Washington<\/st1:place><\/st1:State>. When the group was starting up its <st1:state st=\"on\"><st1:place st=\"on\">New   Mexico<\/st1:place><\/st1:State> news site earlier this year, the Center for Civic Policy helped it locate funding sources.
