{"id":34672,"date":"2011-12-21T10:51:28","date_gmt":"2011-12-21T17:51:28","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=34672"},"modified":"2011-12-21T10:51:35","modified_gmt":"2011-12-21T17:51:35","slug":"prc-violated-state-and-federal-law-audit-finds","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2011\/12\/prc-violated-state-and-federal-law-audit-finds\/","title":{"rendered":"PRC violated state and federal law, audit finds"},"content":{"rendered":"<div id=\"attachment_8844\"  class=\"wp-caption module image alignright\" style=\"max-width: 250px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-8844\" title=\"Balderas, Hector\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2009\/11\/Balderas-Hector.jpg\" alt=\"\" width=\"250\" height=\"234\" \/><\/a><p class=\"wp-caption-text\">State Auditor Hector Balderas<\/p><\/div>\n<p>The <a href=\"http:\/\/nmprc.state.nm.us\/\" target=\"_blank\">Public Regulation Commission<\/a> violated state and federal laws related to employees\u2019 and commissioners\u2019 use of state vehicles and gas cards, state Auditor <a href=\"http:\/\/nmprc.state.nm.us\/\" target=\"_blank\">Hector Balderas<\/a> announced today in releasing an audit of the agency.<\/p>\n<p>You can read the full audit <a href=\"http:\/\/osanm.org\/media\/audits\/430_Public_Regulation_Commission_FY2011.pdf\" target=\"_blank\">here<\/a>, but here\u2019s how the auditor\u2019s news release summed things up:<\/p>\n<blockquote><p>\u201c \u2022 In violation of federal tax regulations, the PRC did not keep records that track the business and personal use of government vehicles used by PRC Commissioners and employees.\u00a0The independent auditor found that the PRC is underreporting fringe benefit income to Commissioners and employees who are commuting in a state vehicle;<\/p>\n<p>\u201c \u2022 Over $30,000 in unauthorized gas purchases and other products may have been made with PRC-issued gas credit cards in fiscal year 2011;<\/p>\n<p>\u201c \u2022 The independent auditor found the PRC violated state law by failing to properly report information to the State Auditor about potential fraudulent gas card charges by former Commissioner Block, which may have unreasonably delayed investigations of wrongful activity at the agency;<\/p>\n<p>\u201c \u2022 20 persons at the PRC made hundreds of prohibited purchases of premium gas in violation of state regulations;<\/p>\n<p>\u201c \u2022 One Commissioner\u2019s use of a state-owned Ford F-250 truck resulted in questioned costs and was in noncompliance with a federal program.\u00a0\u00a0The Commissioner drove the truck for a period approximating 30 days; and<\/p>\n<p>\u201c \u2022 State vehicles were taken out of state in violation of state regulations.\u201d<\/p><\/blockquote>\n<p>This was a regular financial audit of the PRC by the firm Atinkson and Co., Ltd.
